BRAND NAME JUSTIFICATION FOR

ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION THRESHOLD

1. Justification for Limited Sources:

This justification supports the need to solicit this requirement as a brand name or equal procurement under FAR 13.106-1(b)(1) , with a 100% small business set-aside. The requirement is for attachments compatible with existing Bobcat track loaders and skid steers currently utilized at the Baldhill Dam site. A limited source justification is necessary due to the unique and proprietary technology embedded within Bobcat attachments manufactured since the year 2000.

2. Unique Features & Compatibility:

Bobcat attachments manufactured since 2000 incorporate a 7-pin CanBus controller that is proprietary to Bobcat. This controller is essential for full functionality and communication between the attachment and the carrier machine. While adapter plates exist to allow Bobcat attachments to function on equipment from other manufacturers, these adapters present significant drawbacks:

Installation Costs: Adapter plates require professional installation by qualified technicians, adding to the overall cost and lead time.

Functional Limitations: Even with adapters, full functionality of all attachments cannot be guaranteed. Specifically, attachments like snowblowers and brooms have demonstrated difficulty operating reliably with adapter plates in place.

Existing Investment: Baldhill Dam currently owns 13 Bobcat attachments (mostly newer models) and maintaining compatibility with this existing investment is crucial for operational efficiency and cost-effectiveness. Replacing the attachments entirely is not fiscally responsible.

3. Market Research:

Comprehensive market research was conducted to identify potential alternatives. This research included:

SAM & SBA DSBS Searches: Searches of the System for Award Management (SAM) and the

Small Business Administration's Dynamic Small Business Search (DSBS) databases.

Google Searches: Broad internet searches for compatible attachments and adapter solutions.

Manufacturer Websites: Direct review of competitor websites to assess compatibility and features.

This research confirmed that no other manufacturer currently offers attachments with the same seamless compatibility and full functionality as Bobcat attachments when used with existing Bobcat carriers, without the limitations associated with adapter plates.

4. Small Business Availability & Competition:

Bobcat is manufactured in the United States, though it is a division of Doosan Group, a Korean company. Importantly, Bobcat ended its exclusive relationship with Kipper Tool Company in 2022. This change has fostered a more competitive landscape with numerous independent small business dealers of Bobcat equipment now registered in SAM, providing ample opportunity for a 100% small business set-aside.

5. Conclusion & Recommendation:

Based on the unique compatibility requirements, the limitations of adapter solutions, and the availability of competitive small business sources, it is recommended that this requirement be solicited as a name brand requirement for Bobcat attachments, with a 100% small business set-aside. This approach will ensure the procurement of fully functional, compatible equipment that maximizes the utility of existing assets and supports small business participation.
