STATEMENT OF WORK

ADVANCED OCCUPATIONAL EDUCATION SERVICES

1. INTRODUCTION

The Federal Bureau of Prisons intends to make a single award to a responsible entity for the provision of an advanced occupational education program as prescribed in the description of duties listed below to the inmate population of Yankton Federal Prison Camp located in Yankton, South Dakota. Faith-Based and Community-Based Organizations have the right to submit offers/ bids equally with other organizations for contracts for which they are eligible.

2. PLACE OF PERFORMANCE

Services will be performed at the Federal Prison Camp, Education Department, 1016 Douglas Avenue, Yankton, South Dakota 57078-0610.

3. SUPPLIES

Some supplies and training aids will be furnished by the Federal Bureau of Prisons. The furnished supplies will normally include items of in-kind service such as space, equipment, utilities, writing supplies, and related materials. Standard audio-visual equipment will be provided by the Federal Bureau of Prisons and will be available for classroom use. The contractor must seek and receive prior approval of the Federal Bureau of Prisons before bringing any other equipment into the institution, including personal computers.

Library services in support of the advanced occupational education program will be provided by FPC Yankton. Reference books and materials provided by the contractor will be inventoried and maintained by the Contract Officer Representative (COR).

A photocopy machine will be provided by the institution. Multiple copies for' classroom distribution remain the responsibility of the contractor and / or inmate student. Inmate students may secure a small. number of transparencies and flip charts for class presentations.

4. DESCRIPTION OF DUTIES

The contractor shall provide, on a nondiscriminatory basis, an Advanced Occupational Education Program. The contractor will develop lesson·objectives, plans, and prepare a viable course curriculum leading to certificates and associate degrees in Accounting (pending a Federal Taxation teacher), Business, and Horticulture ( contingent on FPC Yankton hiring a Vocational Horticulture Teacher). The program must be occupationally oriented and provide instruction that enables students to develop employment skills. Contract services to be rendered will consist of three semesters of study per contract year (see Work Schedule below). The beginning and ending dates of each semester may not necessarily coincide with on-campus semester schedules.

The Government intends to use approximately 1150 credit hours per contract year under this contract.

Services will be unsupervised, but will be monitored by an assigned Contract Officer

Representative (COR) in accordance with Bureau of Prisons policy. On a periodic basis, the contractor shaH provide consulting services to assist the COR with the program. The COR will recruit and register eligible students. The COR will also coordinate the sale of textbooks and related instructional supplies with the students and the contractor's bookstore. The contractor's instructors will provide office hours on an as-needed basis.

The contractor shall accept all credit hours that the inmate students have earned since the inception of the advanced occupational education program in January 1989 and apply said credits toward an associate's degree or certificate program.

5. SPECIAL QUALIFICATIONS REQUIRED

The contractor must be listed in the directory entitled Accredited Institutions of Post-Secondary Education published for the Commission on Recognition of Post-Secondary Accreditation (COPA). On-site instructors must possess the same academic/ teaching credentials as required for on-campus instructors and possess a degree accepted by the accrediting agency.

Documentation certifying accreditation must be attached to the proposal.

The Government will make award to the responsible offeror whose quote conforms to this solicitation and is most advantageous to the government, considering pricing factors and past .

performance.

6. METHOD OF INSTRUCTION

All duties will be performed in accordance with the standards and methods generally accepted within the contractor's field of expertise. Instructional methods are required to be equivalent to those found in a traditional college setting. Only registered inmates may participate in courses of instruction. The contractor shall verify that inmates participating in the advanced occupational education program have received a high school diploma or GED certificate, regardless of the contractor's prerequisites. Tuition and fees must be paid in full by the student prior to the beginning of a session or semester.

7. CLASSROOM MANAGEMENT

The base period of performance shall begin on the date of award and continue for one calendar year. Four additional calendar year option periods may be unilaterally exercised by the Government in accordance with the terms and conditions of the contract.

Classes will be offered for a period commensurate with post-secondary accreditation requirements, normally 15 weeks a semester. Classes will be offered during the fall, spring, and summer semesters. Interim sessions or short courses may be provided if approved by the COR.

Classes shall be scheduled as follows:

Monday - Friday Monday - Friday Monday - Thursday

8:00 AM- 11:00 AM

12:15 PM - 3:45 PM

6:00 PM - 9:00 PM

In the event of an institutional emergency, classes may be delayed or cancelled as determined by the COR.

There will be approximately 20 inmate students per class. One session is equal to one credit hour.

The classes will be held either Monday through Thursday, between the hours of 8:00 a.m. and 9:00 p.m., or on Friday between the hours of 8:00 a.m. and 4:00 p.m., excluding Federal Holidays. A schedule that is mutually acceptable to the Government and the contractor can be determined after award of the contract. Government obligations will be limited to services received from the contractor.

8. WORK MANAGEMENT

The contractor will be required to follow any and all applicable guidelines for the services to be provided. He or she will also maintain accountability of all Government-furnished materials, supplies, and equipment.

9. INMATEMANAGEMENT

Provisions of services under this contract will require frequent, unsupervised contact with inmates.

The contractor will not be responsible for the management of inmates other than to ensure that those inmates involved in activities within the contractor's scope of services shall abide by all rules in effect to ensure their safety and well-being. He or she is to be constantly aware of security and maintain a professional relationship with inmates at all times. Any violations of the rules and regulations on the part of an inmate are to be brought immediately to the attention of any Bureau of Prisons employee and also to the Contract Officer Representative (COR) for proper action.

The Government will cooperate with the contractor in identifying potential problems students may be having that affect their classroom behavior or educational progress. The COR, or designee, may observe the classes conducted by the contractor.

10. INSTITUTION SECURITY

The contractor agrees to adhere to all regulations prescribed by the institution for safety, custody, and conduct of the inmates. Each contractor employee working on-site will be required to attend a four-hour orientation training program before they are permitted within the institution.

Each contractor employee working on-site will be required to satisfactorily complete the following investigative procedures before they are permitted within the institution:

(a) National Crime Information Center (NCIC) Check;

(b) DOJ-99 Name Check;

(c) FD-258 Fingerprint Check;

(d) Law Enforcement Agency Checks;

( e) Vouchering of employers over the past five years;•

(f) SF-171 (Application for Federal Employment) or Resume/Personal Qualifications;

(g) BP-S660.012 Authority for Release oflnformation;

(h) Release of Information;

(i) National Agency Check and Inquiries (NACI)- if applicable; and G) Urinalysis.

A urinalysis test is required for detection of marijuana and other drug usage before the contract is awarded. If the proposed contract is with a company and the individual(s) assigned to perform the work test(s) positive, the individual(s) shall be excluded from performing the contract and the contractor shall provide acceptable replacement personnel subject to the same security requirements.

The contractor must be in compliance with Department of Justice regulation at 8 CFR 274a regarding the employment of aliens. A copy of this directive is available upori the contractor's request.

11. MISCELLANEOUS INFORMATION

This is a contractual arrangement and not a personnel appointment. As specified in FAR 37.101 A Non-personal Service Contracts means a contract under which the personnel rendering the services are not.subject, either by the contract's terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees. All duties outlined in this Statement of Work shall be performed in accordance with standards and methods generally accepted within the contractor's own field of expertise.

Payment shall be based on the accomplishment of specific results, and the results to be obtained shall be entirely within the contractor's own unsupervised determination. The COR will periodically evaluate the contractor's performance of the contract.

12. PA YMEN(I' TERMS

Payment will be made electronically to the contractor's bank routing and account number as provided by the contractor by registering in the Central Contractor Registration database at www.ccr.gov. Payment terms as specified in FAR 52.212-4(g) indicate that the due date for making an invoice payment by the designated payment office shall be the 30th day after the designated payment office has received a proper invoice, or the Government accepts the services performed by the contractor. The contractor can however offer discount payment terms for prompt payments as sp~cified in block 12 on the SF-1449 form of this solicitation. Half sessions will not be authorized for payment.
