About this file

This document is a Question and Answer (Q&A) file related to Request for Response (RFR) 2005 issued by the Massachusetts State Lottery Commission (MSLC). The RFR is for the procurement of plastic dispensers and displays. The RFR outlines a three-phase evaluation process, with the technical portion weighted at 75% and cost at 25% of the total score. The contract allows for negotiation of changes to performance, cost, and deliverables after the award, if mutually agreed upon. The successful bidder will be required to provide a 10-year warranty against discoloration and a 5-year warranty on workmanship and materials.

The Q&A indicates that the MSLC has experienced minimal returns, less than $500 per year, over the past 3 years for similar products. Physical samples of the required dispensers and displays are available for vendor inspection, but no technical drawings have been provided. The contract is limited to the state of Massachusetts, and the MSLC is the sole agency involved in this procurement.

Question

Answer

1. Sec. 1.4 6 Indicates that Phase I, Phase II and Phase III will be evaluated separately, however there is no allocation of the relative weight attributed to each Phase. Typically, we’ve seen this indicated as a percentage. Please advise as to the relative weight attributed to each Phase.

Assuming a proposal complies with the submission requirements in Phase I and progresses to Phase II, the technical portion will be worth 75% and cost will be worth 25% of the total score (Prompt Pay Discount is worth 5% of cost score).

2. Sec. 1.6.2.2 8 Does not indicate whether the Massachusetts Lottery and the selected Bidder may negotiate a change in any element of performance, cost and/or deliverable after the award. Please advise whether this is a possibility.

As stated in 1.6.2.2, the Lottery and selected Bidder(s) may negotiate a change in any element of performance, cost and / or deliverable pursuant to awarding of a contract, subsequent thereto if mutually agreed upon in writing, which results in lower costs or is more cost effective or is an overall better value. The contract cannot be negotiated under any other circumstances.

3. Phase I:

Response Template

Limitation of Liability and Indemnification’. The language is acceptable, however there should be an express exception to the indemnity for IP provided by the

Massachusetts Lottery. Please advise whether this revision can be accommodated.

In the event any intellectual property is provided by the Lottery upon further negotiation the subject will be addressed at that time.

4. Section 3.1.2

Warranties

16 Specific warranties for 10 years on discoloration and 5 years for workmanship and material are required. How is the product determined to be poor workmanship versus normal wear and tear on displays?

- There will be no discoloration or yellowing of the acrylic materials used for the all the dispensers/displays required in this RFR within the 10 year warranty.

- Workmanship would be evaluated at time of delivery and as issues arise related to seam separation, assembly tolerances, door/lock functionality, fit and finish as well as day to day performance at our various agent locations.

5. Section 3.1.2

Warranties

16 Typically, how many units have been warrantied per year?

Very minimal returns $500.00 year or less in the past 3 years.

6. Section 3.3.4 22 Is a technical/engineering drawing available for this concept?
