Memorandum for Record – Limiting Competition at or below the Simplified Acquisition Threshold

This is a justification document for a sole-source purchase order issued by the Mission & Installation Contracting Command (MICC) at Dugway Proving Ground on behalf of the Chemical Biological Testing Division (BTD). The procurement is for proprietary consumable parts and non-recurring engineering (NRE) services from Teledyne Instruments Inc. (16830 Chestnut Street, City of Industry, CA 91748-1017) to support the Safety Air Monitoring and Analytical Referee Systems (SAMARS) Phase 3 Part 2 Gas Chromatograph (GC) development effort. The total contract value is $72,550 with a completion date of March 30, 2028, funded through FY 2027-2028 RDT&E appropriations under a fixed-price purchase order contract vehicle. The requirement includes customized Teledyne Falcon GC column assemblies, trap modules, Flame Photometric Detector (FPD) optical filters, pre-concentrator tubes, and engineering work to integrate a halogen-selective detector capability into the Falcon GC platform to replace the discontinued MINICAMS system.

The justification cites FAR 12.201-1 authority for commercial acquisitions at or below the simplified acquisition threshold, with the primary rationale being that Teledyne Instruments is the sole source capable of providing the required proprietary components and engineering enhancements. Market research conducted by CTD personnel, including searches of GSA Advantage, outreach to major laboratory supply vendors (Fisher Scientific, Sigma Aldrich, VWR International), and review of industry literature confirmed that no other manufacturer produces compatible components or possesses the engineering capability to modify a gas chromatograph to meet SAMARS Phase 3 Part 2 specifications. The procurement is characterized as a logical follow-on to prior Phase 1 and Phase 2 development efforts completed exclusively by Teledyne, with all components uniquely designed for the Falcon GC platform and not commercially interchangeable with competitors' systems. The document includes detailed line-item pricing for 11 deliverables with standard 45-day lead times and certifications from the Chief of the Chemical Analytical Branch and the Contracting Officer confirming the justification's accuracy and that the sole-source award is in the Government's best interest.

4. Description of Services or Supplies: CTD has a requirement for the procurement of proprietary, brand-name consumable parts and engineering enhancements for the Teledyne Falcon Gas Chromatograph (GC). These components are essential to support the Government’s ongoing, multi-phase development of the SAMARS instruments at DPG. These items are intended to replace the discontinued MINICAMS system currently used for safety air monitoring within the Chemical Test Division (CTD).

The consumable items include customized gas chromatograph column modules, modified trap modules, proprietary Flame Photometric Detector (FPD) optical filters, and custom manufactured pre-concentrator tubes. These components are uniquely designed for the Falcon GC and are not commercially interchangeable with other manufacturers’ systems.

The requirement also includes non-recurring engineering (NRE) necessary to integrate a halogen selective detector (or equivalent technology) into the Falcon GC platform.

This capability is required to detect chemical agent compounds containing halogen ions, specifically chloride, that do not contain phosphorus or sulfur, thereby enabling the Falcon GC to fully replace MINICAMS detection functionality.

6. Reasons for Authority Cited:

a. Only One Reasonable Source: Teledyne Instruments is the only manufacturer capable of providing the proprietary consumable components and engineering enhancements required for the Falcon GC. Teledyne is currently partnered with DPG WDTC in the multi-phase development of the Falcon GC as the designated replacement for the discontinued MINICAMS system. No other vendor manufactures or supports the Falcon GC platform, nor can any other vendor modify or customize a GC to meet the specific flow, trap, detector, and sensitivity requirements needed for SAMARS Phase 3 Part 2. Teledyne has already completed Phase 1 and Phase 2 Falcon GC units for DPG, incorporating increased flow capacity, onboard operations, data storage, and touchscreen control via NumaView software. The Phase 3 effort requires Teledyne’s proprietary engineering to integrate a halogen-selective detector compatible with the Falcon GC architecture. No other manufacturer offers a GC platform capable of supporting this integration.

b. Brand Name Restriction: The Teledyne Falcon GC is the only GC platform that meets the Government’s technical requirements for safety air monitoring. The Falcon GC uniquely incorporates a built-in preconcentrator trap system essential for achieving low detection limits. Competing systems rely on external trap units, which increase cost, footprint, weight, and installation complexity, an impractical configuration for CTD’s operational environment. The proprietary trap, column modules, detectors, and optical filters required for SAMARS Phase 3 Part 2 are manufactured exclusively by Teledyne and cannot be substituted or modified by other vendors.

c. Detrimental Impact if Not Approved: Failure to procure these brand-name components and engineering enhancements would prevent completion of the Phase 3 instrument and jeopardize CTD’s ability to sustain safety air monitoring operations. The MINICAMS system is discontinued and no longer supported by the manufacturer.

Without the Falcon GC Phase 3 capability, CTD would be unable to detect halogen-containing compounds, resulting in significant mission degradation and inability to meet safety monitoring requirements.

d. Logical Follow-On (if applicable): This action is a logical follow-on to prior Phase 1 and Phase 2 Falcon GC development efforts performed exclusively by Teledyne. The Phase 3 enhancements directly build upon the architecture, flow system, and software developed in earlier phases. No other vendor can logically continue this work due to proprietary design elements and Teledyne’s exclusive ownership of the Falcon GC platform.

7. Publicizing Contract Actions:

☐ do not apply, less than $20K threshold ☒ apply and will be followed ☐ do not apply due to an exception at FAR 5.101(b)(1)( )

b. Requirement to post justification in accordance with, FAR 12.301(a)(2), GSAM

538.7104-3(a)(3) or FAR 16.507-6(f) unless:

☐ Action is not a brand name restriction and is under SAT, no posting required.

☐ Action is a brand name restriction, under $40K, no posting required.

☐ Action is a brand name restriction over $40K but will not be posted due to the following exception:

☐ FAR 6.301(e) ☐ GSAM 538.7104-3(b)(3)(i)(B) ☐ FAR 16.507-6(f)(4)

8. Market Research: Market research was conducted by personnel within the Chemical Test Division (CTD). Efforts included searches on General Services Administration (GSA) Advantage, an open market survey, and outreach to major laboratory supply vendors such as Fisher Scientific, Sigma Aldrich, and VWR International. These searches confirmed that the proprietary and custom modified Teledyne Falcon GC modules, detectors, trap assemblies, and consumable components required for

SAMARS Phase 3 Part 2 are not available through any third-party distributors or resellers.

In addition to vendor outreach, CTD personnel reviewed industry literature, participated in technical and analytical conferences, and consulted with experienced field technicians to identify commercially available portable gas chromatograph systems capable of meeting chemical agent detection requirements. This research reaffirmed that while several manufacturers produce portable GCs for industrial applications, none offer an integrated preconcentrator trap, halogen-selective detector compatibility, or the flow and sensitivity performance required for safety air monitoring.

Teledyne Instruments is the exclusive manufacturer and proprietor of the Falcon GC platform and all associated proprietary modules and consumables. No other vendor produces components compatible with the Falcon GC or offers the engineering capability to modify a GC to meet SAMARS Phase 3 Part 2 specifications. Based on the results of the market research, Teledyne was identified as the sole proprietary source capable of providing the required brand name components and engineering enhancements, and as the only provider of a commercially available gas chromatograph that, with modifications, can meet CTD’s safety air monitoring and testing support requirements.

9. Other Facts: The MINICAMS instrument currently used for safety air monitoring has been discontinued and is no longer supported, making the development of a replacement system essential for CTD’s mission. Teledyne Instruments is the only vendor capable of customizing a portable GC to replace MINICAMS and meet CTD’s operational requirements. Teledyne has already developed Phase 1 and Phase 2 Falcon GC units for DPG, each incorporating proprietary system modifications and performance enhancements. Teledyne remains the only manufacturer willing and able to modify its GC platform to meet Phase 3 requirements, and competition is not feasible until a comparable product is developed and made commercially available.

This procurement is a logical follow-on to the Government’s ongoing, three-phased development effort with Teledyne Instruments to create a customized Safety Air Monitoring solution for DPG. All consumable parts, trap assemblies, column modules, detectors, and optical filters required for SAMARS Phase 3 Part 2 are proprietary and exclusive to the Falcon GC system. These components cannot be sourced, replicated, or modified by any other vendor. Their proprietary nature, combined with Teledyne’s exclusive ownership of the Falcon GC design architecture, establishes Teledyne Instruments as the sole proprietary source capable of providing the essential consumables and engineering enhancements needed to complete the Phase 3 instrument.
