About this file

This document is a Justification and Approval (J&A) for a sole-source procurement for the U.S. Army Contracting Command. The procurement involves twenty-one (21) KG-250X In-Line Network Encryptors for a Foreign Military Sales (FMS) case supporting Romania, specifically for the High Mobility Artillery Rocket System (HIMARS) Command and Control and AN/TPQ-53 Radar System. The procurement is specifically for ViaSat brand encryptors, which are Type 1 NSA-certified for secure NATO communications, with no alternative manufacturers capable of meeting the technical requirements.

Market research identified four potential sources, including the original equipment manufacturer (ViaSat) and three authorized resellers: Atlantic Diving Supply, Noble, and C6i Service Corp. The justification emphasizes that using alternative encryption systems would require extensive safety testing, potentially causing deployment delays of up to one year and additional costs of $500,000. The procurement is valued under $750,000 and will be conducted as a 100% Small Business Set-Aside under NAICS Code 334290, with an anticipated award date no later than 31 July 2025.

FAR Part 13 Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: Army Contracting Command - Aberdeen Proving Ground ACC-APG

6515 Integrity Court, Bldg. 4310 Aberdeen Proving Ground, MD 21005

2. Description of Action: This proposed action is for the award of a Firm-Fixed-Price “Brand Name” supply contract to purchase Commercial-Off-The-Shelf (COTS) hardware of KG-250X In Line Network Encryptors, Part number 1101000. This is a Foreign Military Sales (FMS) Case for Romania using FMS funds (non-repayable).

3. Description of Supplies/Services: The hardware to be procured is as follows:

Qty: twenty-one (21) KG-250X in-Line network encryptor, Part number: 1101000

4. Authority Cited: 41 U.S.C.1901as implemented by FAR 13.501(a)(2)(i), For a proposed contract exceeding the simplified acquisition threshold, but not exceeding $750,000, the contracting officer’s certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief will serve as approval, unless a higher approval level is established in accordance with agency procedures.

5. Reason for Authority Cited:

CECOM-SAMD requires the ViaSat brand KG-250Xs P/N 1101000, in support of Romania. The KG-250Xs will allow mission requirements to be met as it relates to the High Mobility Artillery Rocket System (HIMARS) Command and Control (C2) and to support operations of the AN/TPQ-53 Radar System. Using other equipment would require safety testing of the vehicles they would be integrated into, which would cause delays of up to one (1) year. The KG-250X is a Type 1 NSA-certified encryptor used for secure communications with NATO partners. Other brands will need to be tested and evaluated for NATO certifications and that can take 12-36 months.

If ViaSat encryptors are not procured and a different P/N is qualified, the government risks significant operational setbacks. Qualifying an alternative system would lead to delays in deployment, additional costs in testing and validation, and potential compatibility issues. These delays would compromise CECOM-SAMD’s mission readiness and effectiveness in critical situations, potentially costing $500,000 and extending project timelines by 15 months. There are no form and fit requirements. The U.S. Government does not possess the technical data package (detailed designs) for these items.

6. Publicizing Contract Actions: The requirement is in accordance with FAR

13.501(a)(ii) and is a brand name restriction. It will be redacted and posted with the solicitation.

7. Efforts to Obtain Competition: In accordance with FAR 12.603, Streamlined solicitation for commercial products or commercial services, a combined synopsis/solicitation will be posted on SAM.gov with the redacted brand name justification. It is anticipated that there will be adequate competition amongst value added resellers of the KG-250Xs and the OEM.

a. Effective Competition: Competition will be among all resellers and the OEM of the ViaSat brand-name item.

8. Actions to Increase Competition: To increase competition, the combined synopsis/solicitation will be posted on SAM.gov to allow potential offerors to provide quotes for brand-name only KG-250X In Line Network Encryptors.

On 31 July 2024, confirmed via email that they do not have distributors, but they do have authorized sales partners. To date, no other manufacturer’s product exists that can perform the same functions as ViaSat, Inc.’s KG-250X In Line Network encryptor.

9. Market Research: Market research was carried out by CECOM SAMD. An internet search using PartTarget, Google and WebFlis on the items was conducted. Four (4) sources were identified including the OEM, ViaSat who can meet the requirement:

Atlantic Diving Supply (ADS), Noble, C6i Service Corp, and Unmanned Systems

Technology. ViaSat, Inc. is a large business and the OEM of the KG-250X In Line

Network Encryptor. Unmanned System Technology, ADS, Noble and C6I are authorized resellers of this item and small businesses. The searches were conducted from March

9, 2025 to March 20, 2025.

10. Interested Sources: The Government will continue to perform market research to determine whether other sources exist as value added resellers for the KG-250X In Line

Network Encryptors.
