(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
(ii) The solicitation number 36C26223Q0809 is issued as a Request for Quotation (RFQ) in conjunction with FAR Part 13 – Simplified Acquisition Procedures and constitutes the only solicitation. The government intends to award a single Firm-Fixed Price (FFP) contract.
(iii) The provisions and clauses in this document are in effect through the Federal Acquisition Circular 2023-02, March 16, 2023.
(iv) This solicitation intends to award a contract using full and open competition to a business associated with NAICS[footnoteRef:1] Code 325413. [1: North American Industrial Classification System]
(v) The US Government, Veterans Affairs (VA), Veterans Integrated Services Networks (VISN) 22 Network Contracting Office, seeks to make a procurement for Serology Test Kits for the VA San Diego Healthcare System (VASDHS). The estimated period of performance will start on 05/01/2023 through 04/30/2024, with four (4) additional one(1)-year option periods.
(vi) Offeror quotes must demonstrate meeting the salient, physical, functional, and performance requirements specified in this solicitation, otherwise it will be considered non-responsive.
(vii) All interested vendors shall provide quotations for the following requirements outlined herein and Attachments A.
REQUIREMENTS:
1) Brand Name and Equal to Product Information:
Items must be equal to this brand and part numbers and meet the following salient characteristics:
· Must be a fully automated assay for the Meridian Bioscience Absorbent Micro Plate Reader ELX800.
· Must be FDA approved for the Meridian Bioscience Absorbent Micro Plate Reader ELX800.
· Must be 100% compatible for use on the Meridian Bioscience Absorbent Micro Plate Reader ELX800 platform and will not limit the functionality of software, hardware, or testing capabilities.
· Must provide Serology Test Kits.
2) Pricing must include all handling, HAZMAT, dry ice, and shipping fees when applicable.
3) Estimated Annual testing volume – See Attachment A
4) Delivery hours - normal tour-of-duty hours are 7:30am to 5:00pm, Monday through Friday, excluding Federal holidays in accordance with 5 U.S. Code § 6103 (When a holiday falls on a Sunday, the following Monday will be observed as a National Holiday. When a holiday falls on a Saturday, the preceding Friday is observed as a National Holiday by U.S. Government Agencies).
5) Delivery to the Path and Lab Department, to the VASDHS as needed, at 3350 La Jolla Village Dr. San Diego, CA 92161.
(viii) The provision at 52.212-1, Instructions to Offerors – Commercial Items, applies to this solicitation.
All offeror quotes for this solicitation must be received electronically through email (not to exceed 10 MB) to Mark Hrycyk at mark.hrycyk@va.gov no later than Monday, April 24, 2023, 7:00 AM Pacific Time (PT). Ensure to reference solicitation number 36C26223Q0809 within subject line of the email. Any offeror quotes received after the prescribed date/time shall be considered non-responsive and will not be considered for award.
Any questions regarding this solicitation must be received electronically through email to Mark Hrycyk at mark.hrycyk@va.gov and Robert W. Hutchison at robert.hutchison1@va.gov no later than Tuesday, April 11, 2023, 7:00 AM PT. Ensure to reference solicitation number 36C26223Q0809 within subject line of the email.
(ix) Offerors shall submit the following via email:
1. Offerors shall provide a narrative with sufficient informational that the Serology Test Kits being offered under this solicitation comply with all aspects of the Requirements and all Equivalent Brand (Row F), Equivalent Nomenclature (Row G), Equivalent Part Number (Row H), and Equivalent Description (Row I) are entered as requested in Attachment A – by inputting data into cell F2, G2, H2, I2, and F3, G3, H3, I3, and F4, G4, H4, I4 (ONLY) on Tabs 1(Base), 2(OY1), 3(OY2), 4(OY3), and 5(OY4).
2. Offerors shall provide pricing as requested in Attachment A – by inputting data into cell K2, K3, K4 (ONLY) on Tabs 1(Base), 2(OY1), 3(OY2), 4(OY3), and 5(OY4). All other cells will self-calculate.
3. If the offer is not the manufacturer, provide an “Authorized Distributor” letter.
(x) 52.212-2 Evaluation—Commercial Products and Commercial Services (Nov 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Lowest price for items that meet all salient, physical, functional, and performance requirements specified in Attachments A of this solicitation.
Acceptability of Serology Test Kits shall be established by review of each submitted quote by the designated technical evaluator(s) and verification that all specified items meet the salient, physical, functional, and performance requirements specified in this solicitation. Submissions to this solicitation must show clear and compelling evidence that the specified items meet all the salient, physical, functional, and performance requirements specified in this solicitation.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether-or-not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(xi) Offeror must include a completed copy of the provision at 52.212-3 -- Offeror Representations and Certifications -- Commercial Items, if they do not have a current record in SAM, with this solicitation.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-

(xiv) The following clauses also apply:
52.217-8 - Option to Extend Services (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 calendar days before contract expiration. The prices for any option exercised under FAR 52.217-8 will be those rates in effect under the contract each time an option is exercised under this clause.

(a) The Government may extend the term of this contract by written notice to the Contractor no later than 30 days before the contract expires; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years, not including any option to extend services under clause 52.217-8.

(a) No used, refurbished, or remanufactured supplies or equipment/parts shall be provided. This procurement is for new Original Equipment Manufacturer (OEM) items only. No gray market items shall be provided. Gray market items are OEM goods intentionally or unintentionally sold outside an authorized sales territory or sold by non-authorized dealers in an authorized sales territory.
(b) No counterfeit supplies or equipment/parts shall be provided. Counterfeit items include unlawful or unauthorized reproductions, substitutions, or alterations that have been mismarked, misidentified, or otherwise misrepresented to be an authentic, unmodified item from the original manufacturer, or a source with the express written authority of the original manufacturer or current design activity, including an authorized aftermarket manufacturer. Unlawful or unauthorized substitutions include used items represented as new, or the false identification of grade, serial number, lot number, date code, or performance characteristics.
(c) Vendor shall be an OEM; authorized dealer, distributor or reseller for the proposed equipment/system, verified by an authorization letter or other documents from the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions.
