MANDATORY MINIMUM QUALIFICATIONS CERTIFICATION

There are certain mandatory minimum qualifications which offerors must meet in order to be invited to submit proposals and be considered for award of the proposed contract. Offerors are required to submit detailed supporting documentation to substantiate meeting all mandatory minimum qualification requirements. Offerors that provide only engineering with construction management services and plan to subcontract all the construction work separately will not be considered for this project. However, it is otherwise acceptable for entities to utilize teams and/or alliances for this proposal as long as the minimum qualification requirements were collectively satisfied by these team/alliance members. If teams/alliances are used to satisfy Requirement 1 below, each and every team/alliance member must have contributed. The remaining minimum qualification requirements must be satisfied by each individual entity. The minimum qualification requirements are as follows:

MINIMUM QUALIFICATION REQUIREMENTS
MEETS

REQUIREMENTS?

YES/NO

1. Offerors must have successfully provided engineering, procurement, and construction, including startup and commissioning (full EPC plus startup and commissioning) for at least two (2) Pulse Jet Fabric Filter (PJFF) retrofits. These retrofits must have been on pre-existing large coal fired utility boilers of at least 200 MW’s, operated inside the United States. Only PJFF retrofits that have been fully commissioned shall be submitted and at least one (1) of these retrofits shall have been in operation for at least one (1) year. Additionally, this PJFF retrofit project must have met the original (pre-construction) scheduled in service date (unless reasonably explained otherwise) and must have been no more than 3% over the original project budget.

2. Offeror must have the financial capacity (creditworthiness) to guarantee the timely performance, obligations, duties and responsibilities under or related to the contract (including performance and warranty issues), for the term of the contract. (Required information shown below)

3. Offeror must have an established, overall, formalized Total Quality Program (TQP). This TQP must be demonstrated by providing the table of contents of the TQP.

4. Offeror must be willing to become signatory to TVA’s project labor agreement (PMMA).

5. Offeror must have an acceptable safety program with demonstrated ability to assign on-site safety professionals. As verification of such, the Offeror must meet at least one (1) of the following two (2) safety requirements:

A. The Recordable Injury Rate shall be less than 0.85 average for the minimum of two (2) PJFF projects described above in Item 1, and a Lost Time Injury Rate of less than 0.2 average for those same projects. The Offeror shall submit the safety records for the two qualifying projects to verify that the Offeror meets the safety criteria above.

B. The Recordable Injury Rate for the Offeror, or each individual entity if applicable, shall be less than 0.85 average for the Offeror’s entire safety program over the last 3 years. Likewise, the Lost Time Injury Rate shall be less than 0.2 average for the last 3 years. The Offeror, or each individual entity if applicable, shall submit their overall safety records for the last 3 years to verify that the Offeror meets the safety criteria above.

The Offeror only needs to meet the criteria of either A or B above and should only submit the safety records verifying one or the other, not both. Offeror shall state which part (A or B) that they are confirming that they meet.

Note: Other than the mandatory minimum qualifications required for construction and startup of at least two (2) PJFF projects, if the offeror believes a valid exception to any of the other mandatory minimum requirements exists, please submit the certification with a detailed explanation of the exception. TVA will review the exception and make a determination of its acceptability. No challenges will be accepted to TVA’s decision.

Information required to be submitted in item 2 above regarding financial capacity:

· Audited financial statements for the last three (3) preceding years that include balance sheets, income statements, statements of cash flows and notes to the financial statements, or an annual report on Form 10-K for the last three (3) preceding years.

· Interim financial statements for the most recent fiscal period or quarterly financial statements on Form 10-Q for the most recent fiscal period.

· Bank name, address, phone number and officer contact.

· Credit references from three (3) sources that include name, address, phone number and contact.

· Complete legal name of the company and the State of Incorporation.

· Company ownership schedule if privately held.

Offeror certifies by signing below that it meets all of the mandatory minimum qualification requirements, including, but not limited to, the required in services dates, etc., listed herein.
