About this file

This document includes a federal contract opportunity solicitation for medical supplies and a related pricing schedule spreadsheet. The Department of Veterans Affairs National CMOP Contracting Office is soliciting quotes to supply two medical supply items, Contour Next glucose test strips in 50-count and 100-count packages, to the Lancaster, Texas CMOP facility. Quotes are due by April 9, 2021 with delivery required within 10 days of order receipt. The solicitation is set aside for SDVOSB vendors and requires state distributor licensing and OEM authorization documentation be provided. Gray Market Prevention: Deviation to policy allows non-manufacturing vendors selling medical surgical supplies to satisfy the Gray Market Prevention language by providing letters of authorization from a manufacturer's authorized wholesaler/reseller via an authorization letter directly from the manufacturer.

(a). Gray market items are Original Equipment Manufacturer's (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment, and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers. No remanufactured or gray market items will be accepted.

(b). Vendor shall be an OEM authorized dealer or authorized distributor for the proposed medical supplies, medical equipment, and/or services contracts for maintenance of medical equipment (i.e. replacement parts). Verified by an authorization letter or other documentation from the OEM, such that the OEM's warranty and services are provided and maintained by the OEM. All software licensing, warranty and services associated with the medical supplies, medical equipment, and/or services contract for maintenance of medical equipment shall be in accordance with the OEM terms and conditions.

(c). The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right to enforce any of its contractual remedies. this includes termination of the contract or, solely at the VA's election, allowing the vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items.
