52.27-103-72 DOJ CONTRACTOR RESIDENCY REQUIREMENT BUREAU OF PRISONS (JUNE 2004)
For three of the five years immediately prior to submission of an offer/bid/quote, or prior to performance under a contract or commit ment, individuals or contractor employees providing services must have:
I. Legally resided in the United States (U.S .);2. worked for the U.S. overseas in a Federal or military capacity; or3 . been a dependent of a Federal or military employee serving overseas.
If the individual is not a U.S . citizen, they must be from a country allied with the U.S. The following website provides current inform ation regarding allied countries: http://www.opm.gov/employ/html/citizen.htm
By signing this contract or commitment document, or by commencing perfonnance, the contractor agrees to this restriction.
[End of Clause]
52.218-000 CONTINUING CONTRACT PERFORMANCE DURING A PANDEMIC INFLUENZA OR OTHER NATIONAL EMERGENCY (May 2008)
During a Pandemic or other emergency we understand that our contractor workforce will experience the same high levels of absentee ism as our federal employees. Although the Excusable Delays and Termination for Default clauses used in Government contracts list epidemics and quarantine restrictions among the reasons to excuse delays in contract performance, we expect our contractors to make a reasonable effort to keep performance at an acceptable level during emergency periods.
RFQP0700FA01300002 Page 6 of 9
The Office of Personnel Management (OPM) has provided guidance to federal managers and employees on the kinds of actions to be taken to ensure the continuity of operations during emergency periods. This guidance is also applicable to our contract workforce.
Contractors are expected to have reasonable policies in place for continuing work performance, particularly those performing mission critical services, during a pandemic influenza or other emergency situation. The types of actions a federal contractor should reasonably take to help ensure performance are:
• Encourage employees to get inoculations or follow other preventive measures as advised by the public health ser vice.
• Cross-train workers as backup for all positions performing critical services. This is particularly important for work such as guard services where telework is not an option.
• Implement telework to the greatest extent possible in the workgroup so systems are in place to support successful re mote work in an emergency.
• Communicate expectations to all employees regarding their roles and responsibilities in relation to remote work in the event of a pandemic health crisis or other emergency.
• Establish communication processes to notify employees of activation of this plan.
• Integrate pandemic health crisis response expectations into telework agreements.
• With the employee, assess requirements for working at home (supplies and equipment needed for an extended tele work period). Security concerns should be considered in making equipment choices; agencies or contractors may wish to avoid use of employees' personal computers and provide them with PCs or laptops as appropriate.
• Determine how all employees who may telework will communicate with one another and with management to accom plish work.
• Practice telework regularly to ensure effectiveness.
• Make it clear that in emergency situations, employees must perform all duties assigned by management, even if they are outside usual or customary duties.
• Identify how time and attendance will be maintained .
It is the contractor's responsibi li ty to advise the Government Contracting Officer if they anticipate not being able to perform and to work with the Department to fi ll gaps as necessary. This means direct communication with the Contracting Officer or in his/her ab sence, another responsible person in the contracting office via telephone or email messages acknowledging the contractor's notifica tion . The incumbent contractor is responsible for assisting the Department in estimating the adverse impacts of nonperformance and to work diligently with the Department to develop a strategy for maintaining the continuity of operations.
The Department does reserve the right in such emergency situations to use Federal employees, employees of other agencies, contract support from other existing contractors, or to enter into new contracts for critical support services. Any new contracting efforts would be acquired following the guidance in the Office of federal Procurement Policy issuance "Emergency Acquisitions", May, 2007 and Subpart 18.2. Emergency Acquisition Flexibilities, of the Federal Acquisition Regulations .
[End of Clause]
52.232-99 PROVIDING ACCELERATED PAYMENT TO SMALL BUSINESS SUBCONTRACTORS(DEVIATION) (AUG 2012)
(a) Upon receipt of accelerated payments from the Government, the contractor is required to make accelerated payments to small busi ness subcontractors to the maximum extent practicable after receipt of a proper invoice and all proper documentation from the small business subcontractor.
(b) Include the substance of this clause, including this paragraph (b), in all subcontracts with small business concerns.
(c) The acceleration of payments under this clause does not provide any new rights under the Prompt Payment Act.
(End of Clause)

(c) Liability insurance may be on either an occurrences basis or on a claims-made basis. If the policy is on a claims-made basis, an ex tended reporting endorsement (tail) for a period of not less than 3 years after the end of the contract term must also be provided.
(d) Evidence of insurance documenting the required coverage for each health care provider who will perform under this contract shall be provided to the Contracting Officer prior to the commencement of services under this contract. If the insurance is on a claims-made basis and evidence of an extended reporting endorsement is not provided prior to the commencement of services, evidence of such en dorsement shall be provided to the Contracting Officer prior to the expiration of this contract. Final payment under this contract shall be withheld until evidence of the extended reporting endorsement is provided to the Contracting Officer.

Attachment 1 - Statement of Work
A. BACKGROUND
The Federal Bureau of Prisons (BOP) provides healthcare in more than 117 correctional facilities geographically dispersed throughout the contiguous United States, Hawaii, and Puerto Rico.
Medical services rendered to all federal inmates are governed by Federal law, BOP policies and procedures, the Joint Commission and American Corrections Association (ACA) standards.
The BOP protects society by confining offenders in controlled environments of prisons and community-based facilities that are safe, humane, cost-efficient, and appropriately secure. The health care mission of the BOP is to deliver medically necessary health care to inmates effectively in accordance with proven standards of care without compromising public safety concerns inherent to the BOP's overall mission. The term "medically necessary" is used to determine the type of health care services that are necessary.
B. SCOPE
The Federal Bureau of Prisons intends to establish multiple Blanket Purchase Agreements (BPAs) for the transportation of medically impaired or fragile male and female prisoners to and from Federal Prisons throughout the United States. The services under these BPAs will be made available to any future correctional facility built or acquired by the BOP. The BPAs will be used to supplement the BOP's capability of transporting inmates requiring medical care. There is no guarantee any service will be purchased by the Government. Procedures for issuing BPA Calls are outlined in Attachment 3.
There will be two different types of air services which will be required under any awarded BPA: air charter and air ambulance.
The majority of air services required will be air charters. The BOP shall retain the option to provide medical staff and medical supplies to meet the medical needs of the patient(s) being transported by air charter.
Air ambulance is defined as an aircraft specially constructed, modified or equipped, and used for the primary purposes of responding to emergency calls and transporting critically ill or injured patients whose medical flight crew has at a minimum two
(2) attendants certified or licensed in advanced life support.
Less frequently, air ambulances are required. If requested by
Attachment 1 - Statement of W ark the BOP ordering official, the BPA Holder shall provide their medical staff and medical supplies/equipment to meet the medical requirements of the patient(s) being transported by air ambulance . Medical staff and supplies shall be included in the per air nautical mile pricing for air ambulance service.
C. BPA HOLDER REQUIREMENTS AND RESPONSIBILITIES
1. Provide the safe and secure aircraft along with qualified pilots to transport medically impaired prisoners, of various security levels, that are escorted by BOP staff to and from Federal Prisons or community-based health care facilities around the country. Services will normally be required Monday through Friday, non-Federal holidays, hours of 06:00 a.m. through 5:00p.m., local time. However, flights may be required on weekends, Federal holidays, and during non-normal hours.
2. Provide written safety reports upon request by the BOP.
3. Provide maintenance records of aircraft to the BOP on a monthly basis. All deficiencies found shall be corrected and submitted to the BOP before use of the aircraft in question.
4. Provide the ability to accommodate interim destinations to load and unload patients prior to the final destination (multiple stop itineraries.)
5 . Provide itineraries, pilot, and aircraft information for each flight a minimum of 24 hours prior to departure times.
Changes to this information will be reported immediately to the Health Services Administrator and/or Contracting Officer of the location issuing the BPA Call.
6. The BPA Holder, flight crew, and medical staff shall defer all security and control concerns of patients to the BOP and escorting staff to include, but limited to: quantity of escort staff, non-medical restraints, and weapons.
7. Provide a diverse fleet of aircrafts that are capable of intercontinental flights. Aircraft must be able to carry a minimum of three (3) BOP staff to one (1) inmate.
8. All flights scheduled shall be same day round trip flights except when expressly authorized by the Contracting Officer's Representative (COR) or Contracting Officer.
Multiple stops may be scheduled. Overnight stays must have the approval of the BOP COR or Contracting Officer.
9. At no time shall a BPA Holder be permitted to supervise inmates or have contact with inmates, other than to provide essential medical care in-flight.
10. Provide and maintain during the term of the BPA medical liability insurance issued by a responsible insurance carrier of not less than $1,000,000.00 per specialty per occurrence.
11. Air ambulance services:
a. Provide a medical director of the program that:
1. Is a physician who is responsible for supervision and evaluation of the quality of medical care provided by the medical personnel.
2. Is licensed and authorized to practice in the state in which the medical transport service is based and have educational experience in those areas of medicine that are commensurate with the medical transport service or utilize specialty physicians as consultants when appropriate.
3. Maintains open communications with referring and accepting physicians and be accessible for concerns expressed by referring and accepting physicians regarding controversial issues and patient management.
b. Provide patient(s) transport team member(s) that are licensed and authorized to practice in the state in which the medical transport service is based and have educational experience in those areas of medicine that are commensurate with the medical transport service.
c. The medical transport service has criteria or mechanisms to provide the appropriate care required for patients who are being transported. As a minimum, the transport team shall consist of a Registered Nurse.
d. Provide medical supplies and equipment consistent with the scope of care.
e. Medical transport personnel shall ensure that all medical equipment/supplies are in working order.
f. Provide specific policies which address diseases affected by altitude with maintenance of adequate oxygen saturation and treatment of oxygen desaturation.
g. The aircraft is configured in such a way that the medical transport personnel can provide patient care consistent with the scope of care of the medical transport service. The aircraft/ambulance shall be equipped according to applicable federal and state laws.
h. The aircraft design and configuration must not compromise patient stability in loading, unloading or in-flight operations.
i . Arrange/provide ground ambulance/transport services to and from community-based health care facilities upon request by the BOP. Since ground ambulance transportation will not be regularly needed, prices shall be negotiated with the contractor(s) on an as needed basis.
12. Helicopter Transportation:
If the BPA Holder suggests using helicopter transportation, approval must be obtained from the BOP prior to the trip and a statement shall be signed by the air transport operator or chief pilot that the use of a fixed wing aircraft or combination of fixed wing aircraft is not operationally feasible. Helicopters shall be priced the same as air nautical miles for air ambulance.
13. Due to the security concerns with transporting convicted felons, BPA Holders shall make every effort to maintain "on- time" departures of all calls issued against a BPA.
Any aircraft that departs (leaves the blocks) within 20 minutes of scheduled departure shall be considered "on time". If a BPA Holder consistently has late departures, the Government may elect to cancel the BPA. Late departures due to inclement weather will not affect the Government's decision to cancel a BPA.
14. Aircraft shall be positioned to the designated airport and readied for flight one (1) hour prior to scheduled departure time.
D. BUREAU OF PRISONS REQUIREMENTS AND RESPONSIBILITIES FOR AIR
CHARTER SERVICES
1. The respective BOP facility from which the inmate is being transferred shall be responsible for providing staff for the medical airlift, i.e., Medical Doctor, Physician's Assistant, Nurse, or Custodial Staff. The originating BOP facility shall be responsible for providing these staff for the duration of the flight regardless of in-transit stops.
During these stops, the airlift may drop off and pick up inmates for transport.
2. On occasion, inmate transfers may be conducted with the use of armed BOP staff members. At no time shall the BPA Holder's staff/pilots be permitted to carry a weapon during a flight operation for the BOP.
3. Prior to take-off, a BOP staff member shall be accompanied by a flight crew member and inspect the aircraft to be boarded. All compartments that are accessible while in flight shall be inspected for weapons and contraband prior to boarding the inmate.
4. The BOP shall provide all security restraint equipment.
5. For air ambulance services, all of the above apply with the exception that the contractor will provide medical staff.
6. Should the Government cancel a scheduled flight, the Government shall reimburse the BPA Holder for direct operating expenses only related to the cancelled trip. The BPA Holder will be required to submit a detailed invoice of expenses to the ordering official or Contracting Officer.
The Government will not reimburse a BPA Holder for any unsupported expense.
E. CONTRACTOR QUALIFICATIONS
The BPA Holder's pilots shall possess a valid commercial pilot license issued by the Federal Aviation Administration (FAA) with a minimum of 1,500 hours of flying time. The pilots shall also meet the minimum qualifications set by the Association of Air Medical Services (AAMS) and the Commission on Accreditation of Air Medical Services (CAAMS) .
The BPA Holder shall be able to supply rotor wing and fixed wing aircraft for medical flights. All records associated with a pilot shall be turned over to the BOP upon request, e.g., license and certification (if deemed necessary by the BOP) from the Contracting Officer . The BPA shall be able to supply medical personnel upon the request of the BOP, i.e., Medical Doctors, Paramedics, Nurses, or EMT's. Medical personnel will only be required during emergencies, or when the BOP will not be able to supply a qualified medical person for the flight. If the BOP does require medical personnel for air charter services, prices will be negotiated at that time.
Each BPA Holder is required to have a current and valid Title 14 CF.R Part 135 qperating Certi£icate. Failure to maintain Part 135 certification will result in cancellation of the BPA.
For Air Ambulance Services, each BPA Holder must maintain a current and valid EMS license/certification. Failure to maintain an EMS license/certification will result in cancellation of the BPA.
The Part 135 certification and EMS license/certification will also be applicable if the BPA Holder brokers a flight with another air charter or air ambulance company. A copy of the broker's certification(s) must be sent along with the trip quotation form to the ordering official.
F. BILLING OF AIR CHARTER/AIR AMBULANCE SERVICES
Air Ambulance/Air Charter services shall be billed in air nautical miles. Mileage shall be calculated using "great circle distance" from point of take-off to point of landing. The point of take-off and point of landing encompass only the inmate transport and do not include any re-positioning of the aircraft.
The BPA Holder may bill air mileage which exceeds the great circle distance between point of take-off and point of landing, only if excess mileage is due to circumstances beyond the contractor's control (e.g., weather, vectoring, traffic, security, change in inmate condition). Excess air nautical miles and the regular contract air nautical miles shall be priced the same. Excess mileage must be reflected in the billing as a separate line item. Documentation to justify the excess mileage must be submitted with the billing.
If the BPA Holder must make an unscheduled landing, the contractor shall notify the BOP staff from the ordering BOP facility immediately after landing. If the unscheduled landing is due to conditions other than those beyond the contractor's control (e.g., mechanical or equipment problems), the contractor is liable for any and all costs incurred. For conditions beyond the BPA Holder's control, (e.g., medical emergency, inmate threat to safety of those on board), the contractor shall submit documentation supporting the additional costs incurred.
Invoices shall identify the BPA call number, aircraft tail number, date and time of each trip, quantity of air nautical miles flown, and the number of hours and level for each medical personnel used.
G. Period of Performance
Each BPA shall remain in effect for a 12 month base period with 4 12 month optional periods, commencing with the Date of Award.
Each BPA will automatically renew at the end of each performance period, unless notification is received from the awarding Contracting Officer. Individual purchases under each BPA shall not exceed the simplified acquisition threshold. If a BPA Holder's performance consistently reaches unsatisfactory levels, the Government may elect to cancel the BPA due to poor performance. Also, the Government may cancel any or all BPA(s) if doing so is in the best interest of the Government.
Attachment 2- Schedule of ltems/BPA Pricing
Prospective BPA Holders, i.e. quoters, shall fill out this form completely. All prospective BPA Holders shall submit their pricing based on Air Nautical Miles. It is anticipated that a minimum of three (3) BPAs will be awarded. See Attachment 4 for evaluation criteria.
ESTIMATED QUANTITIES
Estimated quantities for each performance period are detailed below. The estimated quantities provided are not a representation to the BPA Holder that the estimated quantities will be required or ordered or that conditions affecting requirements will be stable or normal.
The Government estimates that an average of 300 trips per performance period will be requested. The total estimated number of air nautical miles for each performance period is as follows:
Air Charter Air Ambulance
BPA PRICING METHODOLOGY
