This is a solicitation for a firm-fixed price construction contract NAICS 332311. The Contractor shall provide all labor, material and equipment to provide, or fabricate and install a self-contained temperature and humidity controlled class 1000 clean room mini environment, (hereinafter referred to as the clean room) as described herein and the attached drawings.

The magnitude of the this project is Between $25,000 and $100,000.

The contractor is required to submit a safety plan for this project. The contractor shall provide a safety plan within (5) calendar days from contract award to the contracting Safety officer CORS. The government has

(7) calendar days to review and provide comments or approve the safety plan. The contractor has (3) calendar days to respond to the contracting officer to revise the safety plan.

STATEMENT OF WORK

Project Name: Installation of Mass Spectrometer Procurement and Installation of Class 1,000 Temperature and Humidity Controlled Clean Room Mini- Environment

Project Location: Building 245 Rooms C-10 Basement

Start Date: 1 Week from contract award

A. Brief description of work:

Contractor shall supply all labor, material and equipment to provide, or fabricate and install a self-contained temperature and humidity controlled class 1,000 clean room mini environment (hereinafter referred to as the clean room) as described herein and the attached drawings.

B. Period of Performance:

1) The clean room mini environment shall be designed, fabricated and installed within 90 days from contract award.

2) On-site installation shall not start until all material and components are delivered on site.

C. Product Requirements:

1) Refer to attached drawings for clean room area outline, doors and type of panels and locations.

2) The clean room shall consist of two sections separated by a sliding glass door;

a. A 12’x12’ temperature and humidity controlled clean room

b. A 4’x6’ gowning vestibule/anteroom

3) The clean room enclosure shall be standalone and provided with its own HVAC equipment to provide air circulation as well as temperature and humidity control.

4) Entrance to the clean room shall be via removable entry vestibule. The removable vestibule shall be configured such that it can demounted and temporarily moved away to enable the passage of instrument in and out of the room. The two spaces shall be separated by a 48”x84” sliding glass door.

Otherwise, the vestibule shall be securely fastened to the clean room enclosure.

D. Material of Construction:

1) Clean Room and Entry Vestibule Enclosure, General:

i. The two sections shall be sized and arranged as listed above and as shown on attached drawings.

ii. Together with its self-contained HVAC system, ductwork and accessories, the clean room mini environment shall be designed and fabricated to fit in the designated area in the lab and accessible via a single door located as shown.

iii. The thickness of the mini environment wall assemblies shall not exceed 2¼" at any location except at the single sliding glass door separating the gowning room and the main clean room.

iv. The clean room mini environment shall be able to be disassembled in sections and/or pieces for future reconfiguration, disassembly, storage and/or disposal.

v. All surfaces, edges and corners shall be true to line and free from projections that could cause injury or damage.

vi. Accessibility:

The clean room assembly shall be provided with means to move the instruments in and out. This can be accomplished by means of a service door and/or hinged or removable panels.

2) Framing Components

i. All studs and battens shall be aluminum extrusions with anodized clear finish.

ii. Studs and battens shall fasten together tightly creating a sealed joint connection and secure alignment of panels.

iii. All connections of horizontal and vertical framing shall be secured properly utilizing engineered devices as specified by the clean room manufacturer to pull all joints together.

iv. The batten shall clamp against the front of the post and permit the attachment of conduit, shelving, and utility hardware through the screw boss in the batten.

v. The back of the stud post shall provide a strut design to support utility lines and piping.

vi. A removable enclosure cap conceals fasteners of the batten to the stud post.

vii. Studs and battens shall allow wall panels to be installed or removed easily without disturbing adjacent wall panels or ceiling. All vertical framing members and corners, shall be interchangeable and capable of being placed anywhere along the wall plane and corners without loss of strength.

viii. Materials and connections shall be manufacturer's standard, capable of supporting design forces. Provision shall be made for movement of surrounding structure in design of separations and joints. Structural members shall be sufficiently stiff to allow proper operations of vibration isolation equipment and ceiling filter sealant systems.

ix. The framing system shall be coordinated with building structure to perform under vertical and lateral design loads and seismic requirements.

x. Deflection head must be capable of 3/4" downward movement.

xi. Materials:

1. Metal Framing: Aluminum 6063-T5 alloy.

2. Fittings: ASTM-A36 or ASTM-A635.

3. Finish: 201R1 anodized, clear finish.

3) Clean Room Wall Panel System:

i. Wall panels shall be finished flush on one side and minimize the need for field cutting.

ii. Opaque Panels:

Opaque wall panels shall be .032" smooth aluminum with a smooth conductive epoxy finish laminated to both sides of an aluminum honeycomb core.

a. Wall panel shall have a surface resistivity in the range of 106 to 109 ohms/square per EOS/ESD-S11.11-1993, which supersedes ASTM- D257, and an electrostatic decay of <10% IN, .5/sec. per method 4066 Federal Test Method Standard 101B.

b. Colors: As selected by the Owner from manufacturer's standard panel colors.

iii. Transparent Panels:

Transparent Panels shall be 1/4" tempered safety glass.

iv. Return Air Grilles:

Return air grilles shall be manufacturer's standard installation designed to fit the clean room’s wall system.

4) Electrical Requirements:

Provide top mounted independent single point connection junction boxes as follows:

i. Instrument Power:

a) Provide 3P-30A, 25A Fuse, 600V, HD Disconnect Switch with locking provision plate Cat#: EATON DH321NGK.

b) Provide feeder 4-6AWG+1-10AWG Gnd THHN Copper wire in 1” EMT conduit from disconnect to a terminal junction box by terminating wires to a terminal blocks with separation barrier mounted on the ceiling for easy connection of power feed at site.

ii. Power Strip

a) Provide Aluminum Wiremold raceway Type ALA4800 with dividers one for power and one for mounting Tele-data devices, along the wall.

b) Provide 20A, 120V, 6 orange color isolated ground dedicated duplex receptacles (4 on west & 2 on east) on the raceway.

c) Provide 20A, 120V, 4 ivory color duplex receptacles 2 on either side on the raceway.

d) Provide 12AWG wire for receptacle circuit with 10 twists per foot. The circuits run in raceway power channel and terminate above ceiling at terminal blocks with separation barrier in a box for easy connection of circuit at site.

iii. HVAC Power & Lighting Provide Terminal block with separation barrier junction box for mechanical AC units and ceiling lighting for easy connection at site.

Power available 208V single or 3 Phase.

iv. Emergency Power Trip Provide Emergency Trip Pushbutton with push to trip 2 separate 120V contacts and wire with 12AWG THHN Copper wire. Terminate 2 Trip circuit and terminate above ceiling at terminal blocks with separation barrier in a box for easy connection of circuit at site.

v. Fire Alarm Provide a junction box with empty 3/4” conduit with pull string up to a junction box for installing Fire Alarm Strobe and wiring by NIST at site.

E. Manufacturers:

1) The use of a manufacturer's name, model or catalog number is for the purpose of establishing the standard of quality and general configuration.

Provide clean room mini environment designed, fabricated and assembled by a single supplier listed or approved equal.

2) Contractor shall provide and install a Class 1000 hard wall modular cleanroom enclosure with packaged HVAC system, per specification and attached drawings. The entire clean room assembly shall be the end product of a firm who is experienced in the design and manufacturing of modular cleanrooms and guarantees achieving the required performance and the standardization for appearance, maintenance, and replacement parts.

3) Acceptable manufacturers include:

E. General Requirements:

The Contractor and his employees and subcontractors shall become familiar with and obey all NIST Site Regulations, including fire, traffic, and security regulations. All personnel employed on the site shall keep within the limits of the work (and avenues of ingress and egress), and shall not enter any restricted areas unless required to do so and are cleared for such entry.

F. Material / Equipment Storage

1) Contractor access shall be limited to the designated work area and the general areas in the building.

2) All material must be stored in the area designated by the COR outside the building. The Contractor shall adequately protect all materials from the weather.

3) The Contractor shall not store any material inside the building.

4) The Contractor’s tools and equipment shall be conspicuously marked for identification. The contractor shall be responsible for securing and protecting all tools, equipment and/or material used, stored or staged on the job site at all times.

G.Environmental Protection

1) Disposal of Refuse:

a. Unless otherwise noted, the Contractor is totally responsible for the removal and disposal of all demo material, refuse, garbage and trash associated with this project. Disposal of such material shall be in accordance with the requirements of the local jurisdiction.

2) Disposal of Hazardous Wastes:

a. Any hazardous wastes generated by the Contractor shall be properly controlled and disposed by the Contractor in accordance with applicable RCRA (40CFR) and COMAR (Title 26) regulations.

3) Covered Chutes:

a. All chutes for refuse, and the like, shall be covered, or of such a design to fully confine the material to prevent the dissemination of dust.

H.Construction Site Maintenance:

1) The Contractor and all Subcontractors on, or delivering material to, the site shall conform to all local regulations regarding load limits.

2) The Contractor shall store all Contractor tools, equipment and material supplies on project site so as to preclude mechanical and climatic damage and maintain site in a neat and orderly manner.

3) Contractor shall be responsible for maintaining any temporary structures clean, visually pleasant and in good repair.

I. Noise Control:

The Contractor shall comply with all applicable local laws, ordinances, and regulations relative to noise control. Any noise generating activities shall be planned and the building occupants notified in advance.

J. Asbestos Material:

No asbestos containing material is expected to be encountered by the Contractor on this project. If material is encountered that looks suspicious but must be disturbed, do not touch the material and immediately notify the COR in writing. Within fourteen

(14) calendar days, the Government will perform laboratory tests to determine if there is asbestos. If asbestos is not a danger, the Contracting Officer will direct the Contractor to proceed without change. If the material encountered is suspect or confirmed to contain asbestos, the Contracting Officer will direct a change.

K.Occupational Safety and Health:

1) NIST, as a Federal government facility in the State of Maryland, is under the jurisdiction of the OSHA Region III regional office, which may assign an OSHA Compliance Safety and Health Officer (CSHO) to conduct safety and health inspections of the Contractor’s operations at the NIST Gaithersburg site.

Accordingly, the Contractor is subject to OSHA Citations and Notices of Penalty for noncompliance with OSHA standards.

2) To protect its own interests, NIST may also conduct periodic safety and health inspections to assure that NIST employees/property are not at risk of injury/damage from Contractor operations, and to avoid the risk of OSHA Citations under the OSHA multi-employer worksite provisions.

3) Control of Hazardous Energy (Lockout/Tag-out): In accordance with the provisions of OSHA standards 29CFR1910.147 and 29CFR1926.417, the Contractor shall establish and implement a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on electrical circuits/equipment, machines or other equipment/systems where the unexpected energizing, start up or release of stored energy could occur and cause injury, the circuit/machine/equipment/system shall be isolated from the energy source and rendered inoperative.

4) Electrical Installations and Work Practices: The Contractor shall comply with all applicable installation safety requirements, safety-related maintenance and environmental considerations, and safety requirements for special equipment as contained in Subpart K (Electrical) of 29CFR1926.

5) Personal Protective and Life Saving Equipment: In accordance with the provisions of Subpart E (Personal Protective and Life Saving Equipment) of 29CFR1926, the Contractor shall ensure that protective equipment (including personal protective equipment for eyes, head, face, head and extremities;

protective clothing; respiratory devices; and protective shields and barriers) shall

be provided, used and maintained in a sanitary and reliable condition whenever it is necessary by reason of hazards of process or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of the body through absorption, inhalation or physical contact. The contractor shall wear safety glasses at all times at NIST.

6) Tools-Hand and Power: The Contractor shall ensure compliance with all applicable safety requirements for tools (hand and power) as outlined in Subpart I (Tools-Hand and Power) of 29CFR1926.

L. Security:

1) The Contractor(s) shall be on the NIST grounds only between the hours of 6:30 a.m. and 5:30 p.m. (normal work hours) on normal Federal work days. Should the Contractor(s) desire to work at times other than those specified above, the dates and hours must be scheduled at least seven (7) working days in advance and approved by the NIST Security Office through the Contracting Officer. After hours work will require a Government escort 100% of the time.

2) Prior to the employment of any foreign national at the contract work site, the Contractor must have such employees approved by the Servicing Security Office in consultation with the Department’s Office of Security in accordance with the National Security Threat List. The name, country of citizenship, and employer for each Contractor and subcontractor’s employee (visitor) working on the NIST site shall be submitted to the COR for review thirty (30) days prior to the work date.

Non U.S. citizens to be employed under this contract must have official legal status in the U.S. and have continuously resided in the United States for the last five years.

3) Contractor personnel may be required to wear picture identification badges at all times on the NIST grounds, as determined by the Contracting Officer. Contractor will be required to complete a Department of Commerce background check.

4) The main gate at the National Institute of Standards and Technology site shall be used for material supply and personnel by the Contractor and subcontractors unless otherwise directed by the COR. The gate will be open from 6:30 a.m. and 5:30 p.m., Monday through Friday inclusive. Special arrangements may be made through the Contracting Officer and National Institute of Standards and Technology for normal access, material supply, and/or overtime beyond these hours or on Holidays.

M. Submittals:

Submit the following in addition to the standard requirements.

1) Manufacturer's literature, specifications, details, and installation instructions for each cleanroom wall component proposed. Including technical data as may be

required to show compliance with applicable codes and standards as well as design and specifications.

2) Provide one sample of each wall system component with proposed finishes, gaskets, and connectors. Include any other components as necessary to illustrate a completed wall assembly.

3) One set of samples of each finish and color required. Submit sample finishes on aluminum having the specified alloy, temper, finish-coating treatment, and thickness of metal required for the work.

4) Provide 6-inch (minimum) square color samples of available standard wall panel colors and finishes.

5) All samples will be reviewed for color and finish only. Compliance with all other requirements is the exclusive responsibility of the Contractor.

N. Delivery Storage and Handling:

1) Deliver materials in their original, unopened packages.

2) Wall system panels shall be delivered with an approved clear PVC film. Wall system shall be packaged to prevent transit and construction dust from contaminating surfaces. Stripping of packaging and coatings to be done after installation of wall panels.

3) Exercise extreme care in handling all cleanroom wall system components to prevent damage.

4) Store materials within the building in the space designated for cleanroom component storage. Store materials in such manner as to prevent damage or intrusion of foreign matter. Conspicuously mark "Rejected" on materials, which have been damaged, and remove from the job-site.

O. Installation and Testing:

1) Final installation of partition components shall assemble into a rigid structure with tight straight-line joints. Completed installation shall be free of exposed bolts, nuts, rivets, and fasteners within the cleanroom area and shall interface with a ll mechanical and electrical work in a clearly preplanned and craftsman-like installation.

2) Contractor shall obtain third party testing and certification of cleanroom to Federal Standard 209E Class 1000 (ISO 6) after initial installation per ISO Standards 14644-1, 14644-2, and 14644-3. Minimum tests should include:

a. Particle Counts

b. HEPA Filter Leak Test

c. Room Pressurization

3) Contractor shall provide startup, testing and balancing, and commissioning of HVAC system.

P. Warranty

H. 2 1352.209-73 COMPLIANCE WITH THE LAWS (APR 2010)

The contractor shall comply with all applicable laws, rules and regulations which deal with or relate to performance in accord with the terms of the contract.

H. 3 1352.228-70 INSURANCE COVERAGE (APR 2010)

(a) Workers Compensation and Employer?s Liability. The contractor is required to comply with applicable federal and state workers'' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer?s liability section of the insurance policy, except when contract operations are so commingled with a contractor?s commercial operations that it would not be practical to require this coverage. Employer?s liability coverage of at least $100,000 shall be required, except in states with exclusive or monopolistic funds that do not permit workers'' compensation to be written by private carriers.

(b) General liability.

(1) The contractor shall have bodily injury liability insurance coverage written on the comprehensive form of policy of at least $500,000 per occurrence.

(2) When special circumstances apply in accordance with FAR 28.307-2(b), Property Damage Liability Insurance shall be required in the amount of $$500,000.00 .

(c) Automobile liability. The contractor shall have automobile liability insurance written on the comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract.

Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage.

(d) Aircraft public and passenger liability. When aircraft are used in connection with performing the contract, the contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger liability, and $200,000 per occurrence for property damage. Coverage for passenger liability bodily injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

(e) Vessel liability. When contract performance involves use of vessels, the Contractor shall provide, vessel collision liability and protection and indemnity liability insurance as determined by the Government.

When the Government is injured, wholly or partially as a result of the contractor?s actions and such actions are covered by the insurance required by 1352.228-70, Insurance Coverage, the Government is entitled to recover from the contractor the full amount of any such injury attributable to the contractor regardless of a deductible. The Contracting Officer may offset the amount of recovery against any payment due to the contractor.

H. 5 1352.237-71 SECURITY PROCESSING REQUIREMENTS - LOW RISK CONTRACTS (APR 2010)

(a) Investigative Requirements for Low Risk Contracts. All contractor (and subcontractor) personnel proposed to be employed under a Low Risk contract shall undergo security processing by the Department?s Office of Security before being eligible to work on the premises of any Department of Commerce owned, leased, or controlled facility in the United States or overseas, or to obtain access to a Department of Commerce IT system. All Department of Commerce security processing pertinent to this contract will be conducted at no cost to the contractor.

(b) Investigative requirements for Non-IT Service Contracts are:

(1) Contracts more than 180 days - National Agency Check and Inquiries (NACI)

(2) Contracts less than 180 days - Special Agency Check (SAC)

(c) Investigative requirements for IT Service Contracts are:

(1) Contracts more than 180 days - National Agency Check and Inquiries (NACI)

(2) Contracts less than 180 days - National Agency Check and Inquiries (NACI)

(d) In addition to the investigations noted above, non-U.S. citizens must have a background check that includes an Immigration and Customs Enforcement agency check.

(e) Additional Requirements for Foreign Nationals (Non-U.S. Citizens). Non-U.S. citizens (lawful permanent residents) to be employed under this contract within the United States must have:

(1) Official legal status in the United States;

(2) Continuously resided in the United States for the last two years; and

(3) Obtained advance approval from the servicing Security Officer in consultation with the Office of Security headquarters.

(f) DOC Security Processing Requirements for Low Risk Non-IT Service Contracts. Processing requirements for Low Risk non-IT Service Contracts are as follows:

(1) Processing of a NACI is required for all contract employees employed in Low Risk non-IT service contracts for more than 180 days. The Contracting Officer?s Representative (COR) will invite the prospective contractor into e-QIP to complete the SF-85. The contract employee must also complete fingerprinting.

(2) Contract employees employed in Low Risk non-IT service contracts for less than 180 days require processing of Form OFI-86C Special Agreement Check (SAC), to be processed. The Sponsor will forward a completed Form OFI-86C, FD-258, Fingerprint Chart, and Credit Release Authorization to the servicing Security Officer, who will send the investigative packet to the Office of Personnel Management for processing.

(3) Any contract employee with a favorable SAC who remains on the contract over 180 days will be required to have a NACI conducted to continue working on the job site.

(4) For Low Risk non-IT service contracts, the scope of the SAC will include checks of the Security/Suitability Investigations Index (SII), other agency files (INVA), Defense Clearance Investigations Index (DCII), FBI Fingerprint (FBIF), and the FBI Information Management Division

(FBIN).

(5) In addition, for those individuals who are not U.S. citizens (lawful permanent residents), the Sponsor may request a Customs Enforcement SAC on Form OFI-86C, by checking Block #7, Item I. In Block 13, the Sponsor should enter the employee?s Alien Registration Receipt Card number to aid in verification.

(6) Copies of the appropriate forms can be obtained from the Sponsor or the Office of Security.

Upon receipt of the required forms, the Sponsor will forward the forms to the servicing Security Officer. The Security Officer will process the forms and advise the Sponsor and the Contracting Officer whether the contract employee can commence work prior to completion of the suitability determination based on the type of work and risk to the facility (i.e., adequate controls and restrictions are in place). The Sponsor will notify the contractor of favorable or unfavorable findings of the suitability determinations. The Contracting Officer will notify the contractor of an approved contract start date.

(g) Security Processing Requirements for Low Risk IT Service Contracts. Processing of a NACI is required for all contract employees employed under Low Risk IT service contracts.

(1) Contract employees employed in all Low Risk IT service contracts will require a National Agency Check and Inquiries (NACI) to be processed. The Contracting Officer?s Representative (COR) will invite the prospective contractor into e-QIP to complete the SF-85. Fingerprints and a Credit Release Authorization must be completed within three working days from start of work, and provided to the Servicing Security Officer, who will forward the investigative package to OPM.

(2) For Low Risk IT service contracts, individuals who are not U.S. citizens (lawful permanent residents) must undergo a NACI that includes an agency check conducted by the Immigration and Customs Enforcement Service. The Sponsor must request the ICE check as a part of the NAC.

(h) Notification of Disqualifying Information. If the Office of Security receives disqualifying information on a contract employee, the Sponsor and Contracting Officer will be notified. The Sponsor shall coordinate with the Contracting Officer for the immediate removal of the employee from duty requiring access to Departmental facilities or IT systems. Contract employees may be barred from working on the premises of a facility for any of the following reasons:

(1) Conviction of a felony crime of violence or of a misdemeanor involving moral turpitude.

(2) Falsification of information entered on security screening forms or of other documents submitted to the Department.

(3) Improper conduct once performing on the contract, including criminal, infamous, dishonest, immoral, or notoriously disgraceful conduct or other conduct prejudicial to the Government regardless of whether the conduct was directly related to the contract.

(4) Any behavior judged to pose a potential threat to Departmental information systems, personnel, property, or other assets.
