About this file
Summary
This is a NASA Shared Services Center Recommendation and Determination to Solicit from One Source form (Version 2.0, dated March 15, 2017). The document recommends a sole source procurement with the Virginia Department of Environmental Quality (VDEQ) for technical review and state regulatory oversight of the NASA Wallops Flight Facility (WFF) Environmental Restoration Program. The estimated period of performance or lead-time for delivery is November 9, 2026. The total estimated cost field is redacted in the document.
VDEQ is identified as the only authorized source capable of performing this service based on EPA authorization granted to the Commonwealth of Virginia on March 6, 1986, to operate the State Hazardous Waste Program in lieu of a federal program, with subsequent EPA re-authorizations of revisions to the Virginia Hazardous Waste Program. The justification emphasizes that VDEQ holds exclusive oversight and enforcement authority for the Environmental Restoration Program work affecting the Commonwealth. The document notes that failure to procure VDEQ services would cause delays to the NASA WFF Environmental Restoration Program and subject NASA to Environmental Protection Agency stipulated penalties (amount redacted) for each day of delay. Competition is deemed impractical due to VDEQ's unique regulatory mandate and authority.

NATIONAL AERONAUTICS AND SPACE ADMINISTRATION
NASA SHARED SERVICES CENTER
RECOMMENDATION AND DETERMINATION TO SOLICIT FROM ONE SOURCE
OR BRAND NAME
PICK ONE
Sole Source:
☒I recommend that NASA, NASA Shared Services Center negotiate with the Virginia Department of Environmental Quality only for technical review and state regulatory oversight. The total estimated cost of this effort is and the estimated period of performance or lead-time for delivery is November 9, 2026.
OR
Brand Name Justification:
☐I recommend that NASA, NASA Shared Services Center negotiate with only with vendors who can provide the subject band name from Manufacture Name for Enter Supply or Service to be procured. The total estimated cost of this effort is Enter Dollar amount and the estimated period of performance or lead-time for delivery is Date.
This recommendation is for the acquisition of supplies or services determined to be reasonably available from only one source/only one manufacture. Competition is impractical for the following reasons (please answer the questions below):
1. What are the reasons for soliciting only the suggested source/suggested brand name? Please provide the unique characteristics of the items or services along with the supporting rationale and the market research performed to substantiate your reason for the suggested source/brand name.
VDEQ, as the state environmental regulatory agency, is the only source that can perform this service. On March 6, 1986 EPA granted the Commonwealth of Virginia authorization to operate the State Hazardous Waste Program in lieu of pursuing a federal program and since that time EPA has re-authorized revisions to the Virginia Hazardous Waste Program. Therefore, only the Commonwealth has oversight and enforcement authority for the Environmental Restoration Program work in matters that impact the Commonwealth and VDEQ is the only entity mandated to conduct that oversight for the Commonwealth.
2. What is the impact to the government if another vendor/brand is used? Include any dollar, schedule, or compatibility impacts if possible.
VDEQ is the only entity authorized to perform this service. Failure to procure VDEQ will cause delays to the NASA WFF Environmental Restoration Program and subject NASA to stipulated penalties from the Environmental Protection Agency of up to for each day of delay.
