About this file
This is a Justification and Approval (J&A) document for use of other than full and open competition (sole source award) issued by the Department of the Navy, Naval Sea Systems Command, Puget Sound Naval Shipyard and Intermediate Maintenance Facility (PSNS & IMF), Everett Detachment. The document justifies the award of two Out of Scope Work Specifications as a contract modification to existing contract N4523A26F0501, awarded to Delphinus Engineering, Inc. on November 18, 2025, for the USS BENFOLD 6A1 Continuous Maintenance Availability.
The required services involve performing a chelate flush and refill of the cooling skid, cabinets, associated piping, and valves on the ship's SPY equipment cooling system, as specified in Request for Contract Change (RCC) 6N and 7N. All work must be completed at Naval Station Everett before the availability's completion date. The Navy invokes 10 U.S.C. 3204(a)(2) and FAR 6.302-2 (unusual and compelling urgency) as the statutory authority for sole source justification. The rationale centers on mission-critical urgency: during homeport in Japan, welding on the cooling piping system was performed without required flushing, causing high cooling water temperatures and low flow rates that jeopardize the SPY-1D RADAR system—the primary radar system for all warfare areas and a one-of-one system critical to the aircraft carrier strike group. Failure to remediate could result in catastrophic radar system failure, significant repair costs, and extended ship docking. The Contracting Officer determined costs to be fair and reasonable in accordance with FAR 15.404-1 and will review a technical advisory report for acceptability. The funding source is FY26 OPN funds. No additional market research was conducted due to the urgent nature precluding competitive solicitation.

DEPARTMENT OF THE NAVY
PUGET SOUND NAVAL SHIPYARD
AND INTERMEDIATE MAINTENANCE FACILITY
1400 FARRAGUT AVENUE STOP 2090
BREMERTON WASHINGTON 98314-2090 IN REPLY REFER TO:
J&A No. 26-06JA
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
The Naval Sea Systems Command, Puget Sound Naval Shipyard and Intermediate Maintenance Facility (PSNS & IMF), Everett Detachment, Contracts Division Code 451.
2. Description of the Action Being Approved.
Award of a contract action on a sole source basis for the addition of two Out of Scope Work Specifications to contract N4523A26F0501, awarded to Delphinus Engineering, Inc. on 18 November 2025 for the USS BENFOLD 6A1 Continuous Maintenance Availability. All work must be accomplished at Naval Station Everett before the availability's completion date of
3. Description of Supplies/Services.
Provide all services required to perform chelate flush and refill cooling skid, cabinets and associated piping and valves on ships spy equipment cooling system as required per Request for Contract Change (RCC) 6N and 7N. The Independent Government Estimate is utilizing FY26 OPN funds.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 3204(a) (2); FAR 6.302-2, Unusual and compelling urgency; The supplies or services are of such unusual and compelling urgency which the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals and waive the solicitation period. Urgent requirements are supplies or services that are mission critical and the routine processing time would result in injury to the Government.
5. Rationale Justifying Use of Cited Statutory Authority.
The US Navy has an urgent and compelling need to perform chelate flush and refill cooling skid, cabinets and associated piping
J&A No. 26-06JA and valves on ships spy equipment cooling system. While ship was homeported in Japan, the system had welding performed on the cooling piping system and failed to conduct required flushing of the system. Consequently, the cooling system is now experiencing high cooling water temperatures, and low cooling water flow. The SPY-1D RADAR is the primary RADAR system for every warfare area, launching missiles, firing guns, and providing protection to the aircraft carrier in a Strike Group. It is a 1 of 1 system.
Debris free cooling water is critical to keeping all the RADAR components cooled from overheating. Without clean cooling water, equipment valves clog which causes insufficient cooling water throughout the many cabinets and consoles. Insufficient cooling water leads to overheating of vital parts that causes a catastrophic failure of the RADAR system. A failure of this magnitude could result in repair costs of and a ship being docked for as seen with similar DDGs being repaired.
To meet DDG fleet mission requirements, this work must be executed during the current USS BENFOLD 6A1 Continuous Maintenance Availability from
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Contract N4523A26F0501 was initially solicited as a competitive delivery order under NAVSEA IDIQ-MAC utilizing FAR Part 16.5 procedures. No additional market research was conducted because it is not practicable due to the urgent nature of this requirement discussed in paragraph 5 above, for any company other than Delphinus Engineering, Inc. to provide the required supplies and services.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable. Contracting Officer anticipates the costs to be fair and reasonable and will request and review a technical advisory report to assess the technical acceptability of the proposed amounts. The Contracting Officer has determined the price fair and reasonableness in accordance with FAR 15.404-1.
J&A No. 26-06JA
8. Actions to Remove Barriers to Future Competition.
The Navy will continue to conduct competitive acquisitions for future maintenance requirements to the maximum extent possible.
The workload forecast for FY26 for Navy West Coast is robust and continues to grow. The Navy is committed to performing market research while monitoring and evaluating the ship repair industrial base and providing fair opportunity to all capable contractors.
