About this file

This document is a Justification for Other than Full and Open Competition (JOFOC) for a sole source procurement by the Department of Commerce National Oceanic and Atmospheric Administration. The agency requires AML Oceanographic Ltd to troubleshoot and determine the root cause of a failure in an MVP-200 profiler owned by NOAA. Only AML Oceanographic Ltd is considered capable of performing the repairs as they are the original equipment manufacturer. The nature of the requirement was deemed urgent due to the unordered freewheeling of the winch drum, which resulted in the loss of a towfish, sensor, and cable. Expediting repairs is necessary to restore the ship's sonar survey capabilities as it continues its mission in the Chesapeake Bay, where data from the MVP is considered highly important. Market research confirmed AML Oceanographic Ltd is the sole source for troubleshooting and repairing the equipment.

SINGLE SOURCE DETERMINATION USING

SIMPLIFIED ACQUISITION PROCEDURES (SAP)

FOR AN ACTION NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD

(AUTHORITY: FAR 13.106-1(b)(1))

1. Agency and contracting activity. Department of Commerce, NOAA Office of Marine and Aviation Operations, Acquisition, Analysis, and Accountability Branch

2. Description of supplies or services required to meet agency needs (including the estimated value).

AML OCEANOGRAPHIC LTD (OEM) to troubleshoot and determine the root cause and failure mode of the MVP-200 profiler in connection with CASREP 2023-05.

3. Identification of the single source or the brand name to be solicited.

4. Supporting rationale. Only one source or brand name is reasonably available as detailed below:

(Check all applicable boxes and provide supporting rationale under the selection. Delete choices not selected.)

Urgency – The nature of the requirement has been deemed urgent due to unusual and compelling circumstances. Following competitive procedures would result in unacceptable delays resulting in serious injury to the Government. (The MVP200 winch drum went into an unordered freewheel mode spooling out approximately 500 meters of cable in 3 minutes. As the full extent of the cable was paid off the drum and the bitter end termination at the slip-ring came under tension the cable parted at the termination resulting in the loss of the towfish, sensor and 500 meters of cable. The impact to the ship’s capability to receive data from the sonar is halted due to a loss of sensors and tow fish. This equipment enables the ship to perform sonar surveys in dep water. Until repairs and equipment is provided, such data is not possible. The estimated time for troubleshooting is at least one day and equipment may have long lead times. The ship is transiting to the MOC-A around July 1st and expected to arrive in Norfolk on July 15, 2023. The repairs are necessary as the ship will continue her mission in the Chesapeake Bay and data received from the MVP is highly important).

5. Market Research.
