QUESTIONS AND ANSWERS PURSUANT TO RFQ SB1341-15-RQ-0574

(LITIGATION SEARCHES)

Q1. For “litigation searches” are you needing civil, judgment, and/or criminal searches or a combination of these?

A1. A combination

Q2. If you are requesting civil litigation searches would you want pending only or closed as well?

A2. Pending and closed

Q3. Do you need defendant only cases or would you require us to report on cases as plaintiff as well?

A3. Defendant

Q4. Would copies be required with these or just register of actions/dockets

A4. Just a register, but copies may be needed. NIST would request on a case-by-case basis, if needed.

Q5. Where are the searches needed and at what level (Please include State and if County or USDC-Fed)?

A5. USDC Fed., state, county / local.

Q6. It would be helpful to have an estimate of the no. of organizations being considered or vetted each yr. for the Malcolm Baldrige National Quality Award. Pricing would be impacted based on volume. If you don’t have a specific no. it would be helpful to a least have some historical information as a guide.

A6. 10-15 is typical

Q7. The SoW indicates that there are potentially 43,000 local Courts and it is understood that not all of these have searchable electronic records. Would it be possible to quote based on a local search and as a separate item an optimal travel expense at cost and within Federal guidelines?

A7. The offeror may quote off their typical business model. NIST needs to know how much the total cost per search will be, all fees included.

Q8. It is possible for numerous Courts to have jurisdiction over an organization or individual. Is the expectation that the Contractor search the most logical Court based on the organization’s primary location or the residence (if known) of the HRO or should this be a broader search?

A8. The HRO is only searched if named in the organization lawsuit, not personal records relating to his/her residence.

Q9. Is this a follow-on requirement? If so, could you please provide the incumbent contract no.

for this opportunity?

A9. Yes. SB1341-11-SE-0969

Q10. Is RFQ SB1341-15-RQ-0574 a blanket contract or one contractor for the entire contract?

A10. One contractor for the entire contract

Q11. Please clarify the quantity nos. in the CLINs. Is 0001 108 searches total, or 108 sets of 3 searches each? Does 0002 require 15 add’l. searches for each nominee? Does 0003 require 200 copies of each docket found?

A11. 108 searches total; 15 add’l. searches; it is possibly up to 200 pages, not copies, from dockets but this is only on an as-requested basis.
