About this file
This is a Sole-Source Determination and Justification document issued by the Oregon Department of the State Fire Marshal's Designated Procurement Officer, Philip Hofmann, dated September 21, 2026. The department intends to contract with AP Triton to complete a Standards of Coverage analysis and report for the agency's Regional Hazardous Materials Emergency Response Teams (RHMERTs). The analysis will evaluate whether Oregon's statewide hazardous materials response system possesses adequate resources, partnerships, and deployment strategies to effectively respond to hazardous materials emergencies while protecting people, property, and the environment. The scope of work includes reviewing the distribution and concentration of fixed and mobile resources, assessing whether RHMERTs are properly trained, funded, and equipped, evaluating current response performance in mitigating emergencies, and providing recommendations to improve performance with established benchmarks for success. The contract proposal due date is October 12, 2026.
The estimated total contract value is $100,000.00. The Department of the State Fire Marshal justified the sole-source procurement determination under Oregon Administrative Rule 125-247-0275(2)(a) based on compatibility requirements, finding that AP Triton is the only source capable of providing compatible services. The justification notes that AP Triton possesses unmatched expertise in conducting Standards of Coverage analyses and extensive knowledge of the Oregon fire service, with proprietary methodologies, GIS modeling platforms, and hazard-specific risk analysis tools that align with the agency's existing systems. The agency previously conducted an Intermediate Solicitation from June through July 2026 that yielded no offers, supporting the determination that the experience necessary to conduct the analysis is limited to AP Triton.

Re: Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275
Part A
1. Authority to enter into a Sole-Source Contract: OAR 125-246-0170(2)(c)(H)
2. Estimated Total Value of Contract: $100,000.00
3. Subject of Contract: Standard of Coverage Report for Regional Hazardous Materials Teams
4. Background:
It is the Department of the State Fire Marshal’s (“Agency”) intent to enter in a contract with AP Triton to complete a Standards of Coverage (“SoC”) analysis to support the operations of the Agency’s Emergency Response Division (“ERD”) The purpose of the SoC analysis and report for the Agency’s Regional Hazardous Materials Emergency Response Teams (“RHMERT”) is to review and evaluate if the established statewide hazardous materials response system has the appropriate resources, partnerships, and deployment strategies to effectively respond to hazardous materials emergencies in order to protect people, property, and the environment. The analysis will help to determine the distribution and concentration of fixed and mobile resources, and to evaluate if the RHMERTs are properly trained, funded and equipped to respond to hazardous materials incidents. The analysis must also review the current response and performance of the RHMERTs in mitigating emergencies. The report must provide recommendations to improve performance and set benchmarks for success, by establishing clear policies and procedures, and clarify the level of risk that the community is willing to accept and ensure that the fire department can deliver the necessary services to protect people, property, and the environment.
The Agency has determined that it is in the best interest of the state of Oregon to enter into a contract with the AP Triton to complete the SoC analysis due to the AP Triton’s unmatched expertise and knowledge of both completing SoC analyses and the Oregon fire service. That expertise and knowledge will not only allow for a more detailed and accurate SoC analysis but also will increase buy-in from fire agencies across the state of Oregon.
5. Findings:
A. Market Research Overall Finding.
The Agency conducted market research by first reviewing the past SoC analysis completed in 2006, in order to determine the qualifications that a potential contractor would need to meet in order to provide a SoC analysis that would meet the Agency’s needs. In addition to determining the qualifications that a potential contractor must meet, the Agency determined that familiarity with the Oregon fire service was critical in order for fire agencies across Oregon to find the report credible.
The Agency also conducted an Intermediate Solicitation, solicitation number S-26000-00015785, which was conducted from the end of June 2026 through the end of July 2026. There were no Offers submitted in response the that Intermediate Solicitation. After the solicitation’s Opening Date, it was determined that the nature of the experience needed to conduct a SoC analysis for the Agency’s RHMERTs is limited to AP Triton – who the Agency intends to enter into a contract with for the SoC analysis.
And
B. Findings of Fact pursuant to OAR 125-247-0275(2) must include, at a minimum, one of the following:
1. Pursuant to OAR 125-247-0275(2)(a): Compatibility. Provide findings supporting your determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source.
The SoC analysis requires a Contractor with extensive experience conducting SoC analyses specifically for fire and hazardous materials response agencies. AP Triton is one of the few firms nationally recognized for developing SoC analyses integrating fire, EMS, and hazardous materials response systems. AP Triton uses proprietary methodologies, GIS modeling platforms, hazard‑specific risk analysis tools, and scenario modeling workflows that align with the Agency’s existing systems.
AP Triton’s prior work and established systems provide direct methodological compatibility with Oregon’s RHMERT program, minimizing integration barriers and ensuring continuity across risk assessment, gap analysis, modeling, stakeholder validation, and final report production.
Based on the requirements of OAR 125‑247‑0275(2)(a), the Agency’s operational needs, and the specific compatibility required to utilize existing systems and data efficiently, the Agency determines that AP Triton is the only source capable of providing the compatible services necessary for the RHMERT Standards of Coverage project.
The efficient utilization of the Agency’s existing hazardous materials response systems, datasets, operational methodologies, and statewide coverage framework requires acquisition of compatible services available only from AP Triton. A sole‑source procurement is therefore justified under OAR 125‑247‑0275(2)(a).
