. 1 STATEMENT OF WORK
BACKGROUND
The National Institute of Standards and Technology (NIST) include three (3) Directorates that use MTS instruments to support its mission. Two of these Directorates are the Engineering Laboratory (EL) and the Material Measurement
Laboratory (MML).
The EL promotes U.S. innovation and industrial competitiveness in areas of critical national priority by anticipating and meeting the measurement science and standards needs for technology-intensive manufacturing and construction Staff members serve on about 130 committees and working groups, many in leadership positions. For example, the output of
EL research is a source of technical information for (ASHRAE), the American Society of Mechanical Engineers (ASME), the American Institute of Steel Construction (AISC),, Underwriters Laboratories, Inc. (UL), the International Organization for Standardization (ISO), the International Council for Research and Innovation in Building and Construction (CIB), the
International Code Council (ICC), and the Construction Industry Institute.
The Material Measurement Laboratory is one of seven metrology laboratories within the National Institute of Standards and Technology (NIST). The laboratory supports the NIST mission by serving as the national reference laboratory for measurements in the material sciences. Our activities range from fundamental and applied research on the composition, structure and properties of industrial, materials and processes, to the development and dissemination of tools including reference measurement procedures, certified reference materials, critically evaluated data, and best practice guides that help assure measurement quality. Our research and measurement services support areas of national importance, such as
Manufacturing, from lightweight alloys for fuel-efficient automobiles to biomanufacturing and data for chemical manufacturing
MTS Systems Corporation (hereafter referred to as MTS) instruments owned and used by EL and MML are identified in
Section II of this Statement of Work (SOW).

. 2 ORDERING INSTRUCTIONS
PAGE 18 OF 62 SB1341-15-RQ-0636
The Government anticipates that a single award will be made, however, the Government reserves the right to make multiple awards if it is determined to be in the Government’s best interest to do so. The ordering procedures below apply to multiple awardees and may be modified at the time of award if a single award is made.
Individual task orders will be procured through competition among contract holders. The
Government intends to limit competition to contract awardees only.
This section sets procedures and criteria that will be used to provide multiple awardees a fair opportunity to be considered for each task order issued under this indefinite delivery/indefinite quantity (IDIQ) contract.
(a) Except as provided for in paragraph (b) of this section, for orders issued under this multiple award IDIQ, each awardee shall be provided a fair opportunity to be considered for each order in excess of $3,000.
In determining the procedures for providing awardees a fair opportunity to be considered for each order, the Government will compete the orders among all awardees. Accelerated or streamlined procedures, such as e-mail quotations shall be utilized.
The Government need not contact each of the awardees under the IDIQ before selecting a task order awardee if the Government has information available to ensure that each
Contractor is provided a fair opportunity to be considered for each order.
(b) Awardees need not be given an opportunity to be considered for each order in excess of $3,000.00 under multiple award IDIQs if the Government determines that:
(1) The agency's need for such services is of an urgency that providing such opportunity would result in unacceptable delays;
(2) Only one Contractor is capable of providing such services required at the level of quality required because the supplies or services ordered are unique or highly specialized;
(3) The order should be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the agreement, provided that all awardees were given a fair opportunity to be considered on the original award.
(c) Ordering shall take place through a competitive process. A request for quotation package shall be forwarded to awardees via e-mail. The following documents shall be included in the request for quotation package:
1. The statement of work and all associated attachments;
2. The due date for quotations;
3. The period of performance for the required services; and
4. Whether the task order will be firm fixed price or time and materials.
(d) Written solicitation packages will be sent via e-mail to the attention of each awardee's Project Director. Solicitations will identify a due date & time for quotes.
E-mail quotations shall be acceptable.
When submitting an e-mail response, the Contractor agrees to be bound by the originator of the e-mail the same as if submitted under an original signature.
All submissions must be received on or before the due date and time specified in the RFQ.
Information received after the due date and time shall be considered late and will not be considered.
PAGE 19 OF 62 SB1341-15-RQ-0636
Response times may vary for quotations, however, the Government anticipates that a response time of five business days from the date the quotation is forwarded via email will be required.
(e) Upon receipt of the Request for Quotation Package, Contractors shall prepare a firm fixed-price or time and materials quotation and submit that quotation to the Contract
Specialist on or before the date and time specified in the RFQ, via email.
The quotation shall include all costs necessary to complete the required work. Travel shall be quoted in accordance with Government Travel Regulations. Quotations must utilize the labor rates and any other rates negotiated in the base contract. Quotations must break out costs for labor, parts, travel and any additional other direct costs that are required to complete the work.
Contractors shall also submit a technical summary of the work that will be performed.
(f) All timely quotations shall be reviewed by the Contract Specialist, the Contracting
Officer’s Representative (COR) and/or other authorized NIST Technical Personnel. If it is determined to be in the best interest of the Government, the Contract Specialist and/or the Contracting Officer will enter into discussion with the quoters.
If discussions are conducted, a revised quotation may be requested. Revised quotations will be re-evaluated by the COR and the Contracting Officer.
Quoters must submit their best quotation in responding to individual Requests for
Quotation, as the Government anticipates making awards without discussions.
(g) Award shall be made on a lowest price/technically acceptable basis unless otherwise indicated in the request for quotation.
(h) Every order placed under the IDIQ will be separately evaluated for price reasonableness by the Contracting Officer.
(i) Upon completion of evaluation, the Contracting Officer will issue a firm fixed-price or time and materials task order to the successful quoter.
(j) Upon receipt of an executed task order, the Contractor shall commence work as required by that order.
