B.4 STATEMENT OF NEED (SON)

Background: The Department of Veterans Affairs, Erie, PA VA Medical Center, Surgical

Department, is implementing a Total Joint Initiative to expand and sustain its ability to perform total hip and total knee arthroplasty procedures in-house. This initiative is intended to improve access to timely orthopedic surgical care for Veterans, enhance continuity of care, and reduce reliance on care in the community referrals.

As part of this initiative, the Erie, PA VA Medical Center has invested in standardized surgical platforms and powered orthopedic equipment to support a system based, reproducible approach to total joint replacement procedures. To fully operationalize the program, the Surgery

Department requires the acquisition of reusable orthopedic hand instruments necessary to assemble standardized instrument trays used during total joint procedures.

Scope of Work:. New orthopedic surgical instruments will be used to support our newly established Total Joint Initiative. The instruments shall be suitable for inclusion in standardized orthopedic instrument trays used for total hip and total knee arthroplasty procedures. The instruments are essential for patient positioning, surgical exposure, bone preparation, ligament balancing, implant placement, and closure during primary and revision total joint surgeries. The requested instrumentation must support repeated use in a high-volume surgical environment.

52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL

PRODUCTS AND COMMERCIAL SERVICES (DEVIATION)

OCT 2025

C.1 52.212-1 ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS

– COMMERCIAL PRODUCTS AND SERVICES (DEVIATION) (OCT 2025)

The following provisions are incorporated into RFO 52.212-1 as an addendum to this solicitation:

(a) Quotes shall be submitted via email to the Contracting POC listed on page 1 of the

Standard Form 1449 in Block 7a. Include the Request for Quote number in the subject line of the email. All quotes shall be submitted on or before the offer due date shown on page 1 of the

Standard Form 1449 in Block 8.

(b) Any exchanges with potential offerors must go through the Contracting POC. Prospective

Vendors are warned against contacting any medical center personnel outside the Procurement

Department before the award of a Contract resulting from this solicitation. If such contact occurs and is found to be prejudicial to competing Vendors, the Vendor making such contact may be excluded from award consideration.

(c) Period for acceptance of Quotes. The offeror agrees to hold the prices in its quote firm for

30 calendar days from the date specified for receipt of quotes.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of quotes. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during testing.

(e) Multiple Quotes. Offerors are encouraged to submit multiple quotes presenting alternative line items (provided that the alternative line items are consistent with RFO Part 4), or alternative commercial products or commercial services for satisfying the requirements of this solicitation.

Each quote submitted will be evaluated separately.

(f) Late submissions, revisions, and withdrawals of quotes.

(i) Offerors are responsible for submitting quotes so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that quotes are due.

(ii) Any quotation received at the Government office designated in the solicitation after the exact time specified for receipt of quotes is "late" and may not be considered unless it is received before purchase order issuance and the Contracting Officer (CO) determines that accepting the late quotation would not unduly delay the acquisition.

(iii) If an emergency or unanticipated event interrupts normal Government processes so that quotations cannot be received at the Government office designated for receipt of quotes by the exact time specified in the solicitation, and urgent Government requirements preclude a notice of an extension of the closing date, the time specified for receipt of quotes will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(g) Requests for information. The CO will not notify unsuccessful offerors that responded to this Request for Quotation (RFQ). However, offerors may request information on purchase order(s) resulting from this solicitation with the CO.

(h) Evaluation: Comparative evaluation: The Government will conduct a comparative evaluation of all offers received in response to this solicitation and award a contract to the offer that represents the best value for the Government. The evaluation will be based on the criteria outlined below.

(i) Technical Features and Capabilities: Please provide brochures, pamphlets, hyperlinks, or any other materials to show what your item does so that it can be evaluated on its features and capabilities. Failure to provide materials will likely result in a lower evaluation.

(ii) Price: The Government will evaluate the price by adding the total of all line-item prices including options. The Total Evaluated Price will be that sum. In accordance with RFO

25.106(b)(1), price preferences will be given to American-made products.

(iii) Compliance with the Statement of Need (SON): The Statement of Need (SON) outlines the specific requirements of the facility and the products’ features necessary to execute essential tasks. All offers must fully comply with the requirements described in the SON. Offers that do not meet these requirements will receive a lower evaluation.

(iv) Delivery: Offeror must specify the date or delivery information for the quoted items so that the timeframe/delivery information can be evaluated and ultimately agreed upon in the resulting contract.

(v) Warranty: Provide the warranty, express or implied, details and documentation. Express warranties will be included into the resulting contract.

(i) To be deemed responsive and be considered for award, an offeror’s quotation shall include the following in addition to what the statement of need requires and the evaluation information above.

(i) Attachment “Line Items” Referenced in Section D and attached to this solicitation. If you are offering an alternative product(s), fill out blocks C and E and add/subtract line items as needed to convey your complete offer to meet or exceed.

(ii) This acquisition uses brand name descriptions. The brand name and product referenced in this solicitation are meant to provide potential offerors with an easy to find product so that they can compare items easily. The brand name and product are not intended to be restrictive or to convey that the Government only wants such products or brands. However, the salient characteristics/features provided are minimum requirements that shall be met by a comparable item in order to provide an equal or better product.

(iii) A Letter of Authorization (LOA) from the Original Equipment Manufacturer (OEM). The

LOA authorizes the offeror to sell/distribute a brand product if the offeror is not the OEM in accordance with VAAR 852.212-71 GRAY MARKET AND COUNTERFEIT ITEMS (FEB 2023).

(iv) Submit a filled-out copy of the Standard Form 1449 which should include at a minimum:

(A) page 1 – blocks 12, 17, 30a, 30b, and 30c completed by the offeror.

(B) page 2 – Complete Contractor POC Information and Acknowledge Amendments, if applicable

(C) Section B.2 Price/Cost Schedule or Attachment “Line Items” if offering alternative products.

(D) Complete RFO provision 52.212-2 in its entirety.

(j) In accordance with FAR 52.204-7 System for Award Management, an Offeror is required to be registered in System for Award Management (SAM) when submitting an offer or quotation and shall continue to be registered until the time of award, during performance, and through final payment of any contract, order, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation. Processing time should be taken into consideration when registering. Offerors who are not registered in SAM should consider applying for registration immediately upon receipt of this solicitation. See https://ww.sam.gov/ for registration information.

(k) The Government intends to award a one-time Firm Fixed Price contract as a result of this solicitation; however, it reserves the right to issue more than one contract if it is in the

Government’s best interest. The Government may issue a purchase order for any item or group of items of a quotation, unless the offeror qualifies the quotation by specific limitations. Unless otherwise provided in the Schedule, quotations may not be submitted for quantities less than those specified. The Government reserves the right to issue a purchase order for a quantity less than the quantity quoted, at the unit prices quoted, unless the offeror specifies otherwise in the quotation.

(End of Provision)

Upon request, the Contracting Officer will make their full text available.
