STATEMENT OF WORK
1. General: The Contractor shall provide all supplies, materials; equipment, labor, supervision, management and transportation to perform all tasks as identified. All work is to be performed in accordance with the guidelines established by Federal, State, and local ordinances.
2. Location: The Contractor shall provide complete pest control services for Corpus Christi Outpatient Clinic (CCOPC) 5283 Old Brownsville Road, Corpus Christi TX 78405.
3. Coverage: Contractor will apply residual insecticides, outside of the building and the inside all rooms clinical and non-clinical rooms, the elevator, all stairwells, hallways, lobbies and common areas and any other area identified by the Contracting Officer’s Representative (COR) or COR representative. The contractor will also apply the needed residual insecticides outside of the building throughout the perimeter of property of the VA (CCOPC) and any other area identified by the COR or COR representative.
Treatment:
(a) Throughout the year, the Contractor will treat the clinic at a minimum twice (2 times) a month or if more calls are necessary, the contractor will answer any such calls at no additional charge;
to control all ants, flies, silverfish, fleas, ticks, spiders, earwigs, scorpions, mosquitoes, and rodents in the interior and exterior. (The perimeter of property of the VA (CCOPC) and any other area identified by the COR or COR representative of the clinic.)
(b) Set up of traps and removal of dead/alive animal / pests (e.g., dogs’ cats, squirrels, raccoons, opossums, skunks, rabbits, bats, birds, reptiles, bees, wasps, hornets, and similar unwanted pests), as needed through the life of the contract. Contractor will provide a price listing for every pest removal service.
(c) Treatment and extermination the interior of the clinic as necessary for the removal of the following types/species; mites, bed bugs, lice, and any other pest identified by the CO, COR or COR representative as needed throughout the life of the contract. One job is per requested occurrence. If more calls are necessary to control the named insects above, the contractor will answer any such calls at no additional charge. Contractor will provide a price listing for every pest removal service.
Restrictions of Pest Control Materials: All rodenticides or trays shall be placed only at times and in areas approved by the COR or COR representative of pest control and unused portions shall be recovered within a reasonable amount of time. No pest control materials or traps shall be placed where they may be recovered by patients. No pest control materials shall be allowed to contact food or cooking utensils within the break rooms. All trapped rodents shall be recovered and disposed of by the Contractor within 8 hours or the next business day.
Scheduling:
(a) Pest management tasks shall be scheduled to be performed on definite appointed days and in no event shall the Contractor carry on work outside regular agreed upon working hours without prior approval of COR or COR Representative.
(b) In the event climate or weather conditions become unsuitable for work or may induce an environmental hazard, and then the entire work shall be rescheduled to a date and time satisfactory to the Contractor and COR or COR Representative. Postponement will not reflect any penalties assessed to the Contractor, nor should there be any additional cost to the Government.
Tasks: Services required of the Contractor are as follows:
(a) Monitoring and surveillance of pest populations to determine which pest management measures are appropriate and required.
(b) Recommending environmental sanitation practices that restrict or eliminate food, water, or harborage for pests.
(c) Selection and utilization of non-chemical control methods, which eliminate, exclude, or repel pests (i.e., insect electrocution devices, traps, caulking, air screens, etc.).
(d) Selection and use of the most environmentally sound pesticides to control when chemically controlled methods are necessary.
(e) Control of general structural anthropoid pests (i.e., cockroaches, ants, termites, carpet beetles, spiders, carpenter ants, carpenter bees, etc.).
(f) Control of flying insect pests (i.e., houseflies, stable flies, blowflies, etc.).
(g) Control of predatory pests (i.e., lice, bedbugs, fleas, mites, ticks, bees, wasps, mosquitoes, scorpions, etc.).
(h) Control of stored product pests (i.e., sawtooth grain beetle, red/confused flour beetles, Trogoderma beetles, grain moths, etc.).
(i) Control of mice and rats (i.e., house mouse, field mouse, roof rat, Norway rat, etc.).
(j) Control of pest birds (i.e., pigeons, sparrows, blackbirds, etc.): The contractor shall provide consultation to the COR to determine the best method for control of birds.
(k) Control of other vertebrate pests (i.e., dogs, cats, squirrels, raccoons, opossums, skunks, rabbits, bats, reptiles, and similar unwanted pests).
(l) Control of aquatic pests (i.e., mosquito larvae/pupae, algae, etc.).
(m) Evaluation of control measures through surveillance and monitoring pest populations.
Provisions: The Contractor personnel in performing pesticide applications of the areas specified below, shall adhere to the following:
(a) Food Handling areas: Treatment of these areas is limited to only time when food is not being held, processed, prepared, served, and while not occupied by facility employees.
(b) Patient Occupied Areas: Contractor personnel shall utilize pesticides with as low a volatility and as odor free as possible to keep odor levels from affecting patients in these areas.
(c) Critical Areas: The Contractor shall submit a list of pesticides for intended use, for approval by the COR or COR Representative prior to any application, once complete the contractor will submit a copy of the pesticides that were applied, and the amount applied. The contractor will also submit a copy of the license of the person applying the pesticides each time the contractor come to the clinic to apply any pesticides. The planned use of pesticides in these areas requires recognition of the attendant hazards to occupants, supplies, equipment, and surfaces. No substitution can be made at any time without approval from COR or COR Representative. When treatment is required in these areas, the Ultra-Low Volume (ULV) method of pesticide application shall be utilized with approved equipment capable of delivering a particle size range of .5 to 15 microns.
Critical Areas as Determined by Local Medical Facility: Clinical Areas, Isolation Rooms, Respiratory Areas, X-Ray rooms and food preparation areas.
(a) Contractor personnel are required to interrupt their work at any time so as not to interfere with the normal functioning of the facility, including utility services, fire protection system, and passage of facility patients, personnel, equipment, and carts.
(b) The Contractor shall not dispose of any excess pesticide, pesticide containers or other materials contaminated by pesticides at any location on the medical facility premises.
(c) No pest control materials or equipment shall be stored or kept at the Veterans Administration Installation when the operator is not working, without the express Approval from the COR or COR Representative.
Call Back Requirements:
(a) Routine: The Contractor shall within eight (8) hours after receipt of notification by the Contracting officer or his/her COR or COR Representative and at no additional charge to the Government, retreat previously treated areas when inadequate control, as per specifications, was obtained.
(b) Emergency: The contractor shall within three (3) hours after receipt of notification by the Contracting Officer or his/her COR or COR Representative, and at no additional charge to the Government, perform services to correct the emergency condition. The VA must be able to contact the contractor via cellular phone, office phone, email, or voice mail, to achieve the desired response times.
Required Contractor Reporting:
(a) All SERVICE TECHNICIANS MUST REPORT to COR or COR Representative, to sign in before work is begun on the premises of CCOPC, and to sign out after work has been completed. The contractor shall provide a written report of specific services and inspections performed during each visit.
(b) The Contractor will be required to furnish the Veterans Administration, prior to initial application of pesticides, the trade names (if any) and chemical names of the chemicals used, Material Safety Data Sheets (MSDS), a label showing the contents, the use strength of the chemical as applied and the antidote thereto. Contractor will furnish the same information each time the contractor changes chemicals or products used in the performance of this contract. This information is required by the Medical Service for emergency treatment in the event of ingestion of and/or contact with the material by humans.
(c) The Contractor is responsible for supplying, completing, and submitting all reports required by VACO, Federal, State, or local ordinances, which pertain to any duties contained in the contract.
Coordinating Details:
(a) All services for this contract must meet manufacturer’s performance and technical specifications, Federal Regulations, and other specifications that may apply such as National Electric Code (NEC), Life Safety Code (LSC), Joint Commission on Accreditation of Healthcare Organizations (JCAHO), and VA Regulations.
(b) The contractor shall ONLY respond to service calls placed from COR or COR Representative. The Contractor shall not perform any service that will result in additional charges without prior approval from the contracting officer.
(c) There is a potential for exposure to blood borne or other infectious material with equipment throughout the hospital. All contract personnel must use the “Universal Precautions” (i.e., Decontamination of medical equipment, wearing protective gloves, aprons, and goggles) during cleaning and maintenance/repair procedures required by this contract.
Contract Administration Data: All contract administration functions will be retained by the Department of Veterans Affairs. The Contracting Officer will be the only person authorized to approve changes or modify any of the requirements under this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration.
Only the Contracting Officer will be authorized to make commitments or issue changes that affect price, quantity, or quality of performance of this contract. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered unauthorized, and no adjustment will be made in the contract price to cover any increase in costs incurred as a result thereof.
Acronyms and Definitions:
CDR: Contract Discrepancy Report. Report issued by the Government to the contractor to document a supply or service found to be unacceptable during contract performance.
CLIN: Contract Line-Item Number. Unit of work (or service) to be performed (or delivered) by the contractor as a pay item.
CO: Contracting Officer. A person with the authority to enter, administer, and/or terminate contracts and make related determinations and findings.
COR: Contracting Officer’s Representative. An individual, including a Contracting Officer’s Representative (COR), designated and authorized in writing by the contracting officer to perform specific technical or administrative functions.
QA: Quality Assurance. Actions taken by the government to assure contracted services meet PWS requirements.
Personnel:
(a) Non-Personal Services: This is a non-personal services contract. Personnel rendering services under this contract are not subject either by the contract’s terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the government and its employees. The Government shall not exercise any supervision or control over the contract service s performing services herein. Such contract service s shall be accountable solely to the Contractor who, in turn, is responsible to the Government.
(b) Contractor Compliance with the Immigration and Nationality Act of 1952: The Contractor shall comply with all legal provisions contained in the Immigration and Nationality Act of 1952, As Amended; its related laws and regulations that are enforced by Homeland Security, Immigration and Customs Enforcement and the U.S Department of Labor as these may relate to non-immigrant foreign nationals working under contract or subcontract for the Contractor while providing services to Department of Veterans Affairs patient referrals.
Hours of Operation:
(a) Service Hours: The service shall be provided during the hours of 8:30AM - 4:30PM Central Time (0830 - 1630), Monday through Friday, excluding holidays.
(b) National Holidays: The holidays observed by the Federal Government are:
New Year’s Day Labor Day Martin Luther King’s Birthday Columbus Day Presidents Day Independence Day Memorial Day Veterans Day Thanksgiving Christmas
And any other day specifically declared by the President of the United States to be a national holiday.
Quality Control:
(a) Contract Performance Monitoring: The COR may perform surveillance of services by any of the methods listed below:
(1) Observing actual performance.
(2) Inspecting the services to determine whether the performance meets the performance standards; and
(3) Review of any other appropriate records.
(b) When unacceptable performance occurs, the COR shall inform the Contractor and the Contracting Officer. This will normally be in writing unless circumstances necessitate verbal communication. In any case the COR shall document the discussion and place it in the COR file. When the COR determines formal written communication is required, the COR shall prepare a Contract Discrepancy Report (CDR), and present it to the contractor program manager. The Contractor shall acknowledge receipt of the CDR in writing. The CDR will specify if the Contractor is required to prepare a corrective action plan to document how the Contractor shall correct the unacceptable performance and avoid a recurrence. The CDR will also state how long after receipt the Contractor must present this corrective action plan to the COR. The Government shall review the Contractor corrective action plan to determine acceptability. Any CDRs may become a part of the supporting documentation for any contractual action deemed necessary by the Contracting Officer.
(c) Pursuant to VAAR Provision 852.270-1, Representatives of Contracting Officer representative(s); The Government shall periodically evaluate the Contractor performance by appointing a Contracting Officers Representative (COR) to monitor performance to ensure services are received. The Government representative(s) shall evaluate the Contractor performance through inspections of observations, inspection of services or any other form of documentation and all complaints from VA personnel. The Government may inspect as each task is completed or increase the number of quality assurance inspections if deemed appropriate because of repeated failures or because of repeated customer complaints. Likewise, the Government may decrease the number of qualities assurance inspections if performance dictates. The Government Contracting Officer shall make final determination of the validity of customer complaint(s).
(d) If any of the services do not conform to contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount.
(e) When the defects in services cannot be corrected by re-performance, the Government may require the Contractor to take necessary action to ensure that future performance conforms to contract requirements at no additional cost to the Government.
VHA Supplemental Contract Requirements for Combatting COVID-19
1. Contractor employees who work in or travel to VHA locations must comply with the following:
a. Documentation requirements:
1) If fully vaccinated, contractors shall show proof of vaccination.
i. NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination.
2) If unvaccinated, contractors shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor’s order or an FDA approved over-the-counter test that includes an affiliated telehealth service.
3) Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel.
4) Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.
2. Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the COVID-19 Screening Tool. Check regularly for updates.
a. Contractor employees who work away from VA locations, but who will have direct contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance, each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.
3. Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities.
4. For indefinite delivery contracts: Contractor agrees to comply with VHA

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

C.3 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 15 calendar days.

C.4 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR
2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 15 calendar days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 calendar days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

FEDERAL HIRES
The information provided in this clause is for informational purposes only and is not a wage determination. This is not an all-inclusive list, but only a representative list of federal service employees that could be employed under this contract. This clause also states the wages and fringe benefits payable to each if they were employed subject to the provisions of 5 U.S.C. 5341 or 5332 (i.e., GS/WG federal employee). It is the contractor’s responsibility to determine the human capital required to execute the terms of the contract. Likewise, contractors are responsible for confirming with DOL that they are using the appropriate wage determination for the employees they use in the performance of this contract and it is the contractor’s responsibility to ensure employees are paid in accordance with the appropriate classification as determined by DOL.

C.7 VAAR 852.219-74 LIMITATIONS ON SUBCONTRACTING—
MONITORING AND COMPLIANCE (JUL 2018)
(a) This solicitation includes VAAR 852.219-10 VA Notice of Total Service-Disabled Veteran- Owned Small Business Set-Aside.
(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor's offices where the Contractor's business records or other proprietary data are retained and to review such business records regarding the Contractor's compliance with this requirement.
