The services requested include title reports, 50-year chain of title searches, title insurance commitments and policies, ownership and encumbrance searches, and present owner searches. The solicitation is divided into two lots: Lot 1 for residential properties (defined as having no more than five residential units with no reasonable potential for conversion to more intense usage) and Lot 2 for commercial properties (defined as currently zoned commercial or having a commercial future land use designation). Respondents must submit one unbound original, three bound copies, and one electronic PDF copy by January 11, 2023, at 4:00 p.m. local time to the Purchasing Department at 50 South Military Trail, Suite 110, West Palm Beach, Florida 33415. The contract term is 24 months, ending February 8, 2025, with three optional 12-month renewal periods at the County's sole discretion.
Pricing is structured on a unit-rate basis with weighted factors applied to different service types: title reports (70 percent weight), 50-year chain of title searches (10 percent weight), ownership and encumbrance searches (10 percent weight), and present owner searches (10 percent weight). Title insurance commitments and policies are priced separately based on the minimum promulgated rate established by the Florida Insurance Commissioner, with allowances for search fees (up to $125), update search fees (up to $90), and closing fees ($150). Respondents must demonstrate a minimum of ten consecutive years of experience as either an agent, underwriter, or attorney agent and maintain specific licenses, bonds, and insurance requirements, including Professional Liability Insurance with a minimum of $1,000,000 in coverage. An SBE Evaluation Preference of up to 15 points is reserved for Small Business Enterprise prime respondents on contracts valued under $500,000. All respondents must register in the County's Vendor Self Service System, and all subcontractors must also be registered vendors. The evaluation criteria include experience and qualifications (40 percent), key personnel and operations (15 percent), price (25 percent), small/minority/women business enterprise participation (15 percent), and business location/local preference (5 percent). Respondents must comply with the County's Equal Business Opportunity Ordinance and Commercial Non-Discrimination Policy, and failure to maintain required insurance or comply with EBO program requirements constitutes material breach of contract subject to suspension, withholding of funds, termination, debarment, or liquidated damages.

It is the responsibility of the respondent to confirm the certification of any proposed S/M/WBE; therefore, it is recommended that respondents visit the online Vendor Directory at www.pbcgov.org/oebo to verify S/M/WBE certification status.
