2. Nature and/or description of the action being approved.

a. Acquisition purpose and objectives.

The National Institute of Allergy and Infectious Diseases (NIAID) Operations and Engineering Branch (OEB) will be performing renovations of three (3) audiovisual systems in the NIAID Integrated Research Facility (IRF) located at 8200 Research Plaza at Fort Detrick in Frederick, Maryland. The goal of this work is to upgrade all outdated equipment in these rooms and standardize the design and capabilities of conference rooms across NIAID. In support of this goal, OEB requires the upgrade and renovation of Conference Rooms 1B-102, 1B-103, and 1B-104. In the past, legacy conference rooms have often been designed and built by different vendors, each utilizing different brands and models of equipment. As a result, the systems for control, audio processing, and video processing have been non-standardized, widely variable in function, and difficult to maintain, support, and provide end-user training for. This project will continue the standardization of equipment that has been standardized at 5601 Fishers Lane, in Rockville, Maryland and other NIAID audio visual (AV) system locations.

b. Project background.

The NIAID OEB of the Office of Cyber Infrastructure and Computational Biology (OCICB) manages and develops the technology infrastructure that supports Intramural research, Extramural investments and Administrative management.

OEB services 4000+ end users in more than 20 locations throughout the United

Justification and Approval -Brand Name

States. Infrastructure services provided by OEB are maintained and used 24 hours a day, 7 days a week. Services include data storage and protection, applications hosting, server management, workstation configuration and management, networking and security.

This firm-fixed price requirement for the upgrade and renovation of three (3) conference room AV systems at the IRF facility will enable users to collaborate with other NIAID sites through standard video conferencing, as well as Microsoft Skype for Business meetings. The standardized equipment and prescribed NIAID control specification will enable NIAID support staff to develop expertise in room maintenance, training, and end-user support. This will consequently maximize conference room uptime, standardize the NIAID user experience, and empower end-users to utilize the conference rooms without the need for constant AV support.

It will also provide the ability to stock spare parts to ensure consistent and reliable operation across all conference rooms. As with all complex systems, equipment failures occur in integrated AV systems. In such situations, it is important that conference room services be restored as quickly as possible. This is especially so when the conference room meetings are scheduled back-to-back. The OEB AV Engineering Team seeks to standardize as much of the conference room equipment as possible, allowing for spare parts supplies and support staff training to be shared across all NIAID conference room spaces. The supply portion of this acquisition requires Brand Name only equipment from the following manufacturers:

Barco, Biamp, Crestron, DPA, Extron, NEC, Polycom, Shure, and Vaddio.

In 2013, NIAID awarded a firm-fixed price contract to provide the installation and AV equipment for the 5601 Fishers Lane facility. This contract was awarded to Signal Perfection LTD on September 19, 2013 in the amount of $6,343,780.12 under full and open competition.

Previous NIAID purchases for similar AV upgrade and standardization requirements have been open market, competitive awards:

c. Total estimated dollar value and performance/delivery period.

Total Dollar Value: is for the Brand Name justification and approval.

The Government estimates total period of performance is from award date of May 30, 2019 through May 29, 2020.

4. Identification of the statutory authority permitting other than full and open competition.

X This acquisition is conducted under the authority of 41 United States Code (U.S.C.) 3304(a)(1) as set forth in Federal Acquisition Regulation (FAR) 13.106-1(b) and 13.501(a) . Brand name justification. The Barco, Biamp, Crestron, DPA, Extron, NEC, Polycom, Shure, and Vaddio equipment are brand name products.

This acquisition is conducted under the authority of section 4202 of the Clinger-Cohen Act of 1996.

This acquisition is conducted under the authority of the Services Acquisition Reform Act of 2003 (41 U.S.C. 428a).

5. Demonstration that the proposed contractor(s) unique qualifications or the nature of the acquisition requires use of the authority cited.

a. Name and address of the proposed contractor(s).

Acquisition will be limited to qualified authorized resellers for the following brand name products: Barco, Biamp, Crestron, DPA, Extron, NEC, Polycom, Shure, and Vaddio.

b. Nature of the acquisition and proposed unique qualification of the contractor(s).

The Program and Contracting offices have determined that a select group of products (listed in Appendix A) from Barco, Biamp, Crestron, DPA, Extron, NEC, Polycom, Shure, and Vaddio are required to satisfy the technological and compatibility needs for this specific project. No other brands will fulfill these requirements.

Specific characteristics for these products limit the availability to a brand name which are required to maintain consistent equipment across rooms and allows for rooms to use the same control system programming across NIAID. The control processors serve as the “brain” of the room and have control of each piece of equipment in the room. A custom-written program runs on the control processor and allows for both automated actions to be taken as well as user-controlled input via the control system touch panels. Examples of control processor functions would include powering on the room projector and displays, setting input and output selections, and adjusting volume, all with the touch of a single button. Because the custom programming must be written for the specific equipment in the room, it is imperative that equipment be consistent across NIAID for the same programming to be used. Custom programming costs can be tens of thousands of dollars for a single room configuration, so standardization is key to control costs of this implementation. Only these brands can furnish the requirement, to the exclusion of other brands, because the NIAID currently uses Barco, Biamp, Crestron, DPA, Extron, NEC, Polycom, Shure, and Vaddio products which interface with the new name brand equipment. The products must be compatible in all aspect (form, fit, and function) with the existing systems/equipment presently installed or owned by NIAID. The introduction of a new product brand/line would require custom programming which would be counterproductive to all the goals of standardizing equipment across NIAID. Therefore, it essential that this purchase be limited to Barco, Biamp, Crestron, DPA, Extron, NEC, Polycom, Shure, and Vaddio equipment that can be purchased through bona fide resellers.

6. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable. Indicate whether a FedBizOpps notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies.

A FedBizOpps Request for Quote will be publicized to all eligible vendors who are bona-fide resellers of the required brand name products. This Brand Name justification will be published with the solicitation.

7. Determination by the Contracting Officer that the anticipated cost/price to the Government will be fair and reasonable.

It is anticipated that several commercial competitive offers will be received. NIAID expects proposed prices to be fair and reasonable based on receipt of multiple competitive offers.

A final determination by the Contracting Officer will be conducted prior to award of this contract.

8. Description of the market research conducted (see FAR Part 10) and the results, or a statement of the reasons market research was not conducted.

The Program Office conducted the initial market research by reviewing NIAID’s existing AV infrastructure and standardization initiative and scanned the market for options that could satisfy the government’s requirement. Their research concluded that brand name only products from Barco, Biamp, Crestron, DPA, Extron, NEC, Polycom, Shure, and Vaddio would be required for this acquisition. Market research conducted by the Contract Specialist (CS) included a review of the mandatory priorities in accordance with FAR Subpart 8.002(a)(1) Priorities for Use of Government Supply Sources and the CS determined that none of the mandatory Government sources could satisfy this requirement. Additional market research by the CS included contracting knowledgeable government and industry professional and reviewing previous purchases of similar requirements. Previous NIAID purchases for similar AV upgrades and standardizations were competitive procurement on the open market as Brand Name only acquisitions. The Non-Manufacturer Rule (NMR) is applicable to this acquisition and several of the required brand name only manufacturers are considered “other than small” businesses under NAICS 334310. Due to the NMR, a set-aside is not recommended for this requirement. The CS also reviewed the NITAAC CIO-CS contract and the GSA Federal Supply Schedule 70 market research tools. Only a portion of the requested products and services are available through these contract vehicles. Based on discussion with the Program Office and past history of similar requirements, there are several open market vendors that have the capability to provide the requested products and installation.

9. Any other facts supporting the use of other than full and open competition.

Not applicable.

10. Listing of sources, if any, that expressed, in writing, an interest in the acquisition. Not applicable.

11. Statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the required supplies or services.

It is the policy of NIAID to promote the use of competitive procedures whenever and wherever possible. To remove or overcome barriers to competition in the future, the market will be scanned frequently for new companies and products that could satisfy the Government’s requirement. The OEB staff meets regularly with equipment manufacturers and vendors and attends manufacturer and industry training to keep current on technology. Vendor and trade magazines are scanned for new, open technologies that can satisfy future infrastructure requirements. The agency will continually re-evaluate the brand name equipment currently being used; it will continue to research the various manufacturers and products that could be in the Government’s best interest as a “best value” for future replacement equipment at the agency’s site and at sites the agency supports. The current situation requires the use of Barco, Biamp, Crestron, DPA, Extron, NEC, Polycom, Shure, and Vaddio products as these are the brands currently determined to satisfy agency requirements. Since NIAID’s current AV infrastructure is comprised of these brand name only products, no further actions are planned to overcome this barrier.

12. Program office certification.
