About this file
This is a Solicitation/Contract/Order for Commercial Products and Commercial Services (SF 1449) issued by the Department of Veterans Affairs, Network Contracting Office 10, for blood bank testing reagents.
The solicitation seeks Quidel-Ortho Clinical Diagnostic brand-name blood bank reagents for the Aleda E Lutz VA Medical Center in Saginaw, Michigan. The required products include Selectogen (719610), Coombs Control (719810), Confidence System (6902096), and Affirmagen (719210), each with an estimated annual quantity of 13 units. These reagents are used exclusively for tube testing methodology in pre-transfusion screening and are compatible only with Ortho products obtained through Materials Supplies Department. The Government intends to award a five-year Indefinite Quantity (IDIQ) contract with a performance period from May 1, 2026, through April 30, 2031. Delivery is FOB Destination to the VA Medical Center at 1500 Weiss Street, Saginaw, Michigan, with standing order delivery terms. The acquisition is unrestricted (not set aside for small business), with NAICS code 334516 (Analytical Laboratory Instrument Manufacturing) and a 1,000-employee size standard. Quotes are due by April 14, 2026, at 4:30 PM EDT and must be submitted to Kellie Konopinski, the Contracting Officer, at Kellie.Konopinski@va.gov. The contract will be evaluated on a lowest-price technically acceptable basis, with payments made via electronic funds transfer on a monthly invoice basis. The justification for this brand-name-only procurement documents that switching manufacturers would require extensive validation studies and is infeasible due to resource constraints and the planned Oracle Cerner electronic health record implementation.

SECTION C - CONTRACT CLAUSES
ADDENDUM to FAR 52.212-4 CONTRACT TERMS AND CONDITIONS—COMMERCIAL
PRODUCTS AND COMMERCIAL SERVICES
Clauses that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available.
The following clauses are incorporated into 52.212-4 as an addendum to this contract:
C.1 52.216-18 ORDERING (AUG 2020)
(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from 5/1/2026 through 4/30/2031.
(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c) A delivery order or task order is considered "issued" when—
(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the
Government deposits the order in the mail;
(2) If sent by fax, the Government transmits the order to the Contractor’s fax number; or
(3) If sent electronically, the Government either—
(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or
(ii) Distributes the delivery order or task order via email to the Contractor’s email address.
(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.
(End of Clause)
C.2 52.216-19 ORDER LIMITATIONS (OCT 1995)
(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than TBD, the Government is not obligated to purchase, nor is the
Contractor obligated to furnish, those supplies or services under the contract.
(b) Maximum order. The Contractor is not obligated to honor—
(1) Any order for a single item in excess of TBD;
(2) Any order for a combination of items in excess of TBD; or
(3) A series of orders from the same ordering office within 7 days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section.
(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection
52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.
(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 7 days after issuance, with written notice stating the
Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
(End of Clause)
C.3 52.216-22 INDEFINITE QUANTITY (NOV 2025) (DEVIATION)
(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the
Schedule are estimates only and are not purchased by this contract.
(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum."
(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.
(d) Any order issued during the ordering period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order, which may include order options to be exercised after the ordering period of this contract but before the end of the period of performance of the order. The contract shall govern the Contractor's and
Government's rights and obligations with respect to that order, including options exercised, to the same extent as if the order were completed during the contract's ordering period; provided, that the Contractor shall not be required to make any deliveries under this contract after
4/30/2031.
(End of Clause)

Justification for Single Source Awards IAW RFO 12.102 For
Over Micro-Purchase Threshold but Not Exceeding the Simplified Acquisition Threshold
Acquisition Plan Action ID: 36C250-26-AP-2217
1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 10 located at 24 Frank Lloyd Wright Dr., Suite M2200, Ann Arbor, MI 48105 in support of VISN 10 VA Medical Center at 1500 Weiss Street, Saginaw, MI 48602. 2237: 655-26-3-038-0178.
2. Brief Description of Supplies/ Services required and the intended use/Estimated
Amount: Brand Name Only – Ortho Blood Bank Reagents.
SELECTOGEN (719610) - This is used to screen/detect clinically significant unexpected antibody in patient serum using tube testing.
COOMBS CONTROL (719810) – It is used for the detection of false negative antiglobulin test.
CONFIDENCE (6902096) – A standardized quality assurance system for blood bank reagents used to confirm the reliability of the test system.
AFFIRMAGEN (719210)– It is used to detect expected ABO blood group antibody in patient sample.
Estimated quantity is 13 each per year for all line items.
The proposed contract is an IDIQ with a 5-year ordering period.
POP: 5/1/2026 – 4/30/2031
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Blood Bank Reagents must be the specific brand requested. They are compatible with the Ortho products obtained through Materials Supplies Department (MSD) on an as needed basis (Anti-A, Anti-B, Anti-D, LISS, Albumin and Anti-IgG reagents). The products required in this contract are Affirmagen, OrthoConficence System, Selectogen, and Coombs Control and are only compatible with the Ortho products purchased through MSD. The laboratory cannot use Ortho products with Bio-Rad products or Ortho products with Werfen products. Switching to another manufacture of blood bank reagents would cause the laboratory to perform extensive validation studies using both “original” and “new” reagents, for all blood types, and tubes which would be very costly and laborious. The laboratory does not have the time or the resources to perform these extensive validation studies considering planning, implementation, and execution of the new electronic health record, Oracle Cerner. Therefore, it is imperative to maintain the continuous supply of these specific Ortho-Clinical Diagnostic blood bank reagents.
4. Description of market research conducted and results or statement why it was not conducted:
Searched SBA SBS under NAICS 334516 and SD/VOSB and two results were found.
Searched SBA SBS under NAICS 334516 and keyword reagents and no results were found.
Searched SCMC under part number 719610 and There were several results for Ortho- Clinical Diagnostics, Inc. with RPO Central and east for BPA’s and IDIQ’s. There were a few other results that don’t appear to match the Selectogen so are not relevant. Searched AddsUp under part 719610 and several results were found for selectogen from Ortho- Clinical Diagnostics, Inc. and Garrison Walker Group, Inc. GSA was searched under 719610, Selectogen, and Reagent and no results were found. NAC was searched under 719610 Selectogen and no results were found. NAICS 334516 has a waiver, but not for the items we are procuring. The manufacturer, Ortho-Clinical Diagnostics, Inc., is a large business. They have several distributors; however, they are all large as well. Therefore, the VA Rule of Two and the SBA Rule of Two cannot be met. The procurement will be competed brand name only, unrestricted, open market in accordance with RFO 12 procedures. Award will be to the lowest price technically acceptable.
