SIMPLIFIED ACQUISITION PROCEDURES (SAP)
Determination Memorandum for Sole Source Acquisitions Over $10,000 but not Exceeding $250,000
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. WHEN THE CUSTOMER DESCRIBES AN ITEM OR SERVICE, WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE DETERMINATION MUST EXPLAIN WHY THE ITEM OR SERVICE PROVIDER IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT'S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE. THIS FORM MAY BE USED IN LIEU OF THE DETERMINATION DESCRIBED IN FAR 13.106. THE CUSTOMER SHALL
PROVIDE THE FOLLOWING INFORMATION:
1. PURCHASE REQUEST OR REQUISITION NUMBER: 2. PROJECT/TASK NUMBER: 3. ESTIMATED AMOUNT:
4. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE:
We intend to purchase the Exxact TensorEX TS4-67251 system from Exxact Corp. This is the server that is successful and currently utilizing to host the BLQ-10 software for the TI-20 iteration. This is a rack mounted system that matches the S-86 and S-85 servers used to host the tactical TI-20 BLQ-10 software. This device will be used for our Office of Naval Research local Engineering Development Environment (EDM).
5. UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR
SERVICES CAN BE USED:
This server is the same system that was previously purchased and used for TI-20 BLQ-10 development. This unique server has been tested and verified to operate on the operating system drivers to support the TI-20 BLQ-10 development. Also, this server is required without substitutes, as this is created specifically for the operating system drivers and supports the TI-20 BLQ-10 software. Providing a different server to operate within the design would not only potentially cause system instability, but it would also likely result in a nonfunctional system requiring driver modifications. This would then result in additional labor hours and maintenance costs.
6. EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT MORE THEN ONE
SOURCE HAS NOT BEEN DEVELOPED:
The Exxact TensorEX TS4-67251 system is being utilized and meets the development of the tactical TI-20 BLQ-10 software. The market research showed that there is no known substitute currently for the TensorEX TS4-67251 that would not involve duplicative labor hours to integrate this server to meet the Government's requirement of transition the development of the tactical TI-20 BLQ-10. Consideration of any alternatives, even if available, would require work on the contractor and the government to be compatible with the operating system and the TI-20 BLQ-10 software and introduce significant risk of the research effort failing.
7. PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO
COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED:
No actions can be identified at this time. Exploration of system alternatives were discussed with the system developer, which indicated that limiting consideration to this particular system would result in the successful integration of their TI-20 BLQ-10 software and operating system would result in best value for this one time procurement. The particular name brand and model requirements align with specifications for the TI-20 build of BLQ-10 tactical software and operating system drivers. Future procurement of these components may result in different conclusions depending on the combination of requirements and market availability at that time.
