Next, Mr. Newcome reviewed key sections of the Solicitation Document – The solicitation documents contains all of the rules/regulations, terms and conditions that will largely define the relationship between the winning bidder and the Bureau of Prisons as it relates to the project. It is assembled in several sections to facilitate an easy review. Mr. Newcome highlighted the following areas of interest:

Special Contract Requirements

Notice of Contractor Personnel Security Requirements – Any and all workers that work at this facility will need to pass a background check that complies with the requirements of the Homeland

Security Presidential Directive 12 (HSPD-12). This security clearance must be obtained prior to working at FCI Morgantown. The successful contractor will be required to comply with the requirements for a long term contractor personnel.

Payment and Performance Bonds - Mr. Newcome indicated that payment and performance bonds will not be required following contract award due to the magnitude of the project.

Magnitude of Project - Mr. Newcome noted the magnitude of the project as between $25000, and

$100,000.00.

Contract Clauses

Contract Clauses – Mr. Newcome indiciated it is the contractors responsibility to ensure all contract provisions and clauses are understood and followed, including those incorporated by reference. Mr. Newcome explained that clauses incorporated by reference have the same force and effect as if they were given in full text. It is important for contractors to familiarize themselves with the requirements of each clause as they will define the relationship between the contractor and Bureau of Prisons for this project.

Commencement, Prosecution and Completion of Work – The successful contractor shall commence work within 10 calendar days from Notice to Proceed and complete work within 120 calendar days from Notice to Proceed. Mr. Newcome emphasized the 120 calendar days includes the amount of time it takes the contractor to submit security clearance paperwork and to gain approval for working at the site. Therefore, the successful contractor should contact Mr. Michael

Romeo, Engineering Technician on the day of award notification to start the clearance process.

Attachments

Davis Bacon Act - All workers must be paid in accordance with the wages contained in the wage decision #wv160042 dated 1/8/2016. The wage decision details the minimum wages the contractor will be required to pay for the type of work being performed. Mr. Newcome indicated that “on the spot” wage surveys would be conducted during the performance period to ensure the protection of the individuals working under the terms of the contract.

Solicitation Provisions

Notice of Requirement for Affirmative Action to Ensure Equal Employment Opportunity for Construction – To comply with Executive Order 11246, contractors must demonstrate a good faith effort to meet their affirmative action goals for the employment of minorities and women in the construction industry.

Next, Mr. Newcome turned the meeting over to institution staff to discuss the security clearance procedure, access to the site, working hours, material storage, Institution code of conduct, provisions for removal of trash, escort of contractor personnel, NCIC Requirements, parking space, and OSHA requirements.

Security Clearance Requirements -- Mr. Romeo reviewed security clearance procedures.

Upon notification of contract award, contact Mr. Michael Romo immediately to start the clearance process. In order for your employees to work on the job site they have to be cleared in accordance with HSPD-12. All contractor employees (including subcontractors) will be required to complete a security clearance packet, present picture identification in person, and be fingerprinted before the paperwork can be processed. Mr. Romeo advised that at the time of fingerprinting, there will be an on-site orientation meeting each applicant will be required to attend. Contractors should allow four (4) hours for this process. Mr. Rome also discussed the requirement for contractors to access the EQUIP computer system as part of the application process. After all of the required paperwork is properly completed and the BOP has an acceptable package, it will take approximately 2-3 weeks for a determination to be made whether or not the security clearance will be granted. As a reminder, the time it takes to obtain the proper security clearance is included in the contractor’s period of performance. Security clearance procedures have been incorporated in the period of performance. Once the decision has been made the contractor will be immediately notified by the Institution. Any of the contractor’s employees not cleared will not be allowed on the premises. Mr. Romeo advised that the successful contractor should have one point of contact for security clearance applications.

The Warden makes the final determination on all individuals allowed to work on institutional grounds. If an employee is denied, no specific reason will be given for the denial. Denial does not mean the individual has a criminal history. A security clearance denial could result from a multitude of issues (i.e. Relative in institution).

Access to the site- Mr. Romoe The project site will be opened to the contractors 5 days per week, Monday through Friday, excluding Federal Holidays.

Working Hours- Mr. Romeo The contractor will check in for work at 7:00 am and receive their

Work hours and work days may be altered only with a 48 hour advance approval of the Contracting Officer. During an emergency situation, no work will be allowed. During working hours, there will be limited traffic in and out of the institution and contractors shall prepare to remain on the jobsite throughout the duration of the day, besides emergency situations.
