About this file

Summary

This is a Sole Source Determination Memo issued by the Oregon Department of Human Services (ODHS), Office of Contracts and Procurement, dated August 19, 2026. The memo documents a sole source justification (S-10000-00017770) for continuing federally required Family First Prevention Services Act (FFPSA) evaluation and reporting services through the Office of Child Welfare Programs. The services to be provided include comprehensive evaluation planning and continuous quality improvement (CQI) support, fidelity monitoring and technical assistance for evidence-based practice providers, access and utilization analyses, outcomes and cost-benefit evaluations, completion and maintenance of the FFPSA evaluation data system, and rigorous evaluation design and implementation for KEEP and Triple P parenting programs. The contract extends the original contract period (181937, awarded in 2024 from RFP 5538) by one year, with a new end date of June 30, 2029, to align with Oregon's biennial legislative budgetary periods.

The estimated total contract value for three years is $3,670,953.08, with ICF Incorporated, L.L.C. identified as the sole source contractor. The justification for sole sourcing is based on ICF's two-year development of Oregon's FFPSA infrastructure, including the Provider Registry, data-sharing agreements, fidelity systems, and a custom multiform data system. Transitioning to another vendor would cause significant disruption, delay federal compliance, jeopardize Oregon's Title IV-E funding eligibility, and require rebuilding all foundational components at substantial cost. ICF maintains approved access to ORKIDS Family First data sets and established data pathways necessary for FFPSA evaluation tasks. Protests must be submitted within seven calendar days after the notice is posted on OregonBuys.

SOLE-SOURCE DETERMINATION MEMO

FOR SUPPLIES AND SERVICES

Date: August 19, 2026 Sole source number: S-10000-00017770

To: Kirk N. Rhoades, Designated Procurement Officer (“DPO”) ODHS/OHA Office of Contracts & Procurement

Requestor: Mary Geelan, Family First & Integrated Policy Manager Agency/division: Office of Child Welfare Programs (“Agency”) Program/office: Family First Program Contract specialist: Louie Thomas, ODHS OCP

Agency Sole source rule: Sole source authority:

ODHS OAR 125-247-0275 • OAR 125-246-0170(2)

• DAS Delegation ODHS Tiered, as amended

Estimated total contract value: $3,670,953.08 (budget for three total years)

Description of goods or services: Continuing to provide federally required Family First Evaluation and Reporting Services.

1. Background: This sole source justification applies to the purchase of:

a) Provide a brief description of the contract or contracts to be covered including contemplated future purchases

The original contract for this work, 181937, awarded in 2024 from RFP 5538 (S-10000-00004600), engaged the Contractor, ICF Incorporated, L.L.C. (“ICF”), to design and implement Oregon’s initial Family First Prevention Services Act (“FFPSA”) evaluation plan, build the required Provider Registry, establish data‑sharing agreements, track access, fidelity, outcomes, and complete required quarterly and semi‑annual FFPSA reports.

This notice of sole source continues that work, and extends the Contract period by one year from its original end date to June 30, 2029 to align the budget and provisions of services to biennial legislative budgetary periods.

The extension will continue expansion of the existing infrastructure by completing the rigorous evaluations for KEEP and Triple P, both evidence-based parenting programs, to finish and maintain the FFPSA data system, continue statewide fidelity and equity analyses, and completing and delivering all required federal evaluation and reporting tasks.

Contemplated future purchases, if any, will be related to unexpected or unanticipated costs for services associated with the Work of the current project began by the previous contract.

b) Describe the product or service to be purchased

The resulting Contract from this notice of sole source continues providing specialized FFPSA evaluation and reporting services, including:

1) Comprehensive evaluation planning and CQI support;

2) Fidelity monitoring and technical assistance for all EBP providers;

3) Access, utilization, and equity analyses across all FFPSA services;

4) Service‑level outcomes, family wellbeing outcomes, cost analyses, and cost‑benefit evaluations;

5) Completion, hosting, and maintenance of the FFPSA evaluation data system ICF is already building;

6) Rigorous evaluation design and implementation for KEEP and Triple P as required by federal FFPSA rules.

These services are federally required for Oregon to maintain compliance and Title IV‑E funding eligibility.

c) Describe the reasons the agency is seeking this procurement method

Since the RFP award, ICF has built Oregon’s FFPSA infrastructure – including the Provider Registry, data agreements, fidelity systems, reporting templates, CQI structures, and the custom multi‑form data system currently under development. No other vendor has access to or familiarity with these systems.

ICF was selected at the top-ranker proposer and awarded the Work under RFP 5538, and contract 181937 was executed in March 2024. The

6304-0 v3 / l.thomas Page 3 of 5 first Oregon FFPSA Plan had been approved, and the RFP and Contract were written from a novice perspective and for limited time. As the project and its requirements were developed and implemented, it was expected that the project would become more complex as the project matured. Re-posting the Work resolves any potential issues with appearances of “scope-creep,” and it allows us to extend the original project for an additional year to align with Oregon’s biennial budgetary periods.

Agency reserves the right to purchase additional goods and services related to unexpected or unanticipated costs, if any, associated with the Work of the current Contract, including for unexpected FFPSA evaluation services costs, unforeseen continuous quality improvement support issues, possible data system hosting/maintenance issues, quarterly and semi‑annual federal reporting support, or costs associated with the rigorous study completion required by federal FFPSA requirements.

3. Written findings of fact (market research):

6304-0 v3 / l.thomas Page 4 of 5

The findings below must include factual information supporting the determination that meet the sole source requirement in statute.

Pursuant to ORS 279B.075, Agency must conduct market research that supports the assertion that there is only one source that can provide the goods or services.

Market research includes utilization of the internet, trade journals, agency vendor lists, professional organizations, studies, catalogs/industrial periodicals, vendor sources, yellow pages, etc.

Agency must select at least one of the findings and prepare the determination as it specifically relates to the good or service being procured. More than one finding can be addressed. The findings are as follows:

Pursuant to ORS 279B.075 (2)(c): Provide findings supporting the determination that the goods or services are for use in a pilot or an experimental project.

This project is the initial implementation of new federal policy relating to the delivery of Child Welfare services in Oregon, as described more fully in RFP 5538 (S-10000-00004600) “Family First Prevention Services Act (‘FFPSA’) Evaluation and Reporting Services.”

and

Pursuant to ORS 279B.075 (2)(d): Any other findings that support the conclusion that the goods or services are available from only one source.

Contractor was selected by solicitation to provide these services “for additional periods of time up to a total Contract period ending on June 30, 2028” [181937-0 Ex. A, Pt 3, sec 2 (a)(1)]. The purpose of this Sole Source is to extend the Contract end date to June 30, 2029, to align the budgeting and Work to Oregon legislative sessions; and to somewhat refine the original statement of work.

For the additional year, ICF is the only vendor that would be able to continue Oregon’s FFPSA evaluation without causing major disruption because:

• ICF spent two years building Oregon’s FFPSA infrastructure—including the Provider Registry, data agreements, fidelity systems, reporting

6304-0 v3 / l.thomas Page 5 of 5 templates, CQI structures, and the custom multi‑form data system currently under development. No other vendor has access to or familiarity with these systems.

• Transitioning to a new Contractor would set Oregon back at least two years, as a new vendor would need to rebuild the entire evaluation structure, renegotiate data sharing agreements, reconstruct the data system, and recreate all baselines required for rigorous evaluations. This would jeopardize federal compliance and delay required evaluations.

• FFPSA requires continuity in rigorous evaluation, CQI cycles, fidelity monitoring, and semi‑annual reporting—ICF is already performing these and has built the historical datasets and processes necessary to meet federal requirements. Disruption would risk Oregon’s ability to claim Title IV‑E funds.

• ICF is the only vendor with approved access to OR‑KIDS Family First specific data sets and all associated data pathways necessary to carry out FFPSA evaluation tasks, established under the original contract. A new vendor would require lengthy onboarding, background checks, and system approval processes that would halt evaluation work.

• The tasks within the new Contract rely entirely on infrastructure, tools, data systems, and methodologies already created by ICF. Bringing in another vendor would require re‑building all foundational components at significant cost and time.
