Source Selection Information – See FAR 2.101 and 3.104

SOLE SOURCE JUSTIFICATION

1. Identification of Agency and Contracting Activity.

The requiring activity is Maritime Expeditionary Security Group Two, Virginia Beach, Virginia; the contracting activity is NAVSUP Fleet Logistics Center (FLC) Norfolk, Contracting Dept.

2. Description of the Action Being Approved.

This is a sole source action for the provision of four (4) jet docks in support of MESG-2. MESG-2 recently purchased five (5) jet docks under purchase order, N0018923P0698, awarded to Jet Dock

Systems, Inc. on 13 September 2023. Previously, MESG-2 also purchased eight (8) jet docks under the following orders to Jet Dock Systems, Inc.: N0018918F0101 was awarded on 29 February 2008 for two

(2) jet docks, N0018908F0163 was awarded on 10 April 2008 for one (1) jet dock, N0018908F0330 was awarded on 23 July 2008 for three (3) jet docks and N0018918P0808 was awarded on 13 June 2018 for two (2) jet docks. Jet Dock Systems, Inc., a small business, provided all supplies and installation of the existing jet docks.

3. Description of Supplies/Services.

The immediate requirement is for the parts and installation of four (4) new custom jet docks to support

40-foot Metal Shark Patrol Boats to ensure they are operational in order to support the winter missions.

The resultant contract will be funded with FY24 Navy Operations & Maintenance (O&MN) appropriations. These funds are currently available.

4. Statutory Authority Permitting Sole Source.

The statutory authority permitting this sole source action is 41 U.S.C. 1901, Simplified acquisition procedures - a sole source acquisition using simplified acquisition procedures for the acquisition of commercial items, as implemented by FAR 13.501(a).

5. Rationale Justifying Use of Cited Statutory Authority.

The jet docks to be procured under the authority requested by this J&A is critical and necessary to ensure MESG-2’s capability of meeting winter mission requirements. Jet Dock Systems, Inc. previously provided the command with a total of thirteen (13) performance docks and the command is in need of four (4) additional docks. The Jet Dock Systems are floating docks that allow the crafts to drive on and then be lifted out of the water. Jet Dock Systems parts and materials are proprietary to Jet Dock Systems as the Original Equipment Manufacturer (OEM) and no other vendor is able to provide and install the performance docks to work with the ones already purchased and installed. Furthermore, if the additional docks are not purchased and installed in the available timeframe, it will affect the readiness of MESG-2.

Jet Dock Systems, Inc. is able to meet the turnaround time required to meet mission requirement.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable, including a

Description of Market Research, if applicable, and a List of Interested Sources, if any.

The proposed contract was synopsized on the SAM.gov website on 15 November 2023 and only Jet

Dock Systems, Inc. expressed an interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Jet Dock Systems, Inc. to provide the required supplies and services.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this Justification will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVSUP FLC Norfolk has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NAVSUP FLC Norfolk will assess whether competition for future requirements is feasible.

To date, no other sources expressed an interest in the requirement.

Furthermore, market research has determined that Jet Dock Systems, Inc. can meet the government’s minimum needs.
