About this file

This is an Amendment of Solicitation/Modification of Contract issued by the Department of Veterans Affairs, NCO 15 Contracting Office – CMOP, located in Leavenworth, Kansas. Amendment 0005 extends the deadline for receipt of offers to August 21, 2026 at 5:00 PM CDT for RFP# 36C77026R0004, originally issued on December 10, 2025. The amendment includes a Vendor Questions & Answers document addressing nine inquiries related to pharmaceutical repackaging services.

The questions and answers clarify key contract requirements and operational procedures. No emergency orders have been requested in the last four years, though emergency order sizes will vary based on specific pharmaceuticals being ordered. Attachment 2A (Cap Label) has been provided as the logo specification, and outserts are not the repackaging contractor's responsibility. Emergency orders consist of items shipped to the contractor for expedited repackaging and shipment to requesting CMOP sites. The contractor is required to register each drug with a new National Drug Code (NDC) to ensure supply-chain accountability and compliance with the Drug Supply Chain Security Act (DSCSA), even though the contractor does not own the product. Previous amendments are now active on SAM under RFP# 36C77026R0004. Inventory reconciliation tolerances, discrepancy responsibility, and conflict resolution processes are specified in Sections H3 and N1 of the Performance Work Statement, while FDA, DEA, and contract compliance expectations are detailed in Section B1 of the Performance Work Statement.

Vendor Questions & Answers – RFP# 36C77026R0004

1. Attachment 5 - How many of the pallets listed were shipped for emergency orders?

No emergency orders have been requested in the last four years.

2. What is the approximate size/volume of each emergency order?

An emergency order size will vary depending on the pharmaceutical(s) being ordered at that time.

3. What is the logo? Schedule 2A was not attached?

Document is attached and titled as “Attachment 2A – Cap Label”.

4. What about the outserts?

Outserts are not provided by the repackaging Contractor.

5. Need clarity on emergency orders…. Are these for items already repackaged or brand-new item that needs to be repacked?

Emergency orders will always be items shipped to the repackaging Contractor for expedited repackaging and shipment to the requesting CMOP site. ER items are still repackaged under this contract.

6. How is the contractor responsible for registering each drug and providing their own NDC if they never own the product? See below for full answer.

The FDA requires a new and unique National Drug Code (NDC) during pharmaceutical repackaging to identify the repackaging Contractor and the specific new package size or type ensuring full supply-chain accountability and traceability back to the original source product. The new NDC is required when repackaging pharmaceuticals to reflect the specific repackager’s labeler code and the new package size or type, ensuring clear product traceability, billing, accurate supply chain tracking, and legal accountability under the Drug Supply Chain Security Act (DSCSA).

7. We are unable to locate the previous amendments on SAM. They are no longer visible.

We previously requested those amendments be active and added to the solicitation posting under a single RFP number - 36C77026R0004.

Postings could have been found under the inactive files. All SAM postings for RFP# 36C77026R0004 have been made active again for ease of use.

8. The solicitation does not clearly define acceptable inventory reconciliation tolerances, responsibility for discrepancies identified during receiving, or the process for resolving shortages, overages, damaged product, or count variances identified prior to processing.

Please provide this information.

Please refer to Sections H3 and N1 in the Performance Work Statement.

9. Please provide clear expectations necessary to ensure compliance with FDA, DEA and Contract requirements. Please refer to Section B1 in the Performance Work Statement.
