Sole Source Justification for Simplified Acquisitions exceeding the SAT including brand name Rev. 4/2022 SSJ No.: FY25-00243 2 by employing Technical Surveillance Countermeasures (TCSM) equipment to ensure the integrity of the occupied space and DHS information. OCSO employs a wide variety of technologies and techniques to protect classified national security information, restricted data, and/or sensitive but unclassified information including the use of spectrum analyzers. These devices must have the capability of a fully integrated auto-switching antenna panel that continuously sweeps 10kHz – 43 GHz at 1100GHz/sec. The analyzer must be able to detect various frequencies including persistence, spectrogram, Bluetooth device detection, smart bars, discrete bands, I&Q Data Recording, and a multi-purpose probe that includes carrier-current, infra-red, visible light and ultrasonic detection. The devices must also provide a raster waterfall that can identify what time and location on the spectrum when anomalies occurred. The TOB intends to utilize the OSCOR Max spectrum analyzer equipment for these purposes. These devices will replace similar equipment previously procured in 2014 against contract HSHQDC-14-P-00150. The ability to sweep frequencies up to 43 GHz exponentially enhances the detection capabilities.

4. Identification of the authority.

This action is being taken in accordance with 41 U.S.C 1901, as implemented by FAR subpart FAR Subpart 13.5. Simplified Procedures for Certain Commercial Products and Commercial Services.

5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

TOB is responsible for providing technical threat detection and mitigation for the S1 and S2. Additionally, the TOB must be able to provide technical surveillance capabilities to DHS law enforcement elements and employ a wide variety of technologies and techniques to protect classified national security information, restricted data, and/or sensitive but unclassified information. To enhance TOB’s information security capabilities, the TOB requires a portable system for rapid deployment of a spectrum analyzer designed to detect unauthorized frequencies to safeguard temporary meeting spaces. Specifically, the spectrum analyzer must protect the integrity of T-SCIFs during S1/S2 official travel, ensure the integrity and protection of S1’s and S2’s room during official travel, and be able to conduct hardened SCIF investigations and in-conference monitoring to safeguard temporary and routine meetings while both on travel and at Headquarters.

As soon as new advancements in technology present themselves, our old equipment becomes obsolete. For instance, the 43GHz range makes our 24GHz range obsolete since we will now be blind from 24-43GHz if we don’t upgrade our countermeasures equipment. Furthermore, the 10lb weight restriction is a requirement for travel. We have our team kits pinned at 66-70lbs. Our cases are measured and weighed so we can take them on commercial and international travel. Any change in weight for travel equipment would

Sole Source Justification for Simplified Acquisitions exceeding the SAT including brand name Rev. 4/2022 SSJ No.: FY25-00243 3 affect the entire kit and throw our weights off. This can impact travel due to foreign travel embargos and restrictions on overweight luggage.

Market research determined that that there are no spectrum analyzer systems, other than the OSCOR Max, that will provide the required detection capability to ensure all S1 and S2 travel is secured as well as the TOB travel kits are complete and compatible for combined system operations and meet the essential characteristics required of the equipment by TOB as stated above and in section 3 of this document. TOB is required to provide support to Executive Communications and both S1 and S2 during official travel. These systems are both necessary and required to accomplish TOB’s S1/S2 travel mission.

The OSCOR Blue equipment procured under HSHQDC-14-P-00150 are now obsolete due to evolving technologies and surveillance measures, are at the end of their life cycle, and have been unreliable due to operational wear and repair requirements. The OSCOR Max is REI, LLC’s replacement for the OSCOR Blue.

The OSCOR Max spectrum analyzer meets TOB’s minimum essential requirements. It offers a fully integrated auto-switching antenna panel that continuously sweeps 10kHz – 43 GHz at 1100GHz/sec. The OSCOR Max includes the detection of frequencies including persistence (previous and current frequency peak intensity identification), spectrogram (display the frequency content of a signal over time), Bluetooth device detection, smart bars and discrete bands (frequency management and resource allocation in RF communication systems), I&Q Data Recording (for bandwidth-efficient signal capture and processing by shifting signals), and a multi-purpose probe (programmable and configurable) that includes carrier-current, infra-red, visible light and ultrasonic detection. This analyzer provides a raster waterfall that can identify what time and location on the spectrum when anomalies occurred. Additionally, the OSCOR Max weighs 10.4lbs which is approximately the same weight as its predecessor, which integrates directly into TOB’s kits without causing weight issues.

OSCOR Max specifications:

Maintaining a standardized equipment suite simplifies field deployment, reduces training time, and minimizes the risk of configuration errors, which can be critical during time-sensitive operations. Using multiple, incompatible systems can lead to gaps in coverage, increased false alarms, and longer response times, reducing overall mission effectiveness.

REI’s OSCOR Max spectrum analyzer is already proven within the operational environment of TOB. Introducing an untested system, particularly one that cannot see the entirety of the radio frequency spectrum will prove an unnecessary risk.

Market research determined that there are no other electronic detection devices that meet or can be modified to meet the Government minimum essential characteristics regarding the frequency detection, sweep speed, and built-in direct-connect capabilities. The kits are suited specifically to support S1/S2 travel and to provide redundancy in the event of multiple destinations requiring multiple teams. TOB is required to provide and support secure Executive Communications to both S1 and S2 during official travel. This system are both necessary and required to accomplish TOB’s mandated mission.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. (The discussion should include whether a www.sam.gov notice was or will be publicized, as required by FAR s 5.301, 6.305(a). If the justification covers a brand name item, this section should address compliance with FAR 5.102(a)(6)).

This sole source justification will be posted on www.sam.gov so that interested vendors could see the characteristics of the proposed procurement in order to notify the Government if they can meet the requirement.

7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. (Use information such as commercial pricelists or prior acquisition history that will help the Contracting Officer determine the anticipated cost is fair and reasonable or discuss the application of any of the techniques described at FAR 13.106-3(a)(2) and/or 13.106-3 (b)(3)).

The contracting officer determines that the anticipated price(s) will be fair and reasonable based on the Market Research and historical prices paid using previous OPO purchase orders for similar products..

8. Description of market research. (Market Research is required by FAR part 10 and HSAM 3010, and the DHS Market Research Guide. Describe the results of your market research or provide a statement of the reason why market research was not conducted).

The TMO/CISS/TOB conducted market research on the similar products from other vendors. The results of the market research indicate other companies’ similar products lack the specific features required by DHS. REI, LLC is the only authorized seller of http://www.sam.gov/

Sole Source Justification for Simplified Acquisitions exceeding the SAT including brand name Rev. 4/2022 SSJ No.: FY25-00243 5 this type of technical, security, and countermeasure equipment that has all the essential government requirements and characteristics.

OCSO found that other products do not provide all the requested features necessary for this requirement. OCSO would be forced to reduce its detection requirement, acquire new TOB travel kits, and obtain training which could result in a potential lack of secure communications for the S1 and S2, real-time monitoring capabilities, timely field deployment, and seamless integration with existing TOB equipment. OSCOR Max is the only product that provides enhanced spectrum analysis compatible with existing equipment. This compatibility and frequency detection capability are crucial for maintaining operational efficiency and reducing costs

9. Any other facts supporting the justification. (You must explain why technical data packages, specifications, statements of work, or purchase descriptions are not suitable for enhancing competition or not available. Discuss why your requirement cannot be modified to increase competition. If you are contending only one source can meet the Government’s minimum need, you must document the reason why and describe the extent to which the Government will be harmed if not acquired from that vendor. Address any potential duplication of cost, if applicable.)

The technical specifications for these systems cannot be enhanced or reduced for competition. REI, LLC is the Sole and Exclusive US Seller of the OSCOR Max spectrum analyzer. TCSM equipment is a small and specialized niche market, where firms specialize in unique and individual products rather than competing against established firms. These systems will be integrated into the inventory due to compatibility and TSCM Technicians possessing the specific training. Other systems on the market do not meet and cannot be modified to meet the minimum requirements.

10. A listing of the sources, if any that expressed, in writing, an interest in the acquisition.

Based on the Market Research, there are a number of companies that expressed interest but could not meet the Government required minimum essential characteristics.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for supplies or services required. (Include a statement of actions taken or will be taken to increase competition for future acquisitions of the same item/service).

TSCM equipment is specialized to satisfy specific requirements for a specific skill set. This type of equipment is only produced by a small number of manufacturers who produce only one or two pieces of equipment to satisfy a specifically unique requirement.
