About this file
This document is a pricing schedule spreadsheet for a request for quote issued by the Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 15. The RFQ seeks pricing for medical supplies including intravenous administration sets, catheters, and related products to be delivered to the VA CMOP facility in Leavenworth, Kansas on or before January 30, 2024. Vendors must submit pricing using the provided spreadsheet by January 9, 2024 at 4:00PM CST along with required documents including an SF1449 cover page, OEM authorization documentation, and a BAA certificate for non-domestic quotes. The procurement is set aside for small businesses and subject to the Buy American Act. The spreadsheet lists two line items for medical supplies including product descriptions and packaging details for vendors to provide unit pricing and total extended pricing.

Gray Market Prevention: Deviation to policy allows non-manufacturing vendors selling medical surgical supplies to satisfy the Gray Market Prevention language by providing letters of authorization from a manufacturer's authorized wholesaler/reseller via an authorization letter directly from the manufacturer.
(a). Gray market items are Original Equipment Manufacturer's (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment, and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers. No remanufactured or gray market items will be accepted.
(b). Vendor shall be an OEM authorized dealer or authorized distributor for the proposed medical supplies, medical equipment, and/or services contracts for maintenance of medical equipment (i.e. replacement parts). Verified by an authorization letter or other documentation from the OEM, such that the OEM's warranty and services are provided and maintained by the OEM. All software licensing, warranty and services associated with the medical supplies, medical equipment, and/or services contract for maintenance of medical equipment shall be in accordance with the OEM terms and conditions.
(c). The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right to enforce any of its contractual remedies. this includes termination of the contract or, solely at the VA's election, allowing the vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items.
