About this file
This is a Brand Name Justification document for a Department of Veterans Affairs (VA) procurement of four medical surgical products under simplified acquisition procedures. The contracting activity is the VA's Network Contracting Office 15 (NCO 15) – CMOP Division, with an estimated total value of $578,800.00. The four line items consist of: (1) ONE TOUCH VERIO Glucose Test Strips 100CT manufactured by LifeScan/OneTouch (Manufacturer Part Number 53885-0272-10), quantity 2,400; (2) SET, INFUSION AUTOSOFT XC TANDEM #1001680 manufactured by Tandem Diabetes Care (MPN 89152-1680-05), quantity 1,800; (3) CATH SET, INTERMIT 14FR H#96144 manufactured by Hollister (MPN 01234-0961-44), quantity 400; and (4) SET, INFUSION AUTOSOFT XC TANDEM #1001729 manufactured by Tandem Diabetes Care (MPN 89152-1729-05), quantity 1,200. Chelmsford CMOP requires one delivery for line items 1–3, while Tucson CMOP requires one delivery for line item 4, with specific delivery schedules to be determined during evaluation.
Competition is restricted to a single responsible source under 10 U.S.C. § 3204(a)(5) and 41 U.S.C. § 3204(a)(5) because these products have been prescribed for VA patients by physicians and constitute "dispense as written" medical orders with no permissible Manufacturer Part Number substitutions. The market research, conducted in accordance with FAR Part 10 and VAAR 810, included a sources sought notice posted on SAM.gov from December 5–9, 2026, which generated eight interested vendors. The Contracting Officer determined the anticipated cost will be fair and reasonable based on competition, the Independent Cost Government Estimate, and previous acquisition history. All four items are manufactured non-domestically. The acquisition will be split, with the diabetic test strips solicited as a total Service-Disabled Veteran-Owned Small Business set-aside under an existing class waiver, while the remaining items will be competed on a full and open basis because their Original Equipment Manufacturers are large businesses. The document is signed by Jennifer Knight, Contract Specialist, and Kelley Cunningham, Senior Contracting Officer, both dated February 26–27, 2026.

e. The Nonmanufacturer Rule
13 CFR 121.406(b), at least two small businesses identify themselves as authorized distributors. These firms have 500 or fewer employees, operate in the retail/wholesale trade for pharmaceuticals, and take ownership or possession of the products through their facilities or personnel.
Market research shows that only one small business manufacturer produces the Tandem product in the commercial marketplace; however, the product is not manufactured domestically. The other two OEMs—Hollister and OneTouch/Lifescan—are large businesses, and their products are also manufactured outside the United States.
The Contracting Officer confirmed there is a class waiver for diabetic test strips (Medical Surgical Supplies) under NAICS 325413, but no waiver applies to the remaining items. As a result, this acquisition will be split:
o o The remaining items will be competed on a full and open basis because the OEMs are large businesses and the products are manufactured
2237’s: 761-26-2-014-0037 | 762-26-1-040-0450 small business manufacturers currently exist and that would allow compliance with the NMR.
8. Discuss consideration to BAATAA/Exception to BAA (See FAR Part 25) These items are Brand Name/ Dispense as written only. Per FAR 25.01(a)(5) the use of the sole source justification for brand name only - is an exception to the use of trade agreements.
Therefore, BAA applies. All items are made non-domestically as shown in the above chart. A pre-award BAA waiver will be submitted.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition”:
Previous acquisition history with this VA contracting office has shown a mix of large and small businesses have met and fulfilled this product in the recent past.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Market research shows previous awardees have demonstrated an interest in this requirement via the posted sources sought.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: No action is being taken at this time due to the fact that no MPN substitutions are permitted based on physician’s specific orders. There is plenty of competition expected based on the sources sought results.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
