1) During our RFP review relative to service we uncovered three identified install locations that depending on Band selected would present us with a challenge to forward a technically compliant response. It is our understanding that the awarded vendor will be required to service all locations listed within the Attachment regardless of what Band is selected for placement.

Is our understanding correct that 100% service coverage is required to be considered technically acceptable? Will the Final RFP represent which bands will be placed in each location?

Response: Your understanding is correct, 100% service coverage will need to be required to be technically acceptable. Firm requirements cannot be outlined in the RFP. The IDIQ will only provide an estimate of machines, overall, but not by specific location. Vendors may also reference attachment 3- Existing device locations, for a basic guide to where current usage bands are in place. This is not to be considered a firm requirement for exact replacement of devices, but again may be used as a basic guide for estimating purposes. Firm requirements will only be outlined in the subsequent delivery orders.

2) Given the recent events in Japan, has any consideration be given the effect of the disaster on the vendors supply chain and vendors ability to meet RFP specified delivery and service requirements. Given the state of the situation in Japan, and the timeliness of the pending RFP, many vendors may not yet had the opportunity to assess what effect if any recent events will have on their ability to maintain supply chain integrity for parts and equipment. Absent concrete information relative to the supply chain, and the certain penalties associated with the RFP for non compliance to the T/C's, vendors might take a conservative approach and choose not to respond for fear of facing penalties and fines later in the RFP cycle when the facts about their supply chains materialize.

Does the FAR allow the government any "discretion" relative to noncompliance fees and penalties for a unique situation like this? If discretion is granted under the FAR can that discretion be conveyed within the RFP structure?

Response: DLA Document Services will take recent events under consideration throughout the entire solicitation phase. Any necessary changes will be made to the RFP in the form of a formal written amendment.
