LIMITED-SOURCES JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Shipbuilding Division Contracts Division SEA 022.
2. Description of the Action Being Approved
Award of a contract on a sole source basis for the purchase of six (6) Riverine Patrol Boats (RPB) for the Government of Philippines, along with six (6) Ultra High Frequency (UHF) Radios, spares, and reactivation/training to Silver Ships, Inc. (Silver Ships) 9243 Bellingrath Rd, Theodore, AL, 36582-2710.
3. Description of Supplies/Services
The proposed acquisition is for the procurement of the detail design, construction, and documentation of six (6) RPBs, along with six (6) UHF Radios, spares, and reactivation/training, from Silver Ships as identified in Federal Supply Schedules (GSA) 47QSWA18D009G, to support the Philippine Marine Corps (PMC). The boats delivered under this action will be nearly identical to the boats delivered to PMC under Contract N00024-11-F-2234;
however, the configuration will incorporate changes that address obsolescence issues allowing for current technologies to be included.
This program is in support of Section 333 Building Partner Capacity (BPC) under the provisions of the FY 2017 NDAA to expand the Global Train and Equip (Section 1206 of the FY 2006 NDAA) scope for building the capacity of foreign national security forces to conduct Maritime and border security operations. The RPBs will expand the existing PMC RPB fleet and provide more mobility for the PMC Special Forces and battalion landing teams to operate throughout
Estimated completion date for all six (6) boats is anticipated to occur
. The RPB reactivation and training will take place
The warranty period will end
The Government’s minimum needs have been verified by the certifying technical and requirements personnel. The procurement will be funded with FY 2020 BPC funds under Title 10 U.S.C. Sec 333 via . The total estimated dollar value of this procurement is approximately $ , and PMS 325F has established a funding line as shown in the table below:
Estimated Dollar Value

4. Authority and Supporting Rationale Permitting Limited Source
Per Federal Acquisition Regulation (FAR) Part 8, agencies are required to satisfy requirements for supplies through GSA as a priority over using commercial sources in the open market.
Under FAR 8.405-6(a)(1)(i)(C) the new work is a logical follow-on to an original GSA Delivery Order Number N00024- 11-F-2234. The original order must have been awarded competitively in accordance with the applicable GSA ordering procedures.
Silver Ships was originally awarded the RPBs based on a competitive, small business set-aside, order under FAR 8.405-5, and is currently the only company that offers this unique variant of the RPB. In order to ensure commonality in the fleet, and to reduce the logistical, operational, and maintenance requirements on the PMC, it is requested that the PMC be provided the same boats from the same manufacturer and with the same specifications as the six (6) RPBs they received via the FY 2011 1206 .
In the interest of economy and efficiency, it is in the best interest of the Government to award a sole source procurement to Silver Ships for six (6) RPBs, six (6) UHF Radios, spares, and reactivation /training on a follow-on order under the authority of the Multiple-Award Schedule Program.
5. Determination of Best Value
The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the Limited-Sources Justification will represent the best value to the Government. Although GSA has already negotiated pricing, the Contracting Officer will seek additional discounts before placing an order. The Independent Government Estimate (IGE) was developed by PMS 325 and the Contracting Officer will utilize pricing data submitted by Silver Ships along with historical information to determine a fair and reasonable price.
6. Description of Market Research Conducted Among Schedule Holders
The Request for Quote (RFQ) for the previous RPB under contract N0024-11-F-2234 was issued via GSA and awarded to Silver Ships on 29 September 2011. Request for Information (RFI) N00024-20-R-2204 was posted on beta.sam on 17 January 2020 to gather information from industry on what boats are available to meet the requirements. Seven (7) responses were received with the majority of responses stating that they could meet the requirements of the RFI. Market research resulted in increased awareness that purchasing an RPB from other than Silver Ships would result in introducing a new variant of RPBs into the existing PMC fleet. Therefore, no further market research among schedule holders was conducted.
7. Facts Supporting the Justification
The six (6) RPBs PMC received under Delivery Order Number N00024-11-F-2234 remain in-service and this requirement for additional RPBs is intended to double the size of the current PMC RPB fleet.
The operational capability and effectiveness of the PMC would be greatly jeopardized if they did not receive (to the maximum extent possible) the exact same boats and were forced to operate, maintain, and be trained on a mixed fleet of RPBs. Support equipment, such as computer diagnostic tools and filters, must remain interchangeable, and a bench stock of spare parts for the Silver Ships RPBs already exists.
Compromise of product standardization would result in increased cost to the PMC due to the need for duplication of training and maintenance that would occur in a mixed fleet.
Interoperability within the RPB fleet is necessary to enable the PMC to execute missions with tactics, techniques and procedures that are already established. Jeopardizing the operational capability and effectiveness of the PMC would have an adverse effect on the U.S. national security objectives both globally and within the U.S. Philippine Command’s area of responsibility.
Furthermore, procuring these RPBs from other than Silver Ships would result in additional Government resources for source selection review, additional construction support for potentially a new builder and a new logistics package resulting in additional cost and delays.
8. Actions to Remove Barriers to Restricted Consideration
For the reasons set forth in Paragraph 7, NAVSEA has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVSEA will assess whether competition for future requirements is feasible.
