About this file

This is a Federal Acquisition Regulation (FAR) Deviation Notice issued in February 2025 addressing a system synchronization issue between policy updates and the System for Award Management (SAM).

The notice alerts contracting officers and entities that SAM may continue requiring completion of representations and certifications based on Federal Acquisition Regulation provisions that are not included in agency solicitations. Specific examples cited include FAR 52.222-25 (Affirmative Action Compliance) and paragraph (d) of FAR 52.212-3 (Offeror Representations and Certifications—Commercial Products and Commercial Services). The deviation clarifies that contracting officers will not consider these representations when making award decisions or enforcing contract requirements. Entities are neither required to complete these representations nor able to update their SAM registrations to remove them, effectively creating a grace period until system updates align with policy changes.
