B.2 STATEMENT OF WORK
1. Veterinary Services for Research & Development at Tibor Rubin VA Medical Center.
Tibor Rubin VA Medical Center (TRVAMC) Research & Development with veterinary services to the Veterinary Medical Unit (VMU). The TRVAMC is part of the Desert Pacific Healthcare Network (VISN 22), and is one of the most diversified tertiary health care providers in the VA. It is a teaching hospital, providing a full range of patient services, with state-of-the art technology as well as education and research.
2. Scope Offeror to provide Research HCG, VMU with veterinary services as needed to care for sick animals, provide professional guidance and oversight of animal facility, provide input and recommendations pertaining to studies using animal subjects to Research & Development management, Principal Investigators, and animal committee.
3. Tasks
3.1. General Requirements and Mandatory Tasks
3.1.1. Offeror to provide VMU with examination of incoming animals to ensure that only healthy animals are received.
3.1.2. Provide diagnostic and treatment of sick animals.
3.1.3. Provide professional guidance, recommendations and oversight to VA Animal
Facility staff, Research & Development management, Principal Investigators, and Animal Committees.
3.1.4. Attend all Research & Development monthly Animal Committee meetings.
3.1.5. Makes necessary recommendations to ensure that the VMU at the Tibor Rubin
VA Medical Center retains Association for Assessment and Accreditation of Laboratory Animal Care International (AAALAC) accreditation.
4. Implementation
4.1. Change Management Plan
4.1.1. The contractor shall provide a Change Management Plan to document procedures for additions, deletions, and modifications to the Scope of Work and the Mandatory Tasks as outline in section 3.
5. Hours of Operation
5.1. Normal tour-of-duty hours at TRVAMC is 7:00 am to 3:00 pm, Monday through Friday, excluding Federal holidays. There may be instances in which the contractor’s workday may be outside of this period. The contractor is required to coordinate these times with the designated Principal Investigator.
5.2. In accordance with 5 U.S.C. 6103, Executive Order 11582 and Public Law 94-97 the following national holidays are observed and for the purpose of this contract are defined as “Legal Federal official holidays”.

5.3. When a holiday falls on a Sunday, the following Monday will be observed as a National Holiday. When a holiday falls on a Saturday, the preceding Friday is observed as a National Holiday by U.S. Government Agencies.
6. Contractor Responsibilities
6.1. Contractor shall provide FSC with invoices.
6.2. The contractor shall be responsible for any and all liability actions or suits when the contractor is at fault or negligent in the performance of the mandatory tasks as outlined in section 3 subsection titled “General Requirements and Mandatory Tasks”.
7. Tibor Rubin VA Medical Center (TRVAMC) Responsibilities
7.1. Research & Development VMU and management staff to contact offeror to schedule meetings and site visits to inspect new deliveries and treat sick animals as needed.
8. Qualifications Certifications & Submittals
8.1. Contractor personnel performing veterinary services must be fully qualified, competent
Veterinarians. Personnel must have graduated from a veterinary school with a doctoral or professional degree and must possess current accreditation with the State of California. Contractor personnel must have familiarity and experience with the requirements for continued accreditation by the American Association of Laboratory Animal Care (AAALAC) certification shall be submitted with the contractors offer.
8.2. The qualifications of the contractor as well as its personnel shall be subject to review by the Chair ,Research & Development Department, VA Chief of Staff, and the Tibor Rubin VA Medical Center Director. The contractor shall submit a list of names of the key personnel to provide services under this contract.
8.3. Curriculum vitae must be provided for all licensed veterinarians and shall be submitted with the contractors offer.
9. Contractor Personnel
9.1. The contractor shall provide a contract program manager who shall be responsible for the performance of the work. The name of this person shall be designated in writing to the Contracting Officer. The Contractor’s Program Manager shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract.
9.2. The Contractor shall assume full responsibility for the protection of its personnel furnishing services under this agreement, in accordance with the personnel policy of the Contractor, such as providing worker’s compensation, professional liability insurance, health examinations, income tax withholding, and social security payments.
9.3. Worker’s compensation and employer’s liability: In accordance with FAR clause 28.307- 2, the following applies:
9.4. The Contractor is required to comply with applicable Federal and State Worker’s Compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer’s liability except when contract operations are so commingled with the contractor’s commercial operations that it would not be practical. Employer’s liability coverage of at least $100,000.00 is required with the exception of states that do not permit Worker’s Compensation to be written by private carriers.
9.4.1. General Liability: $500,000 per occurrence
9.4.2. Automobile Liability: $200,000 per person, $500,000 per occurrence and $20,000 per occurrence for property damage
9.4.3. Professional Liability Insurance

9.4.5. Social Security Payments
9.4.6. Health Examinations
9.5. The contractor shall be responsible for maintaining the general liability insurance, automobile liability insurance, professional liability insurance, income tax withholding, social security payments, and health examinations.
9.6. Contractor will indemnify and hold the hospital harmless from any and all claims, actions, liabilities, and expenses (including costs of judgments, settlements, court costs, and attorney fees) caused by or resulting from the sole negligence or intentional actions or omissions of the contractor’s employee, or any failure to perform any obligations imposed by this agreement, whether such act, omission, or failure was employee’s or that of any person providing services hereunder through or for provider.
9.7. The parties agree that such personnel shall not be considered VA employees for any purpose and shall be considered employees of the Contractor.
9.8. The contractor shall not employ persons for work on this contract if such employee is identified to the contractor as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population.
9.9. Contractor personnel shall present a neat appearance and be easily recognized as contractor employees. This may be accomplished by wearing distinctive clothing bearing the name of the company and/or wearing badges bearing the Contractor’s and employee’s name. Contractor Field Service Engineers shall be dressed to present a clean, neat appearance at all times when performing under this contract.
9.10. Contract Personnel shall be subject to the same quality assurance standards or exceed current recognized national standards as established by the Joint Commission (JC).
The Contractor shall perform services in accordance with the ethical, professional, and technical standards of the service industry as consistent with VA Policy, Regulations and Procedures.
10. Identification, Parking, Smoking, & VA Regulations:
10.1. The contractor’s staff performing the procedures will be provided with escorted access to the VMU.
10.2. BADGE: Contractor shall obtain a “Contractor I.D. Badge” from the VA Police. All Contractor personnel are required to wear I.D. Badge during the entire time on VA facility. The I.D. Badge MUST have an identification picture and shall state the name of the individual and the company represented.
10.3. PARKING: It is the responsibility of the contract personnel to park in the appropriate designated parking areas. Parking information is available from VA Police & Security Service Office. The Contractor assumes full responsibility for any parking violations.
10.4. SMOKING: No smoking is allowed on VA facility grounds. It is in fulfillment of this obligation that the facilities are committed to the establishment of a smoke-free environment.
11. PLACE OF PERFORMANCE:

12. PERIOD OF PERFORMANCE:
Twelve (12) month Base Year with four (4) twelve (12) month option years.
13. CHANGES:
13.1. The awarded contractor is advised that only the Contracting Officer, acting within the scope of the contract has the authority to make changes which affect the contract in terms of quality, quantity, price, or delivery.
13.2. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment shall be made in the contract terms or price to cover any increase in costs incurred as a result thereof.
Appendix - COVID Supplemental Language
VHA Supplemental Contract Requirements for Combatting COVID-19
1. Contractor employees who work in or travel to VHA locations must comply with the following:
a. Documentation requirements:
1) If fully vaccinated, contractors shall show proof of vaccination.
i. NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination.
2) If unvaccinated, contractors shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor’s order or an FDA approved over-the-counter test that includes an affiliated telehealth service.
3) Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel.
4) Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.
2. Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the COVID-19 Screening Tool. Check regularly for updates.
a. Contractor employees who work away from VA locations, but who will have direct contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance, each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, at all times, adhere to and ensure compliance https://www.va.gov/covid19screen/ https://www.va.gov/covid19screen/ https://www.va.gov/covid19screen/ with federal laws designed to protect contractor employee health information and personally identifiable information.
3. Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities.
4. For indefinite delivery contracts: Contractor agrees to comply with VHA
Supplemental Contract Requirements for any task or delivery orders issued prior to this modification when performance has already commenced.

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.
C.4 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR
2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

(d) Comptroller General Examination of Record. E.1 ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—
COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES
Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available.
The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:
Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 60 days from the date specified for receipt of offers.
Offerors are notified that VA Form 10091, FMS Vendor File Request Form and W-9 (See attached documents). Request for Taxpayer Identification Number and Certification shall be securely faxed to the VA Financial Service Center at (512) 460-5221, and also be submitted with their quote. Failure to include this information may eliminate the offeror from award consideration or considerably delay the award.
System for Award Management: IAW FAR 52.212-4 (t) Contractors submitting offers are required to be registered in the SAM database to be considered for award of a contract.
Amendments to this Solicitation: Contractors are encouraged to monitor the Contract Opportunities website with respect to this solicitation, all amendments to this Solicitation will be posted on the website.
Submittal Instructions: The offerors package must be labeled with the Contractor’s name and business address of firm, the solicitation number, and point of contact to include name, telephone and email address. The Government is not responsible for identifying inconsistencies between the two and may rely on either version at its discretion.
The Contractor is advised that all submissions and related materials become the property of the U.S. Government and will not be returned. A Contractor’s offer, if accepted by the Government, will form binding parts of the contract that results from this solicitation. Therefore, care must be taken to properly address the requirements set forth in this RFQ.
Offerors should review this entire solicitation before submitting an offer to ensure that their offers meet all requirements.
Each Offeror shall submit only one offer which addresses all Government requirements outlined in this solicitation. Offerors shall submit their offers with a cover letter, by date and time noted on the first page of the SF1449 in block 8. The contractor shall submit their offer electronically to Arcelia.Medina@va.gov.
