About this file
This document is a pricing schedule spreadsheet for a solicitation issued by the Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 15. Vendors are requested to provide pricing for Insulet reservoir pods in quantities of 10 boxes by September 6, 2023. The solicitation requests a signed SF1449 cover page, completed pricing spreadsheet, OEM authorization documentation, and Buy American certification if offering non-domestic items. Products must have at least one year of expiration from delivery date. The solicitation allows non-manufacturing vendors to provide letters of authorization from an OEM's authorized wholesaler or reseller in lieu of direct OEM documentation. No gray market or remanufactured items will be accepted. The awarded vendor must be an authorized dealer or distributor that provides the OEM's warranty and services in accordance with the OEM's terms.

| Gray Market Prevention: Deviation to policy allows non-manufacturing vendors selling medical surgical supplies to satisfy the Gray Market Prevention language by providing letters of authorization from a manufacturer's authorized wholesaler/reseller via an authorization letter directly from the manufacturer. |
(a). Gray market items are Original Equipment Manufacturer's (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment, and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers. No remanufactured or gray market items will be accepted.
(b). Vendor shall be an OEM authorized dealer or authorized distributor for the proposed medical supplies, medical equipment, and/or services contracts for maintenance of medical equipment (i.e. replacement parts). Verified by an authorization letter or other documentation from the OEM, such that the OEM's warranty and services are provided and maintained by the OEM. All software licensing, warranty and services associated with the medical supplies, medical equipment, and/or services contract for maintenance of medical equipment shall be in accordance with the OEM terms and conditions.
(c). The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right to enforce any of its contractual remedies. this includes termination of the contract or, solely at the VA's election, allowing the vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items.
