About this file
This is a federal contracting provision template titled "Buy American Certificate (OCT 2022)" that establishes certification and disclosure requirements for offerors regarding the domestic content of end products in their proposals.
The provision requires offerors to certify that all end products are domestic end products unless specifically listed otherwise. Offerors must separately identify any foreign end products manufactured in the United States that do not qualify as domestic, and for non-iron/steel foreign end products, indicate whether they exceed 55 percent domestic content (excluding COTS items). If domestic content percentage is unknown, offerors must select "no." Additionally, offerors must separately list line item numbers for all domestic end products containing critical components as defined in FAR 25.105. The provision includes two tables for offeror completion: one for foreign end products (requiring line item number, country of origin, and domestic content threshold indication) and one for domestic end products containing critical components (requiring line item numbers only). Government evaluation of offers will follow Federal Acquisition Regulation Part 25 policies and procedures. Key defined terms—COTS item, critical component, domestic end product, end product, and foreign end product—are referenced in the "Buy American—Supplies" clause of the solicitation.
