About this file

This is a Request for Statement of Qualifications (RFSQ) issued by the City of Safford, Arizona, for Job Order Contracting (JOC) services in public works and utilities. The City seeks qualified contractors to establish JOC agreements for general construction, general maintenance, and facility maintenance services across multiple trade categories including General Contracting, Roofing, Horizontal work, General Building, Mechanical, Plumbing, Electrical, and Water/Wastewater services. The contract will support small building construction, renovations, repairs, water and wastewater system maintenance, and emergency response services for City-owned buildings and infrastructure. The initial contract term is three years with options to renew for up to two additional one-year terms, creating a potential maximum contract period of five years. The City anticipates making multiple awards under this solicitation.

The RFSQ process requires contractors to submit statements of qualifications rather than sealed bids, allowing the City to evaluate contractor capability and experience before establishing JOC pricing schedules. Specific information regarding response deadlines, bidders' conferences, site visits, and pricing methodology should be detailed within the full RFSQ document. The multiple-award structure allows the City to distribute work across several qualified contractors based on specialization and availability, providing flexibility in managing diverse maintenance and construction needs across the municipal portfolio.

I. GENERAL INFORMATION

The City of Safford (hereinafter “City”) invites interested and qualified persons or contractors (hereinafter

“contractors”) to submit a written Statement of Qualifications (SOQ) for performing various Job Order Construction

Contract services beginning Fiscal Year 2027. The requested categories of construction services are provided in the

Description of Work.

A Job Order Contract is an indefinite quantity contract pursuant to which the Contractor may perform ongoing services on individual projects as directed by the City. The Contract Documents include, but are not limited to, the Solicitation, Construction Task Catalog® which contains construction tasks with preset unit prices, and the City’s Technical

Specifications. The Construction Task Catalog® and Technical Specifications are provided by The Gordian Group in accordance with the contract between the City and Gordian to provide a unit price book and other services related to

Job Order Contracting. The Gordian Group Technical Specifications are a minimum standard in the event the Owner does not provide technical specifications for the work. The unit prices in the Construction Task Catalog® are based on local labor, material, and equipment costs and include the direct cost of construction only.

Multiple contracts may be awarded to multiple contractors areas deemed necessary by the City. The maximum number of contracts to be awarded is five (5) contracts per category of work. Successful contractors may be selected for one or more trade category, as applied. There will be three (3) trade categories Contractors may submit submissions.

Contracts shall be awarded on the basis of demonstrated competence and qualifications pursuant to A.R.S. § 34-604.

All contracts will be for the term of five (5) years, with the consideration of one (1) year extension based on successful completion of work and mutual agreement. The value of these contracts will vary based on projected City needs, available budget, and the selected categories. The award of a contract is not a guarantee of work. There is no specific list of projects at this time. The City’s Five-Year Capital Improvements Plan has examples of the type of projects that could be and is strictly for informational purposes only.

To be eligible for consideration, contractors must submit a single SOQ demonstrating appropriate competence, qualifications, and relevant experience in the service categories for which they apply. Contractors must provide proof and maintain proper licensure throughout the term of the agreement. The City will not accept qualifications at this time for any categories not listed under this request.

The City will apply a one-step process to select the successful contractors under this procurement. The one-step process will involve review and evaluation of the SOQ to establish a final list. A separate final list will be determined for each category of construction services. If a contractor submitted qualifications for more than one category of construction service, the contractor may be on more than one final list. As project needs arise, contractors from this list may be contacted to determine interest and availability for specific tasks. The final list will remain in effect for a period of up to six (6) years from the date of issuance by the City.

a. TERM OF THE CONTRACT

The contract will initially be for three (3) years with the option to renew for up to two (2) additional one-year terms totaling a maximum of five (5) years. The City anticipates making multiple awards under this solicitation.

b. REQUIRED CONTRACTOR LICENSURE

Contractors will be required to have the appropriate contractor’s licensure required for each type of work they are submitting proposals for and maintain those licensures throughout the term of the agreement.

c. CONTRACTOR LICENSE FEE

The City selected The Gordian Group’s (Gordian) Job Order Contracting (JOC) Solution for their JOC program. The Gordian JOC Solution™ includes Gordian’s proprietary JOC Information Management

System (“JOC IMS”), JOC Applications, construction cost data, and Construction Task Catalog® which shall be used by the Contractor solely for the purpose of fulfilling its obligations under this Contract, including the preparation and submission of Job Order Proposals, Price Proposals, subcontractor lists, and other requirements specified by the City. The Contractor shall be required to execute Gordian’s Saas Terms of Use and pay a JOC System License Fee to obtain access to the Gordian JOC Solution™. The JOC System

License Fee applies to all Job Orders issued to the Contractor under the terms of the Contract.

Awarded Contractors will be required to pay the following license fee to Gordian on a Job Order by Job Order basis. Contractors shall take this into consideration when determining their adjustment factor submissions.

IV. EVALUATION AND SELECTION PROCESS

To qualify for evaluation, the SOQ must be submitted on time and materially satisfy all requirements identified in this request. If, in the judgment of the City, an SOQ does not conform to the format specified herein, or if any section is absent or significantly incomplete, the City reserves the right to reject the submittal.

a. OVERVIEW

This is a qualifications-based selection process as authorized by A.R.S. § 34-604. The process will involve an evaluation and scoring of each contractor’s qualifications and relevant experience, as indicated in its SOQ. A Review Committee appointed by the City for this procurement will individually evaluate the SOQs according to the criteria and weighing as indicated for each category. Following evaluation of the SOQs, a final list of the highest ranked contractors will be determined for each service area. The final list will remain in effect for a period of up to six (6) years from the date of issuance by the

City.

b. FINAL RANKING AND CONTRACT NEGOTIATION

Using the individual Review Committee member’s scores from the SOQs, the committee shall rank the contractors to generate a final list of at least two (2) for each construction trade category. If a contractor submitted qualifications for more than one type of construction service, the contractor may be on more than one final list. The City will then notify each of the candidate contractors of the final rankings.

The City may proceed to negotiate an agreement for services, commemorated with an official (Invitation to

Negotiate) sent to the any Contractor. If the City is unable to negotiate a satisfactory agreement with a

Contractor, for compensation and on other terms the City determines to be fair and reasonable, negotiations with that Contractor will be formally terminated. The City may then undertake negotiations with the next most qualified Contractor, in sequence, until an agreement is reached or a determination is made to reject all

SOQ’s. Once negotiations have been terminated with a Contractor, they may not be re-opened with that

Contractor for this procurement.

Multiple contracts will be awarded to the successful contractors on each final list with a maximum of five (5) contracts per category. Award of a contract is not a guarantee of work but is utilized to expedite the process of negotiating specific services as the needs arise. All contracts will be for a term of three (3) years, with the consideration of two additional one (1) year extension based on successful completion of work and mutual agreement. The City will determine the value of each contract based on projected City needs, available budget and the selected construction service categories.

Selected contractors will be required to execute and meet the terms of the City’s standard Construction

Services Agreement, including insurance requirements, in a form acceptable to the City Attorney. Approval of the City Council may also be required for award of a contract.

As project needs arise, contracted contractors may be contacted to determine interest and availability for specific tasks. Upon successful negotiation of a scope and fee for work, the City will issue an authorization for performing the specified tasks.

c. TERM OF CONTRACT

The contract resulting from this request shall commence in 2026, for an initial period of three (3) years (after

City Council approval). The decision to renew contracts shall be solely the City’s decision. Notice of intent to renew shall be made at least one (1) month prior to normal contract expiration. If renewal results in changes of the terms or conditions, such changes shall be in writing as an amendment to the contract and such amendment shall not become effective until fully executed by both parties.

d. TERMINATION OF CONTRACT

The City reserves the right to terminate any part of or the entirety of any contract that may result from this proposal, without cause and at any time with thirty (30) calendar days written notice. General Conditions, or other provisions of the Contract.

B. Contractor shall also furnish such other bonds (if any) as are required by these General Conditions or other provisions of the Contract.

C. All bonds must be in the form included in the Bidding Documents or otherwise specified by Owner prior to execution of the Contract, except as provided otherwise by Laws or Regulations, and must be issued and signed by a surety named in “Companies Holding Certificates of Authority as Acceptable

Sureties on Federal Bonds and as Acceptable Reinsuring Companies” as published in Department

Circular 570 (as amended and supplemented) by the Bureau of the Fiscal Service, U.S. Department of the Treasury. A bond signed by an agent or attorney-in-fact must be accompanied by a certified copy of that individual’s authority to bind the surety. The evidence of authority must show that it is effective on the date the agent or attorney-in-fact signed the accompanying bond.

D. Contractor shall obtain the required bonds from surety companies that are duly licensed or authorized, in the state or jurisdiction in which the Project is located, to issue bonds in the required amounts.

E. If the surety on a bond furnished by Contractor is declared bankrupt or becomes insolvent, or the surety ceases to meet the requirements above, then Contractor shall promptly notify Owner and

Engineer in writing and shall, within 20 days after the event giving rise to such notification, provide another bond and surety, both of which must comply with the bond and surety requirements above.

F. If Contractor has failed to obtain a required bond, Owner may exclude the Contractor from the Site and exercise Owner’s termination rights under Article 16.

G. Upon request to Owner from any Subcontractor, Supplier, or other person or entity claiming to have furnished labor, services, materials, or equipment used in the performance of the Work, Owner shall provide a copy of the payment bond to such person or entity.

H. Upon request to Contractor from any Subcontractor, Supplier, or other person or entity claiming to have furnished labor, services, materials, or equipment used in the performance of the Work, Contractor shall provide a copy of the payment bond to such person or entity.

Insurance—General Provisions

A. Owner and Contractor shall obtain and maintain insurance as required in this article.

B. All insurance required by the Contract to be purchased and maintained by Owner or Contractor shall be obtained from insurance companies that are duly licensed or authorized in the state or jurisdiction in which the Project is located to issue insurance policies for the required limits and coverages. All companies that provide insurance policies required under this Contract shall have an A.M. Best rating of A-VII or better.

C. Alternative forms of insurance coverage, including but not limited to self-insurance and

“Occupational Accident and Excess Employer’s Indemnity Policies,” are not sufficient to meet the insurance requirements of this Contract.

D. Contractor shall include additional insureds as follows: Owner, Owner’s employees, agents, officials, and officers, and deliver to Owner, with copies to each additional insured identified above and, in the

Contract, certificates of insurance and endorsements establishing that Contractor has obtained and is maintaining the policies and coverages required by the Contract. Upon request by Owner or any other insured, Contractor shall also furnish other evidence of such required insurance, including but not limited to copies of policies, and deductibles, full disclosure of all relevant exclusions, and evidence of insurance required to be purchased and maintained by Subcontractors or Suppliers. In any documentation furnished under this provision, Contractor, Subcontractors, and Suppliers may block out (redact) (1) any confidential premium or pricing information and (2) any wording specific to a project or jurisdiction other than those applicable to this Contract.

E. Owner shall deliver to Contractor, with copies to each additional insured identified in the Contract, certificates of insurance and endorsements establishing that Owner has obtained and is maintaining the policies and coverages required of Owner by the Contract. Upon request by Contractor or any other insured, Owner shall also provide other evidence of such required insurance (if any), including but not limited to copies of policies, documentation of applicable self-insured retentions (if allowed) and deductibles, and full disclosure of all relevant exclusions. In any documentation furnished under this provision, Owner may block out (redact) (1) any confidential premium or pricing information and

(2) any wording specific to a project or jurisdiction other than those relevant to this Contract.

F. Failure of Owner or Contractor to demand such certificates or other evidence of the other party’s full compliance with these insurance requirements, or failure of Owner or Contractor to identify a deficiency in compliance from the evidence provided, will not be construed as a waiver of the other party’s obligation to obtain and maintain such insurance.

G. In addition to the liability insurance required to be provided by Contractor, the Owner, at Owner’s option, may purchase and maintain Owner’s own liability insurance. Owner’s liability policies, if any, operate separately and independently from policies required to be provided by Contractor, and

Contractor cannot rely upon Owner’s liability policies for any of Contractor’s obligations to the

Owner, Engineer, or third parties. The Contractor’s insurance coverage shall be primary insurance with the respect to all other available sources.

H. Contractor shall require:

1. Subcontractors to purchase and maintain worker’s compensation, commercial general liability, and other insurance that is appropriate for their participation in the Project, and to name as additional insureds Owner, and Owner’s employees, agents, officials and officers on each

Subcontractor’s commercial general liability insurance policy; and

2. Suppliers to purchase and maintain insurance that is appropriate for their participation in the

Project.

I. If either party does not purchase or maintain the insurance required of such party by the Contract, such party shall notify the other party in writing of such failure to purchase prior to the start of the

Work, or of such failure to maintain prior to any change in the required coverage.

J. If Contractor has failed to obtain and maintain required insurance, Contractor’s entitlement to enter or remain at the Site will end immediately, and Owner may impose an appropriate set-off against payment for any associated costs (including but not limited to the cost of purchasing necessary insurance coverage), and exercise Owner’s termination rights under Article 16.

K. Without prejudice to any other right or remedy, if a party has failed to obtain required insurance, the other party may elect (but is in no way obligated) to obtain equivalent insurance to protect such other party’s interests at the expense of the party who was required to provide such coverage, and the

Contract Price will be adjusted accordingly.

L. Owner does not represent that insurance coverage and limits established in this Contract necessarily will be adequate to protect Contractor or Contractor’s interests. Contractor is responsible for determining whether such coverage and limits are adequate to protect its interests, and for obtaining and maintaining any additional insurance that Contractor deems necessary.

M. The insurance and insurance limits required herein will not be deemed as a limitation on Contractor’s liability, or that of its Subcontractors or Suppliers, under the indemnities granted to Owner and other individuals and entities in the Contract or otherwise.

N. All the policies of insurance required to be purchased and maintained under this Contract will contain a provision or endorsement that the coverage afforded will not be canceled, or renewal refused, until at least 10 days prior written notice has been given to the purchasing policyholder. Within three days of receipt of any such written notice, the purchasing policyholder shall provide a copy of the notice to each other insured and Engineer.
