B.2 STATEMENT OF WORK (SOW)

Statement of Work Clean and Polish Fuel Tanks at the CTX Facilities

Waco and Temple Campuses

PROJECT # 674-21-2-5065-0745

Requirements

The contractor shall be responsible for providing all labor, materials, and equipment needed for the services required to clean, polish and test the f uel in generators and the Boiler Plants tanks at Waco and Temple Campuses. All services and inspections will come from the Central Texas Veterans Health Care Facilities at Doris Miller VA Medical Center at 4800 Memorial Drive, Waco, Texas 76711 and Olin E. Teague VA Medical Center at 1901 Veterans Memorial Drive, Temple, Texas 76504.

The contractor shall provide all personnel, vehicles, transportation, tools, equipment, materials, supplies, facility supervision, administration supervision and any other item(s) necessary to perform and accomplish this service. The contractor shall be familiar with all the terms, conditions, and requirement herein contained. All work must comply with federal, state and local regulations.

Note: “The C&A requirements do not apply, and that a Security Accreditation Package is not required for this contract.”

Period of Performance:

The contractor shall complete the work required under this SOW in 45 calendar days from the Notice to Proceed (NTP), unless otherwise directed by the Contracting Officer (CO). Contractor shall not perform any services on weekends or federal holidays unless prior approval from VA COR is received.

Project Requirements:

Waco Campus Fuel Tanks

1. Generators and Boiler Plant fuel tanks on Waco Campus:

a. Fuel Polishing Diesel tank B198 Generator Tank 11 – 1,000 gallons

b. Fuel Polishing Diesel tank B197 Generator Tank 12 – 2,000 gallons

2. The contractor shall centrifuge all the generators and Boiler Plant fuel tanks with a high-speed diesel fuel purification system that will remove the water, bacteria, algae, sediment and sludge from all storage tanks listed above.

3. The contractor shall test each tank before midpoint and after the fuel is polished and provide the VA COR with the results from the sampling company that tested the fuel within 5 days after completion of the service.

a. Samples taken should be testing for BS & W, micro-organism, and particulate filter ability. Depending on the results of tank sample testing, cleaning may be required. The Contractor shall provide lab testing for all diesel tanks as follows:

Certif ied lab analysis for particulate contamination, ASTM D 2276, water and sediment, ASTM D 2709, micro-organism study, culture study, bacteria count/ml and cetane and growth analysis. Cleaning is to be scheduled at least five (5) days in advance with the COR. Service representative shall make a written report to the Facilities Management Services, and the Manager of the Engineering Section (138FMS) on all work performed and advise of conditions found, including any recommendations.

4. Contractor shall provide fuel treatments for all generators and Boiler Plant Fuel tanks for the full amount and size of the tank.

5. Each generator and Boiler Plant tank shall be capped off with the correct amount fuel for the capacity per tank in gallons and deemed serviceable for use, after the completion of the polishing of tank. (Red Dyed Diesel – OFF Road fuel) Combustible Liquid III Diesel S15 NRLM No. 2-D.

Temple Campus Fuel Tanks

1. Generators and Boiler Plant fuel tanks on Temple Campus:

a. Fuel Polishing Diesel tank B163 Generator – 2,000 gallons

b. Fuel Polishing Diesel tank B171 Generator – 1,000 gallons

A. Government Holidays:

(a) The Government hereby provides notice and Contractor hereby acknowledges receipt that Government personnel observe the listed days as holidays:

(b) In addition to the days designated as holidays, the Government observes the following days:

a. Any other day designated by Federal Statute

b. Any other day designated by Executive Order

c. Any other day designated by the President’s Proclamation

It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation. In the event the Contractor's personnel work during the holiday, they may be reimbursed by the Contractor, however, no form of holiday or other premium compensation will be reimbursed either as a direct or indirect cost, other than their normal compensation for the time worked.

3. Submit the proper documentation and reports to receive payment on this service. See information below:

A. Invoices and Payment

a. Payment to be made monthly, in arrears, following satisfactory performance by Contractor’s personnel and upon receipt of a properly prepared invoice.

b. Contractor shall be required to invoice through the Tungsten System at http://www.tungsten-network.com/us/en/veterans-affairs/. Additional information regarding Tungsten shall be provided upon award.

c. The contract shall have current registration in the System for Award Management (SAM) for this solicitation; URL: www.sam.gov.

d. The invoice MUST be itemized to include the following information. Any information listed below, and not provided on an invoice, will render that invoice incomplete and the invoice will be returned for immediate correction.

i. Time period being invoiced for.

ii. Description of services performed.

iii. Unit Cost billed.

iv. Extended amount due.

Other Considerations

• The contractor shall be responsible for the verification of all requirements for this contract.

• The contractor shall test the fuels before, midpoint and after fuel is removed and before reinstalling it back in the generators or boiler plant tanks.

• The contractor shall provide a report of their findings within 5 days of the service completion date and provide them to VA COR and Alternative CORs.

• It is the contractor’s responsibility to provide adequate documentation and verifications of chemicals of Red Dyed Diesel that is delivered that will meet or exceed all federal government requirements when fulfilling the tanks to normal recommended capacity.

• Deliveries will be done during normal working hours unless otherwise noted by the VA COR. Normal working hours are 7:00 am – 4:30 pm, Monday – Friday.

• Contractor personnel shall abide by all federal codes and regulations set forth for COVID-19 while working on the government premises. Also, all contractor personal must provide VA COR with a proof of an Influenza Vaccine while working on campus per VHA Directive 1192.01.

Note: Daily temperature checks will be performed, and masks are required while working on station.

SAFETY PLAN REQUIREMENTS

Prior to performing any work, the contractor shall have a safety plan set for deliveries in case of a hazardous chemical spill or mishaps.

The safety plan shall include, but not limited to the following:

A. Safety and Health Policy (i.e. company policy) B. Safety and Health Objectives (i.e. company goals, procedures, etc.)

C. Job Site Inspections (i.e. safety inspection/potential hazards/ mishap prevention, etc.)

D. Personal Protective Equipment (i.e. head, hearing, and eye protection, footwear, clothing, gloves, etc.)

E. Safety Rules (i.e. rules applicable to the work/task being performed, hazardous spills, etc.)

F. Job site Safety Training (i.e. OSHA, safety meetings, etc.)

G. Safety Discipline (i.e. correction of violations, etc.)

H. Emergency Procedures (i.e. responsibilities, procedures, etc.)

If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the

To that end, the support contractor(s) may require access to Contractor's offices where the Contractor's business records, or other proprietary data are retained and to review such business records regarding the Contractor's compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an

“Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR

EQUIPMENT (OCT 2020)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the

Offeror has represented that it ‘‘does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument’’ in paragraph (c)(1) in the provision at

52.204–26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212–3, Offeror Representations and Certif ications–

Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it ‘‘does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services’’ in paragraph (c)(2) of the provision at 52.204–26, or in paragraph (v)(2)(ii) of the provision at 52.212–3.

(a) Definitions. As used in this provision—

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204–25, Prohibition on Contracting for

Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization

Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after

August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment t ransmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal

Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.

Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or…
