About this file

This document contains solicitation requirements for a Veterans Affairs (VA) federal contract opportunity that is a Total Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside.

All bidders and offerors must submit documentation demonstrating a satisfactory safety and environmental record. Specifically, bidders must certify they have no more than three serious violations, one repeat violation, or one willful violation under OSHA or EPA regulations within the past three years. Additionally, bidders must provide current Experience Modification Rate (EMR) documentation equal to or less than 1.0, obtained from their insurance carrier on official letterhead. Self-insured contractors or those unable to obtain EMR ratings from insurance carriers must obtain ratings from the National Council on Compensation Insurance, Inc. (NCCI) using form ERM-6, or from their state-run worker's compensation insurance rating bureau if located in CA, DE, MI, NJ, ND, OH, PA, WA, WY, or PR. The government will conduct a Determination of Responsibility for the apparent awardee prior to award, utilizing information from OSHA and EPA online inspection history databases. Failure to affirm compliance with these guidelines or submit required documentation will result in a non-responsibility determination and ineligibility for award. This requirement applies to all subcontracting tiers, making prime contractors responsible for verifying their prospective subcontractors' compliance. The contract will include VAAR 852.219-10 regarding limitations on subcontracting, with the Contracting Officer authorized to use VA support contractors to monitor contractor compliance with these requirements, provided all support contractors execute non-disclosure agreements and comply with FAR proprietary information protections.
