About this file

This document is a Question and Answer (Q&A) related to the 10067 Oregon Women's History Project, a request for proposals (RFP) issued by the Oregon Parks and Recreation Department (OPRD). The project is for professional consulting services in the development and implementation of Phases 1 and 2 of the Oregon Women's History Project. The Q&A addresses a question regarding whether a subcontractor who works for a prime contractor that receives the initial award would be excluded from being awarded the next phase of the project. OPRD's response indicates that while they currently do not have funding for Phases 3 and 4, if funding is received, the project documents created from Phases 1 and 2 will be included in the Phase 3 and 4 RFP package. OPRD references the applicable statutes and administrative rules regarding competitive advantage and disqualification of bidders or proposers.

The jurisdictions involved in this opportunity are Marion County and the City of Salem. The project is being funded through state sources, and the applicable procurement statutes and administrative rules are the ORS 279B and OAR 137-047-0560.

OregonBuys S-63400-00007419 10067 Oregon Women's History Project Question and Answer July 12, 2023

OPRD received the following Question:

Question #1:

My question stems from findings in the pre-submittal conference; I do not see this information detailed in the solicitation. My colleague Natalie Perrin attended the pre-submittal conference and learned that the recipient of this award cannot be awarded the next phase. I would like to know if this extends to subcontractors involved in this phase. If a subcontractor works for a prime that receives this award, and the subcontractor receives payment from proceeds of this contract, are they excluded from being awarded the next phase?

Answer #1:

At this time, we do not have funding for Phases 3 and 4 and we would need Phases 1 and 2 completed to begin requesting new grant funds.

If OPRD receives funding for Phase 3 and 4; the project documents created from Phases 1 and 2 will be included in the Phase 3 and 4 RFP package.

Statutes and Rules References:

The 279B Statute apply to this services RFP and OPRD has adopted DOJ Model Rules 137 according to OAR 736-001-0005. When considering competitive advantage, this is the Statute and Rule I would follow.

Oregon Revised Statute:

ORS 279B.040 - Prohibition on accepting bid or proposal from contractor that advised or assisted contracting agency to develop specifications or solicitation documents (public.law) Oregon Administrative Rule:

OAR 137-047-0560 - Personal Services Contract to Provide Specifications — State Agency Disqualification as Bidder or Proposer — Oregon Administrative Rules (public.law)
