About this file
This document is an amendment to a solicitation for Legionella water testing services. The Department of Veterans Affairs is seeking to collect Legionella water samples from various locations at the VA Illiana Health Care System in Danville, Illinois on a monthly basis. Services include collecting heterotrophic plate count samples from utility water and conducting retests as needed. The amendment clarifies that the size standard is $19 million and answers questions from potential offerors regarding personnel qualifications, sample collection responsibilities, and contract history. Market research determined the requirement did not necessitate a set-aside for service-disabled veteran-owned small businesses. The incumbent contractor is undisclosed due to holding a current contract awarded in March 2022. Offerors must acknowledge any amendments by the specified date in order to be considered for award.

RESPONSE TO VENDOR QUESTIONS
1. Are these tests something you are wanting the lab to come and collect, or is this something we could send you the sample containers with instructions and you collect and send back to us?
-The contractor shall come to the facility and collect the samples.
2. Do you have more information on the attached bid?
-All pertinent information has been provided and is listed in Solicitation 36C25223Q0447_1 published on sam.gov.
3. Can you please clarify the size standard for this solicitation? Form 1449 lists the size standard as $41.5M for NAICS 541380, however according to SBA.gov, it’s $19M.
-Size standard for this solicitation is $19.0 M
4. Could you please advise if this contract will be subject to prevailing wage requirements? If so, can you please disclose the wage determination and what hourly wage is expected for this service?
-As stated on Page 37 of solicitation; Service Contract Labor Standards shall apply- Department of Labor (DOL) Wage Determination (WD) 2015-5021 (Rev-19) dated 12.27.2022. Info listed as follows:
Employee Class GS-403 Microbiologist, Grade 9($26.22/hr) This is not a Wage Determination. This is for informational purposes only.
Monetary Wage-Fringe Benefits 30% Fringe Benefits
5. RFQ Page 8 of 65 5.) “5.) Collect 2-100ml Heterotrophic Plate Count Utility Water Samples to be collected from SPS Department testing for high levels of bacteria, 24 per year.” Can the government clarify that collection is monthly?
-2 per month, 24 per year
6. RFQ Page 45 of 65 states “Provide documentation indicating all personnel are qualified and/or certified to perform services as defined in the Scope of Work and vendor must provide proof/documentation of personnel assigned to service this contract.” Section B.2 Statement of Work does not detail any requirements for personnel qualifications, certification, or training.
- Page 45 of 65 is updated to say, “Provide documentation indicating all personnel are qualified and/or certified to perform services as stated in the attached VHA Directive 1061. Vendor must provide proof/documentation of personnel assigned to service this contract”.
7. CLIN 0008 has an estimated total quantity of 360.00 SPS Heterotrophic Plate Count (Spread Plate) critical water Retests. From the SOW it says 396 (see above). Will the VA staff collect these retests?
-All retests shall be collected by Contractor. The 396 retests are 11 retests per week for three of the four weeks, needing 4 sets of good tests in a row to revert to monthly, with the fourth week being a part of the regular tests number for the month.
8. CLIN 0010 has an estimated total quantity of 72.00 HPC SPS Utility Water Retests. From the SOW (see above) will the VA staff collect these retests?
-All retests shall be collected by Contractor. The 72 retests are 2 retests per week for three of the four weeks, needing four good tests in a row to revert to monthly, with the fourth week being part of the regular testing numbers for the month.
9. Box 10 of the SF1449 shows set aside for Small Business. A quick examination of VA contracts database will show that very similar work has been awarded to SDVOSBs that includes more than two qualified SDVOSBs. This requirement should therefore be set aside for SDVOSB as required under law. Does the government intend to correct this error?
-Market Research has been completed and approved. The data supported setting aside the procurement to Open Market Small Businesses. The Contracting Officer does not have a reasonable expectation that two or more verified SDVOSBs will submit offers and that award can be made at a fair and reasonable price that offers best value to the United States.
10. Did the government conduct market research to determine if set-aside for SDVOSB was appropriate? If so, how was this accomplished?
-Market Research was conducted using Vendor Information Pages (VIP), GSA Advantage and Dynamic Small Business Search.
11. Is this a new requirement?
-No
12. If this is not a new requirement, who is the incumbent and what is the contract value?
-Contract 36C25222P0565 was awarded 03/31/2022. Please see FPDS.gov for more information.
