About this file

This document is a justification for other than full and open competition for the procurement of Genetec AutoVu SharpV license plate recognition cameras by the Federal Bureau of Investigation. The FBI requires 100 Genetec AutoVu SharpV all-in-one LPR cameras to replace existing cameras and maintain integration with its custom license plate recognition solutions. Only the Genetec cameras provide the flexibility needed to deploy LPR in multiple configurations while maintaining the same architecture. Changing to a different brand would require redesigning components and rewriting software at additional cost and time not available. The justification cites 41 USC 3304(a)(1) for brand name procurement to meet the agency's requirement. The FBI conducted market research and found Genetec to be the only brand that meets specialized technical needs. The solicitation will be posted to SAM.gov with quotes due by May 22, 2023 to the FBI procurement section for the 100 Genetec AutoVu SharpV cameras.

FEDERAL BUREAU OF INVESTIGATION

FINANCE DIVISION | PROCUREMENT SECTION

JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND

OPEN COMPETITION

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH 41 U.S.C. 3304 (A) (X)

Requisition Number: DJF-23-1800-PR-0002769

1. Identification of the agency and contracting activity.

The U.S. Department of Justice, Federal Bureau of Investigation, National Acquisition Programs Unit, proposes to enter into a contract on the basis of other than full and open competition for Genetec AutoVu SharpV - All in one License Plate Recognition (LPR) Camera on behalf of the Video Surveillance Unit (VSU) Operational Technology Division (OTD).

2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.

The type of action being approved is for a other than full and open, “brand name” justification for the firm-fixed price procurement of the following Genetec AutoVu SharpV cameras.

3. A description of the supplies or services required to meet the agency’s needs.

The LPR program has a demand for a LPR cameras with the following features:

• Genetec AutoVu SharpV all in one LPR camera (100 Qty)

• Flexible API, designed to ensure easy integration

• Built-in analytic software shall be capable of detecting vehicles even if no license plate is visible by using a Virtual Loop algorithm

• Power over Ethernet Plus (POE)

• Processing rates of 30 frames per second

• Capture ranges from 60-115 feet at a speed of 200 mph

• Support of windows platforms currently in use at the FBI

• Automatic recognition of vehicle license plates

• Built-in ALPR analytics and processing onboard

• Ruggedized construction and waterproof to IP66/67 There is a current high demand for this product. These Optical Character Recognition (OCR) Cameras are integrated into many of the products and concealments that are deployed by VSU

LPR.

4. The statutory authority permitting other than full and open competition.

The statutory authority permitting other than full and open competition is 41 USC 3304 (a)(1), as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 – “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

In accordance with FAR 6.302-1(c) – “Application for brand name descriptions”, use of “brand name” descriptions for this acquisition is essential to the Governments requirement, thereby precluding consideration of a product manufactured by another company.

5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.

These cameras are replacement cameras for existing products that have deployments in the bureau using their API to communicate with the FBI’s custom made LPR solutions.

These cameras have been previously purchased and are currently being used in different concealments. Changing or purchasing a new device would greatly impact our system, by doing so we would have to re-modify all of our concealments and re-write software. That would take more time and money to re-design components and re-write software. The specifications of the camera have already been researched and implemented into our system by VSU.

While the market has several LPR camera solutions available, only the Genetec AutoVu SharpV camera provides the flexibility required to deploy LPR in multiple configurations while maintaining the same architecture. These units are being purchased as replacements to existing field units that can no longer be purchased. To select a different product to take the place of those cameras would incite additional cost and development time not currently available to the

FBI.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

Surveying industry for equipment that meets our needs is a continuous process for this organization. This process is ongoing and conducted through public forums and data gathering, and collaboration with other Governmental agencies with similar requirements. Although they provide a good overview for global information on large, small and other businesses, public sources often do not reveal the granularity needed to completely evaluate a company’s ability to meet some of our specialized requirements. Many companies that market law enforcement related surveillance products do not publicly advertise their products. Additional information on companies stating that they provide video surveillance equipment is obtained from other https://www.acquisition.gov/far/html/Subpart%205_2.html#wp1107980 https://www.acquisition.gov/far/html/Subpart%205_2.html#wp1107990 sources. OTD routinely attends trade shows targeted at law enforcement and Government surveillance markets.

A combined synopsis/solicitation and this approved J&A will be posted to SAM.gov as required by Subpart 5.102(q)(6) and Subpart 6.305(c). This will ensure that quotes are solicited from as many potential sources as practicable.

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer shall use one of the appropriate proposal analysis techniques provided in FAR 15.401-1 to determine anticipated cost to the Government will be fair and reasonable.

8. A description of the market research conducted and the results.

The Government conducted market research based on own testing, other vendor’s data/equipment, and research of the open market.

Video Analytics and the Edge Devices group personnel have researched these items by reviewing manufacturer data specifications, product reviews, and interviews with sales representatives from various companies regarding availability, features, and target markets.

The Video Surveillance Unit monitors the industry using the internet, trade journals, trade symposiums, etc. for research.

Video Analytics and the Edge Devices group personnel have researched these items to locate 3 companies that could provide equipment for the government’s needs. A request for quote via email was sent to each company for the required equipment.

9. Any other facts supporting the use of other than full and open competition.

The Video Surveillance Unit monitors the industry using the internet, trade journals, trade symposiums, etc. for research.

Video Analytics and the Edge Devices group personnel have researched these items to locate companies that could provide equipment for the government’s needs.

10. A listing of any sources that expressed a written interest in the acquisition.

NA

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.

VSU intends to continue to work closely with the market to ensure there are multiple vendors capable of meeting the same core requirements while allowing VSU to access niche capabilities that can be applied across the FBI’s diverse mission sets. Vendor engagement will include participating in NATIA conferences and evaluating vendor technology as the need arises.

The actions of the FFD to identify potential sources possessing the ability to satisfy this and similar requirements are ongoing. Over time, additional sources may become available and identifiable through market surveys, trade shows, collaboration with other Federal agencies, or other means. The market will be continuously monitored.
