About this file

This is a Sole-Source Determination Memo issued by the Oregon Department of Human Services (ODHS), Office of Contracts & Procurement, dated May 10, 2023, for a Temporary Lodging Prevention Pilot Program. The program will provide Direct Support Professional (DSP) services exclusively to ODHS individuals with Intellectual and Developmental Disabilities (I/DD) who are under 18 years of age and at risk of temporary lodging due to staffing challenges. The contractor will maintain a minimum of seven DSP staff available within 24 hours' notice to serve Multnomah, Washington, Clackamas Counties, and other locations as identified by ODHS. DSP staff must meet specific training requirements including Oregon Intervention System (OIS) Level C and Level G, trauma-informed care, ODDS Core Competencies, and HIPAA compliance, and must pass criminal background checks and drug testing. The contract is expected to last less than two years as a pilot project, with an RFP anticipated within six to twelve months for a future permanent Temporary Lodging Prevention Project contract.

The estimated total contract value is $500,000.00, with HDE Home Care LLC identified as the sole-source contractor based on its existing COVID-era contract expiring June 30, 2023. The sole-source justification is grounded in ORS 279B.075(2)(c), citing the goods and services required for use in a pilot or experimental project, as well as the need to maintain continuity of established resources and prevent service gaps in response to a 2018 settlement agreement requiring ODHS to limit temporary lodging for foster children and young adults. The agency determined that HDE's existing infrastructure, trained staff, and operational experience made it the only source capable of providing immediate services without interruption. Protests to the sole-source determination are due within seven calendar days of the notice posting on OregonBuys. No specific funding sources or budget allocations are detailed in the memorandum beyond the total contract value.

Estimated total contract value: $500,000.00

Description of goods or services: Temporary Lodging Prevention Pilot Program -

Direct Support Professionals (“DSP”), dedicated specifically to work exclusively with

ODHS Individuals, to provide immediate services to I/DD Individuals who are under 18 years of age and at risk of not receiving services due to staffing challenges and whose parents are unable to identify staff to safely support them.

1. Background: This sole source justification applies to the purchase of:

a) Provide a brief description of the contract or contracts to be covered including contemplated future purchases.

The Oregon Department of Human Services (ODHS) is working to reduce the number of children and young adults experiencing Temporary Lodging in hotels and similar settings due to lack of available, appropriate Child Welfare placements. In 2016, Youth, Rights & Justice and CASA of Multnomah County filed a lawsuit against OHDS. In February 2018, ODHS entered into a settlement agreement to resolve the lawsuit. The parties, through the settlement agreement, intend to ensure that all foster children and young adults in Oregon are placed appropriately, and limit the number and duration of occasions of Temporary

Lodging.

This Temporary Lodging Prevention Pilot Program is in direct response to this settlement by limiting the occasions of Temporary Lodging. This contract will provide immediate, Direct Support Professional (DSP) services to Intellectual and or Developmental Disabilities (I/DD) Individuals who are under 18 years of age whose behavior has resulted in the inability to remain stable with their family and at risk of houselessness if additional direct services are not provided. This contract may also aid I/DD youth in being able to leave emergency rooms and return with family if DSP services are provided. Currently these situations are resulting in unnecessarily involvement with the ODHS Child Welfare and hotel stays with Child Welfare staff. These situations are unnecessarily involving Child

Welfare due to the inability of families to keep youth safely in their homes without the additional direct services.

The goal is to maintain continuity of services previously provided through a

COVID program that is similar and meeting many of these goals that is expiring while ODDS establishes a new Temporary Lodging Prevention program to mitigate children moving into Child Welfare for Temporary Lodging.

b) Describe the product or service to be purchased

Contractor to provide on-call services dedicated specifically to work exclusively with ODHS Individuals, to provide immediate services to I/DD Individuals who are under 18 years of age and at risk of not receiving services due to staffing challenges and whose parents are unable to identify staff to safely support them.

Contractor will maintain a minimum of seven DSP staff that meet the following training requirements: Oregon Intervention System (OIS) Level C and Level G, trauma informed care, ODDS Core Competencies, and HIPAA. They shall have passed criminal background checks and agree to drug testing as requested by

ODDS. DSP staff shall be available to work within 24 hours’ notice and travel to

Multnomah, Washington, Clackamas Counties and other locations as identified by ODDS in emergent situations.

c) Describe the reasons the agency is seeking this procurement method.

During COVID, ODDS contracted with HDE to provide DSP services to youth with

I/DD, which expires June 30, 2023. This contract provided experienced, on-call, immediate DSP staff to support I/DD with the added benefit of I/DD remaining in their homes simultaneously mitigating the need for Temporary Lodging. Because it is imperative that the established resources remain intact to continue to limit

Temporary Lodging for youth as mandated in the settlement, this Pilot Program will be administered to recreate a similar program and ensure there is not a gap in DSP services. This Temporary Lodging Prevention Pilot Project will fill this immediate need, using resources that are currently in place, and allow time for implementation and fine tuning to confirm the program is of the highest value to our clients, ODHS and ODDS. This pilot project is expected to last less than two years and will be used to develop an RFP within the next six to twelve months to solicit for a future Temporary Lodging Prevention Project contract.
