About this file

This document contains a federal contract opportunity solicitation and related pricing schedule for medical supplies. The Department of Veterans Affairs seeks to procure six medical supply items for delivery to its Leavenworth Consolidated Mail Outpatient Pharmacy facility, including test strips and lancets. Vendors must submit a signed SF1449 cover page, price quote using the provided Excel schedule, current state wholesale distributor license, and documentation showing authorization as an original equipment manufacturer dealer or distributor. Quotes are due by November 16, 2021. Pricing is to remain valid for 10 days after receipt of order. The opportunity is set aside for service-disabled veteran-owned small businesses. Responding vendors must certify compliance with the Drug Supply Chain Security Act and not provide any Medicare-only items.

Gray Market Prevention: Deviation to policy allows non-manufacturing vendors selling medical surgical supplies to satisfy the Gray Market Prevention language by providing letters of authorization from a manufacturer's authorized wholesaler/reseller via an authorization letter directly from the manufacturer.

(a). Gray market items are Original Equipment Manufacturer's (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment, and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers. No remanufactured or gray market items will be accepted.

(b). Vendor shall be an OEM authorized dealer or authorized distributor for the proposed medical supplies, medical equipment, and/or services contracts for maintenance of medical equipment (i.e. replacement parts). Verified by an authorization letter or other documentation from the OEM, such that the OEM's warranty and services are provided and maintained by the OEM. All software licensing, warranty and services associated with the medical supplies, medical equipment, and/or services contract for maintenance of medical equipment shall be in accordance with the OEM terms and conditions.

(c). The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right to enforce any of its contractual remedies. this includes termination of the contract or, solely at the VA's election, allowing the vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items.
