The County reserves the right to reject all proposals, in full or part, and to negotiate fees, conditions, or other terms with the Proposer(s) submitting the overall best scored proposal. The County shall have the right to waive any informality or irregularity of immaterial deviation, omissions, and clerical errors in any bid received.
Legally Binding Agreement: The County and the awarded Proposer shall enter into a formal lease agreement.
BID EVALUATION
Evaluation and Selection: The County will evaluate all submittals in accordance with the Official Code of Hall County, Georgia 3.10, and as further detailed herein. The County will evaluate proposals using a two-step process: The first is the “Technical Qualifications Proposal” that outlines the proposing firm’s qualifications, experience, and its approach to deliver the services.
The second is the “Revenue Proposal”, whereby the evaluation committee will evaluate the proposed costs and revenues for the Services to determine the best value for the County.
Award Process: The County reserves the right to reject any or all bids, in whole or part, or to select any Proposer, without liability on part of the County to the Proposer, to complete the described work. The County intends to award the contract to one (1) Vendor that it deems to be the most responsible and responsive Vendor to perform all the work described herein. Lead times and length of time to complete the work may also be a factor in award. The County will not make an award of contract solely based on lowest cost/highest revenue bid, but also on approach, references, qualifications, and other subjective criteria as the County may deem necessary and determine at its sole discretion.
Technical Qualifications Evaluation: Proposer must answer all scored questions found on Exhibit F – Scored Questions, which are weighted and will be scored by the County’s evaluation committee. The County’s evaluation committee will score and assign point values to the answers.
The total maximum points are set at 1,000. The County has assigned a 40/60 split for scoring points; four hundred (400) points (40%) available for Technical Qualifications, and six hundred
(600) points (60%) available for the revenue proposal. The Proposer with the highest total point score closest to 1,000 will be the apparent contract award winner, subject to approval by the Hall County Board of Commissioners.
Unanswered questions will earn a 0-point score. The Proposer’s response should limit answers directly to the questions asked. Each answer will be scored on a scale of twenty-five (25) percentage points as shown:
Excellent = 100% Good = 75% Adequate = 50% Marginal = 25% Poor = 0%
In addition to the space provided on Exhibit F – Scored Questions, Proposers may expand their answers to the questions onto separate pages if needed with the question repeated at the top of each page. Proposers may input “see attached” in the space provided next to each question.
Responses to the questions should be clear and concise. Where appropriate, Proposers should show statistical information in a tabular chart format and textual information in bullet point format.
Summarize key points at the beginning of each answer. All quantitative material should include complete assumptions and be supported by detailed schedules evidencing all calculations and results.
Provide one-sided documents only. Do not include superfluous marketing brochures or unnecessary promotional materials. These will not be evaluated. Address each specific question with direct, detailed answers.
PROPOSER RESPONSE
Technical Qualifications: Proposers must provide a total of four (4) hard paper copies of their technical qualifications: one (1) marked “Original” and three (3) marked “Copy”. Submit all four
(4) hard paper copies in a sealed envelope(s), separate from the Revenue Proposal.
Revenue Proposal Proposers are to also submit one (1) hard paper copy of their Exhibit B – Revenue Proposal Worksheet.
Electronic signatures on bid documents are acceptable; however, hard copies of the bid response are required, as stated above.
Combined Digital Response
Proposers must provide their responses on one (1) USB drive with two (2) folders therein: one (1) entitled “Technical Qualifications Response” and one (1) entitled “Revenue Proposal”. Do not include the revenue proposal in the technical qualifications folder.
Cost & Revenue Evaluation: This solicitation is heavily focused on a Proposer’s qualifications, experience, and capabilities. Therefore, award may not be made solely based on the lowest cost/highest revenue bid. Cost/Revenue will be given more importance when all other evaluation criteria are relatively equal.
Cost and revenue are not the only considerations for award. If, in the County’s sole discretion, qualifications between two (2) or more Proposers are equal, then the County may make an award to the lowest cost/highest revenue Proposer among them. The County will evaluate cost and revenue as presented on Exhibit B – Revenue Proposal Worksheet. Any and all fees should be detailed in the response.
Validation: Hall County requires that Proposers provide a cover letter with a signature by an officer of the firm with the submittal to ensure its originality.
Mandatory Documents: Proposers must complete and return all forms, documents, and exhibits attached herein with their bid proposals. Failure to do so may deem the proposal non-responsive and the County may not evaluate it for award.
Non-Collusion Requirement (Cone-of-Silence): Proposers must not have contact of any nature with other Proposers, County staff members (except for the Issuing Officer), elected officials, nor County Commissioners during the RFQ/P evaluation process. The County may deem such as collusion, thus rendering the submission in violation of the Official Code of Hall County, and therefore the County may deem the proposal as non-responsible and not evaluate the proposal for an award.
By submitting a proposal, the Proposer represents and warrants that no official or employee of Hall County Government has, in any manner, an interest, directly or indirectly, in the proposal or in the contract which may be made under it, or in any expected profits to arise there from.
County Consultants: From time to time, the County may select an outside consultant at its own discretion who will act under the direction of County’s Project Manager. The consultant will have full authority to act on behalf of the County; however, the consultant may not solicit goods and services on behalf of the County without prior written approval from the County. Vendors MUST follow all specification sections prepared by the County’s consultant, and Vendors MUST allow the consultant to inspect the work.
Taxes: The County is exempt from State of Georgia Local Sales and Use Tax. The Proposer understands and acknowledges that it is responsible for any sales and use taxes it may incur.
The Proposer will not charge or invoice the County any sales and use tax as a separate line item.
The Proposer may request a copy of the County’s Georgia Sales and Use Tax Exemption Certificate.
Bonds: A bid bond equal to five percent (5%) of the bid amount is required to be submitted with the bid response. All Proposers must also include in their bid submissions a letter of bondability.
The County will only accept surety companies licensed to do business in the State of Georgia.
The awarded Proposer must produce performance and payment bonds that are both equal to
100% of the face value of the awarded amount. Performance and payment bonds must be received by the County before a Notice to Proceed is issued.

G. If unable to reach an agreement with the highest scoring Proposer, the County retains the right to negotiate with the next highest scoring Proposer, and so on until reaching a satisfactory agreement, or the County may terminate the process.

8.0 STEPS TO AWARD
The evaluation committee will recommend award of the contract to the highest scoring Proposer.
In the unlikely event of a tie, the County may enter into negotiations of terms and conditions. The County will then present to the awarded Proposer a Notice of Award, a Purchase Order, and a Notice to Proceed.
Step 1: The evaluation committee will evaluate the Proposers’ responses according to the criteria described herein, and score and rank the proposals. The County reserves the right to request clarification of information provided and to request additional information needed to assist in the evaluation process.
Step 2: The Purchasing Division will then open the revenue proposals, and the evaluation committee will then score the responses. The Purchasing Division will combine these results with the results of the technical qualifications scoring. After this scoring, the Purchasing Division will rank the highest scoring proposers on a bid tabulation summary.
Step 3: The evaluation committee may schedule interviews with the Proposers. All costs associated with the interview (if required) will be at the expense of the proposing Vendor.
Step 4: Based upon the results of the proposals, references, and the interviews, the Purchasing Division, along with the evaluation committee, may negotiate with the Proposer(s) ranked highest in an attempt to reach an agreement. If negotiations with the highest ranked Proposer are unsuccessful, the County may negotiate with the second ranked Proposer, and so on until reaching a satisfactory agreement.

EXHIBIT E – ETHICS AFFIDAVIT
RFQ #46-027 Hall County Property Lease for Installation & Maintenance of a Cellular Tower
Contractors, consultants, and vendors of any service or commodity to Hall County, Georgia (“County”) must read and affirm to adhere to the following ethics requirements for compliance with the Official Code 3.10.070 of Hall County – Ethics.
A. It is the policy of Hall County to seek the best overall value when procuring goods and services. To this end, the County finds and declares that its objectives will best be achieved through an open, competitive process with a broad range of responsive and responsible vendors wishing to provide products and services to the County. The County will establish and conduct a procurement program that maximizes service benefit to the community and awards contracts to vendors who offer the best quality and value.
B. The County declares that County employees and officials, along with those wishing to do business with the County, have the shared responsibility for avoiding biased, anticompetitive, or unethical practices.
C. County employees, officials, and their family members are prohibited from seeking, requesting, or receiving any material payment, gift, job offer, security, promise of future benefit, or any other tangible or intangible thing of value when such receipt has the potential to influence a procurement decision or to gain undue advantage in a procurement competition.
D. Prospective vendors must compete for County business within the parameters of the solicitation process and are prohibited from seeking to obtain inside information, attempting to skew the writing of specifications or influencing a procurement decision through any means outside the process established for the respective solicitation.
This principle applies to any vendor, contractor, subcontractor, representative, employee, or agent that may be associated with a procurement transaction.
E. Bidders and proposers shall disclose on competitive bid responses any individual(s), firm(s), family member(s), and/or County official(s) who do business with the County if there is an appearance of a conflict of interest.
F. Ethical business practices are important both during a solicitation and after the decision to grant an award. The County seeks to establish relationships with business partners whose ongoing ethical standards of business conduct are congruent with those outlined here.
G. Contract compliance history with the County and other contractual parties is a valid element in the decision to award a contract.
H. The County stipulates that the furtherance of its strategic goals for job creation, stability, growth in the tax base, business retention, and other fiscal and economic development objectives may be considered during the procurement process. The Purchasing Manager, subject to the approval of the Director of Financial Services, is authorized to establish procurement initiatives consistent with the County's strategic economic development objectives. These procurement practices shall be applied consistently and equitably and shall have a direct relationship to the County's goals.
I. County employees, officials, and their family members are generally prohibited from participation in any procurement decision or any gain of undue advantage in a procurement competition because of contemporaneous employment with a potential or actual business partner.
J. It is unethical for any County employee to purchase commodities or services from a County contract for personal use.
K. Except for solicitations for the sale of real property, individuals, firms, and businesses seeking an award of a County contract may not initiate or continue any verbal or written communications regarding a solicitation with any County officer, elected official, employee, or other County representative other than the Issuing Officer named in the solicitation or the County's financial advisor, between the date of the issuance of the solicitation and the date of the final contract award by the Board of Commissioners. The Purchasing Manager will review violations. If determined that such communication has compromised the competitive process, the offer submitted by the individual, firm, or business may be disqualified from consideration for award. Solicitations for the sale of real property may allow for verbal or written communications with the appropriate County representative.
L. All County commissioners, officials, and employees shall adhere to the standards outlined in the Hall County Code of Ethics.
M. The Purchasing Division of the Financial Services Department shall determine and implement methods of educating all prospective contractors, bidders, proposers, and vendors on the requirements and provisions of Code Section 3.10.070 including, but not limited to, requiring each prospective contractor, bidder, proposer, and vendor that expresses an intent to do business with the County to sign an affidavit attesting that they have read this Chapter and have more specifically also read Code Section 3.10.070.
