This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the information in Federal Acquisition Regulation (FAR) Part 13 using Simplified Acquisition Procedures (SAP). This announcement constitutes the only solicitation; a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. This combined synopsis/solicitation WILL be posted to BETA SAM at https://beta.sam.gov.
THE RFQ number is FA4800-24-Q-A099. This solicitation documents and incorporates provisions and clauses in effect though FAC 2024-05 and the DFARS Change notice 08/15/2024. It is the responsibility of the contractor to be familiar with the applicable clauses and provisions. The clauses may be accessed in full text at this website: https://www.acquisition.gov/.
The 633d contracting Squadron, 14 Burrell Street, Bldg. 67 Langley AFB, VA requests responses from qualified sources capable of providing Rice Lake Roughdeck Drive On Scales that are identified below. All items shall be new. No refurbished or used items will be accepted. This solicitation is set-aside for a small business.
One (1) Rice Lake Indicator, 920i Stainless Steel Enclosure
One (1) Indicator Option, A/D Single Channel 920i Kit
Three (3) Roughdeck 12' ft wide x 10' ft long, 20K capacity with 35' of interface cable, scale height 3.875" high
Two (2) Ramps 12 ft wide x 4 ft long for 20K scale
Four (4) Anchor Plates to properly space scales
Three (3) Factory Calibration 20K x 5 lb., each platform
Three (3) Connector, MS 7 position male
Three (3) Connector, MS 7 position female

Shipping term shall be FOB Destination; therefore, quote SHALL include shipping cost.
System for Award Management (SAM). Quoting vendors must be registered in the SAM database to be considered for award. Registration is free and can be completed on-line at http://sam.gov/.
Evaluation Factors and Required Documents:
An award will be made based on Lowest Price Technically Acceptable. All quotes will be evaluated for both technical acceptability and price reasonableness.
Technical Acceptability: Each quote must clearly indicate the capability of the vender to meet all specifications and requirements in the SOW.
1. The technical capability portion of the quote should include (if applicable):
a. Lead time for each item
b. Specifications if quoting a “like item”
c. Complete list of supplies per the items listed above.
Price Reasonableness: Each quote must breakdown pricing. This shall be a separate document form the technical capability.
1. Vendors shall provide one of the following upon request from the Government to determine price fair and reasonableness.
a. Two (2) invoices for the same or similar parts sold to customers within the last five years
b. Published price list or catalog
c. Contract numbers for the same or similar items sold to Government agencies

To be considered for this opportunity, all quotes shall be:

52.209-11 – Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under any Federal Law. (Feb 2016)
(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--
(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or
(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.
(b) The Offeror represents that—

52.212-1 Instructions to Offerors -- Commercial Items (Oct 2018) – Addendum
1. General Instructions A. The purpose of these instructions is to prescribe the format of the Request for Quote (RFQ) and describe the approach for the development and presentation of the RFQ data. This is designed to ensure the essential information required for evaluation is submitted.
B. The contracting officer urges the offeror to submit their best pricing and technical information upfront. The contracting officer may request at any time for the offeror to submit information, other than the certified cost or pricing data, to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.
C. To assure the timely and equitable evaluation, the offeror shall follow the instructions contained herein. Offeror is required to meet and address all of the requirements, including terms and conditions, representations and certifications, and technical requirements. Offeror must clearly identify any exception to the terms and conditions and provide complete accompanying rationale.
The RFQ when submitted, shall be comprehensive, complete, self-sufficient, and respond directly to the requirements of the RFQ. Elaborate artwork, expensive paper/binding and expensive visual aids are neither necessary nor desired.
The RFQ response shall consist of:
(1) Price Volume
(2) Technical Volume
52.212-2 -- Evaluation -- Commercial Items- Addendum
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
(b) The following factors shall be used to evaluate offers:
Factor 1: Price Factor 2: Technical
Past performance will be reviewed to identify potentially damaging information. Companies with multiple mark downs and unsatisfactory performance will not being considered technically unacceptable. Past performance confidence ratings will not be assigned.
Factor 1 – Price:
Price will be evaluated using the price analysis process established in FAR 15.404-1 to ensure the Government receives a fair, reasonable and balanced price. If the Government cannot determine the proposed pricing to be fair and reasonable, then “Other Than Certified Cost and Pricing Data” will be obtained from the offeror. The Government will evaluate the offer for award purposes for the total price for Contract Line-Item Number (CLIN) 0001.
In addition to the price analysis as described at FAR 15.404-1(b), price proposals will be analyzed to identify any potential unbalanced pricing (See FAR 15.404-1(g)). If the Government sees a wide variation in proposed contract line-item prices, the technical evaluation board will be informed as soon as possible during the initial evaluation of proposals so the appropriate personnel may seek clarity through offeror exchanges. Absent any issues related to the stated requirement, unbalanced pricing may pose an unacceptable risk to the Government and may be a reason to reject the offeror’s proposal.
Factor 2 – Technical:
The technical rating reflects the degree to which the offeror’s proposal meets or does not meet the minimum performance or capability requirements. The focus is on the ability of the offeror proposal to meet the minimum requirements of the SOR for all items required. Technical proposals will be assessed a rating of "Acceptable" or "Unacceptable." To be eligible for award, the offeror is required to receive an “Acceptable” rating for the entire CLIN. All CLIN items are equal in importance in regard to technical acceptance.

The technical evaluation will be conducted on the offer and demonstration of the minimum capability to meet the requirements described in the Statement of Requirements (SOR) accompanying this RFQ. The proposal shall reflect comprehensive understanding of these requirements.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (MAY 2013)
(a) Definitions. As used in this clause--
Department of Defense Activity Address Code (DoDAAC) is a six-position code that uniquely identifies a unit, activity, or organization.
Document type means the type of payment request or receiving report available for creation in Wide Area Workflow (WAWF).
Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.
(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall--
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.acquisition.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this Web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web- Based Training Course and use the Practice Training Site before submitting payment requests through
WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.
(e) WAWF methods of document submission. Document submissions may be via Web entry, Electronic Data Interchange, or File Transfer Protocol.
(f) WAWF payment instructions. The Contractor must use the following information when submitting payment requests and receiving reports in WAWF for this contract/order:
(1) Document type. The Contractor shall use the following document type(s).

(4) Payment request and supporting documentation. The Contractor shall ensure a payment request includes appropriate contract line item and subline item descriptions of the work performed or supplies delivered, unit price/cost per unit, fee (if applicable), and all relevant back-up documentation, as defined in DFARS Appendix F, (e.g. timesheets) in support of each payment request.
(5) WAWF email notifications. The Contractor shall enter the email address identified below in the “Send Additional Email Notifications” field of WAWF once a document is submitted in the system. Information will be added after award

5352.201-9101 OMBUDSMAN (OCT 2019)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution.
Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
(c) If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman.
