About this file

This is a Required Federal Provisions document for Bid S-21-26 related to the Cheyenne Transit Facility Interior and Exterior Renovations and Upgrades project in Wyoming, incorporating FTA Master Agreement version 34 requirements and applicable federal regulations. The document outlines mandatory federal compliance clauses that will be incorporated by reference into the construction contract, establishing the regulatory framework that all contractors must adhere to throughout project execution. The bid is subject to FTA financial assistance, which triggers numerous federal requirements including civil rights compliance, prevailing wage standards, and domestic preference provisions.

The document mandates contractor compliance with multiple federal acts and regulations including the Davis-Bacon Act for prevailing wages applicable to construction contracts exceeding $2,000, the Copeland Anti-Kickback Act, Contract Work Hours and Safety Standards Act, Clean Air and Water Acts for contracts exceeding $150,000, and the Build America, Buy America Act for domestic preferences. Contractors must certify the absence of unpaid federal tax liability, recent felony convictions within 24 months, and suspension or debarment status. Additional requirements include compliance with seat belt use and distracted driving policies, access to records and audits by FTA and DOT officials, compliance with debarment exclusions in the System for Award Management, and filing of Byrd Anti-Lobbying Amendment certifications for awards exceeding $100,000. The awarded contractor must pay all laborers in accordance with the most recent Wage Determination for Laramie County, Wyoming, with wage rates determined by the Department of Labor based on applicable building, highway, or heavy construction classifications. The city retains termination-for-convenience rights with 30 days' written notice and will compensate contractors for accepted work and expenses incurred through the termination date.
