B.2 STATEMENT OF WORK

Central TX VHA Air Exchange Rate Testing

Austin/Temple/Waco VA

Requirements:

The contractor shall be responsible for providing a contract for the services to determine the number of air exchanges for requested rooms in Austin, Temple, and Waco campuses & WAG testing for the OR’s in Temple. This is a turnkey project. Work performed will be done at 3 sites for the Central Texas Veterans Health Care system. After all work is completed, the contractor will have a walkthrough with the Project Manager (PM) or VA COR to ensure all work is completed and ready to receive payment.

The Contractor shall provide and install any required materials, equipment, labor, and trades for the completion of this project. The Government will not provide any materials, equipment, labor, or trades for this project. It is the sole responsibility of the Contractor to meet the requirements of this project without any assistance from the Government. The Government will provide access and information only for this project.

The Contractor shall contact the VA COR 5 days ahead of starting work to allow for coordination.

The Contractor shall provide a work schedule to include a detailed list of work to be done for each requirement and the sequence in which it will be accomplished. The schedule shall be in the form of a progress chart of suitable scale to indicate the work scheduled for completion by any given date during the work period. The work plan shall indicate time frames and programmed power shut-off, if applicable. Contractor shall highlight on the schedule any off-hours and overtime work requirements.

The building will be occupied, and Government operations will continue normal basis for the duration of the contract. The Contractor shall take all precautions to ensure that his operations are conducted in a manner so as not to interfere with the normal operation of the building’s.

The Contractor shall execute work in a safe manner and shall not subject personnel to unsafe conditions.

All work under this contract shall be accomplished by a Licensed Professional skilled in the trade. The contractor shall provide all skilled personnel, services, vehicles, transportation, tools, equipment, materials, supplies, facility supervision, administration supervision and any other item(s) necessary to perform and accomplish this service. The contractor shall be familiar with all the terms, conditions, and requirement herein contained. A pre site visit can be coordinated for Contractor’s bidding and all must be present to verify measurements and investigate site conditions prior to submitting proposal. All work must comply with federal, state, local regulations, and VA Specifications. The Contractor shall obtain all required permits.

The Contractor shall protect all government property to include ceilings, floors, walls, and buildings from damage. Contractor and all associated subcontractor employees shall comply with applicable facility and local security policies and procedures. Contractor shall provide names of Contractor and Subcontractor employees to the COR or Government representative.

VA will issue contractor badge/pass to contractor and subcontractor employees, as applicable.

Employee list shall include name, title, qualifications and responsibilities like hazardous materials, PPE, fire safety penetrations, material disposal, lock-out/tag-out, etc.

All work shall be done according to the Infection Control Risk Assessment (ICRA) specified for the respective areas where work is performed.

Performance Period:

Base year: March 27, 2024 – March 26, 2025 Option Year 1: March 27, 2024 – March 26, 2025 Option Year 2: March 27, 2025 – March 26, 2026 Option Year 3: March 27, 2026 – March 26, 2027 Option Year 4: March 27, 2027 – March 26, 2028

Note: The C&A requirements do not apply, and that a Security Accreditation Package is not required for this contract.

Note: The Contractor shall field verify all existing conditions, measurements, dimensions and working space.

Note: The Contractor shall provide all results in writing and electronically to the VA COR or Representative prior to final payment. The list must include Type of room, RM# / Bldg.#, Date completed, Cubic Feet of room, CFM, Minutes, CFMH, ACH, ACH Required, Positive of Negative. The list must be separated by location.

Note: The Contractor shall provide the VA COR a list of recommendations and an estimated cost in writing and electronically for any correction that cannot be manually adjusted by them prior to final walkthrough.

Note: The Contractor shall provide a written Method of Procedure (MOP) for all work a week prior to outages.

Required Experience and Credentials

Test and balance contractor shall be a certified member of Associated Air Balance Council (AABC), National Environmental Balancing Bureau (NEBB), or Testing, Adjusting and Balancing Bureau (TABB) and have a minimum of three years’ experience in the test and balance (TAB) trade. Technician performing work must have a minimum of three years’ experience with healthcare facilities and be familiar with VA or other Federal Government facilities and procedures. Certification and resumes shall be provided.

Project Requirements:

1. The contractor shall measure the room size and calculate the volume of each identified room to determine the number of air exchanges per hour.

2. The contractor shall determine if the room has negative or positive pressure. The following rooms must be – Clean Rooms (Pos), Soiled Rooms (Neg), Public restrooms to include W.C., bathrooms, or toilets (Neg), Medical storage (Pos) and Trash Rooms (Neg).

3. The contractor shall perform and verify accurate measurements of each room.

4. The contractor shall make, if equipped, all manual corrections to the system that may be required to achieve correct air exchanges.

5. The contractor shall ensure that each room has a minimum total ACH per U.S. Veterans

Affairs HVAC design Manual. These are regulated in NFPA The following rooms will have these minimum ACHs – Clean Rooms (4), Soiled Rooms (10), Public restrooms to include bathrooms, or toilets (10), Medical storage (4) and Trash Rooms (10). These ACH rates are the current requirements and are subject to change.

6. If the room does not meet the requirement ACH or room pressure, contact COR next day to adjust it.

7. Perform a final walkthrough with the VA COR or PM when completed.

8. Each location has three types of rooms.

a. Critical rooms - tested twice a year

b. Non-Critical rooms – tested once a year

c. Operating Rooms – Tested twice a year (WAG Testing)

9. Coordinate with VA COR before the start of this service. See information below:

10. Here is the list of the number of rooms currently requesting testing. These numbers are subject to change.

a. Temple has up to 138 rooms.

i. 70 Critical rooms

ii. 68 Non-Critical rooms

iii. 10 Operating Rooms

b. Waco has up to 13 rooms.

i. 5 Critical rooms

ii. 8 Non-Critical rooms

c. Austin Outpatient Clinic has up to 33 rooms.

i. 33 Critical rooms

ii. 0 Non-Critical rooms

11. Contractor will provide a contingency funding to add additional room/room testing if the needs arise at the various locations.

Note: It is highly encouraged bidders do a site visit to verify conditions prior to bid in-order to be fully acquainted with existing site conditions and scope of work. The VA will not be responsible for Vendor’s misconceptions of the conditions and requirements of this service.

Note: At the end of each workday, please clean-up all worked in areas.

It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation. In the event the Contractor's personnel work during the holiday, they may be reimbursed by the Contractor, however, no form of holiday or other premium compensation will be reimbursed either as a direct or indirect cost, other than their normal compensation for the time worked.

A. Invoices and Payment

a. Payment to be made monthly, in arrears, following satisfactory performance by Contractor’s personnel and upon receipt of a properly prepared invoice.

b. Contractor shall be required to invoice through the Tungsten System at http://www.tungsten-network.com/us/en/veterans-affairs/. Additional information regarding Tungsten shall be provided upon award.

c. The contractor shall have current registration in the System for Award Management (SAM) for this solicitation; URL: www.sam.gov.

d. The invoice MUST be itemized to include the following information. Any information listed below, and not provided on an invoice, will render that invoice incomplete and the invoice will be returned for immediate correction.

i. Time period being invoiced for.

ii. Description of services performed.

iii. Unit Cost billed.

iv. Extended amount due.

v. Invoice number, date, and amount partial or full

vi. Contract and obligation numbers. Any other days, not address in the

SOW, will need to be scheduled with VA COR to work if needed to satisfy this contract.

Codes and Standards The project shall be in accordance with the latest Uniform Building Code (UBC), National Fire Protection Associate (NFPA) standard, Uniform Federal Accessibility Standard (UFAS), VA Specifications and Standards, and local facility requirements. In the event there is a conflict between any of the standards/codes, the more stringent standard/code shall apply.

The contractor shall provide all applicable safety signage and barricades applicable to OSHA, VHA and DOD regulations. Contractor shall comply with VHA DIRECTIVE 2004-012 and all VA Center Policy Memorandums, including but not limited to the following:

(a) Protection of patients, visitors, and employees from traumatic injury, as well as occupational and facility–associated infections.

(b) Compliance with OSHA and State construction safety regulations. Construction contracts require that the general contractor’s on-site “competent person” have completed the OSHA 30-hour construction worker course and that all other general and sub-contractor’s workers have completed the OSHA 10-hour construction worker course or other relevant competency training. The determination for training is based on the project hazards and complexity, State and Federal regulations and VA requirements. Verification of completion of training will be required prior to performing work.

(c) Compliance with EPA and State environmental regulations.

SAFETY REQUIREMENTS

Prior to performing any work, the contractor will be required to submit a safety plan in accordance with OSHA and VA Regulations.

The safety plan shall include, but not limited to the following:

A. Safety and Health Policy (i.e. company policy) B. Safety and Health Objectives (i.e. company goals, procedures, etc.)

C. Job Site Inspections (i.e. safety inspection/potential hazards/prevention, etc.)

D. Contractor Safety Administrator (i.e. competent person/safety officer) E. Personal Protective Equipment (i.e. head, hearing, and eye protection, footwear, clothing, gloves, etc.)

F. Safety Rules (i.e. rules applicable to the work/task being performed, equipment, ladders, confined spaces, open flame, etc.)

G. Job Safety Training (i.e. OSHA, safety meetings, etc.)

H. Safety Discipline (i.e. correction of violations, etc.)

I. Hot Work Permit (i.e. responsibilities, procedures, etc.)

Written Hazard Communication Program (i.e. responsibilities, procedures, list of hazards, MSDS, Site Conditions

1. The work covered by these specifications are mostly buildings that are occupied some way fashion or form.

2. All work must be coordinated with the VA COR.

3. The contractor shall leave no area unsecured or unsafe at the end of the day.

4. The contractor shall always keep the premises as clean as possible and free from an accumulation of waste materials and rubbish.

5. It shall be the contractor’s responsibility to field verify all existing conditions and dimensions prior to bid.

6. All materials removed shall be disposed of offsite by the contractor.

7. Proper PPE must be worn when working in these conditions.

8. Lockout/Tagout procedures but be known by the technician.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

C.3 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 15 calendar days of contract expiration.

C.4 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR

2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 15 calendar days of contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

C.5 VAAR 852.203-70 COMMERCIAL ADVERTISING (MAY 2018)

The Contractor shall not make reference in its commercial advertising to Department of Veterans Affairs contracts in a manner that states or implies the Department of Veterans Affairs approves or endorses the Contractor’s products or services or considers the Contractor’s products or services superior to other products or services.

C.6 VAAR 852.219-73 VA NOTICE OF TOTAL SET-ASIDE FOR CERTIFIED

SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESSES (JAN 2023)

(DEVIATION)

(a) Definition. for the Department of Veterans Affairs, ‘‘Service-disabled Veteran-owned small business concern or SDVOSB’’:

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service-disabled Veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled Veterans or eligible surviving spouses (see VAAR 802.201, Surviving Spouse definition);

(ii) The management and daily business operations of which are controlled by one or more service-disabled Veterans (or eligible surviving spouses) or, in the case of a service-disabled Veteran with permanent and severe disability, the spouse or permanent caregiver of such Veteran;

(iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document;

(iv) The business has been certified for ownership and control pursuant to 38 U.S.C. 8127, 13 CFR 128, and is listed as certified in the SBA certification database at https://veterans.certify.sba.gov/; and https://veterans.certify.sba.gov/

(v) The business agrees to comply with VAAR subpart 819.70 and Small Business Administration (SBA) regulations regarding small business size, government contracting, and the Veteran Small Business Certification Program at 13 CFR parts 121, 125, and 128.

(2) The term ‘‘Service-disabled Veteran’’ means a Veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

(3) The term ‘‘small business concern’’ has the meaning given that term under section 3 of the Small Business Act (15 U.S.C. 632).

(4) The term ‘‘small business concern owned and controlled by Veterans with service-connected disabilities’’ has the meaning given the term ‘‘small business concern owned and controlled by service-disabled veterans’’ under section 3(q)(2) of the Small Business Act (15 U.S.C. 632(q)(2)).

(5) The term “SDVOSB participant” or certified SDVOSB means a small business that has been certified in the SBA Veteran Small Business Certification Program and listed in the SBA certification database (see 13 CFR 128.102).

(b) General. In order for a concern to submit an offer and be eligible for the award of an SDVOSB set-aside or sole source contract, the concern must qualify as a small business concern under the size standard corresponding to the NAICS code assigned to the contract and be listed as an SDVOSB participant in the SBA certification database as set forth in 13 CFR 128.

(1) Offers received from entities that are not certified SDVOSBs and listed in the SBA certification database at the time of offer shall not be considered.

(2) Any award resulting from this solicitation shall be made to a certified SDVOSB listed in the SBA certification database who is eligible at the time of submission of offer(s) and at the time of award.

(3) The requirements in this clause apply to any contract, order or subcontract where the firm receives a benefit or preference from its designation as an SDVOSB, including set-asides, sole source awards, and evaluation preferences.

(c) Representation. Pursuant to 38 U.S.C. 8127(e), only certified SDVOSBs listed in the SBA certification database are considered eligible to receive award of a resulting contract. By submitting an offer, the prospective contractor represents that it is an eligible and certified SDVOSB as defined in this clause, 13 CFR 121, 125, and 128, and VAAR subpart 819.70.

(d) Agreement/LOS certification. When awarded a contract action, including orders under multipleaward contracts, an SDVOSB agrees that in the performance of the contract, the SDVOSB shall comply with requirements in VAAR subpart 819.70 and SBA regulations on small business size, and government contracting programs at 13 CFR part 121 and part 125, including the non-manufacturer rule and limitations on subcontracting (LOS) requirements in 13 CFR 121.406(b) and 13 CFR 125.6. For the purpose of limitations on subcontracting, only certified SDVOSBs listed in the SBA certification database (including independent contractors) shall be considered eligible and/or ‘‘similarly situated’’ (i.e., a firm that has the same small business program status as the prime contractor). An otherwise eligible firm further agrees to comply with the required LOS certification requirements in this solicitation (see 852.219–75 or 852.219–76 as applicable). These requirements are summarized as follows:

(1) Services. In the case of a contract for services (except construction), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance to firms that are not certified SDVOSBs listed in the SBA certification database (excluding direct costs to the extent they are not the principal purpose of the acquisition and the SDVOSB/ VOSB does not provide the service, such as airline travel, cloud computing services, or mass media purchases). When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract.

(2) Supplies/products.

(i) In the case of a contract for supplies or products (other than from a non-manufacturer of such supplies), the SDVOSB prime contractor will not pay more than 50% of the amount paid by the government to the prime for contract performance, excluding the cost of materials, to firms that…
