JUSTIFICATION FOR USE OF NONCOMPETITIVE PROCEDURES

Identification Number (purchase request/solicitation number) : RFQ-D-14-NC-0045

1. A description of the agency's needs and estimated value.

The Drug Enforcement Administration requires continued contractor support for the SPEEDWAY program within the Office of Special Intelligence (NS) . The anticipated performance period for three months is from March 5, 2014 through June 4, 2014. An additional three month option term may be utilized on a month-to month basis with a performance period from June 5, 2014 through September 4, 2014 .

General Dymanics Advanced Information Systems provides technical support in the categories of System Administration, Help Desk Support, Database Administration, Data Analysis, Software Development and Maintenance, Systems Engineering, Training and User Support, and Project Management Support.

The Contractor shall provide technical support to manage system administration and a Help Desk located in Fairfax, Virginia, on a regular five day per week, 12 hours per day schedule, and on call 24-hours per day, including weekends and holidays.

The Contractor shall provide system administration and database management support to maintain, manage and upgrade Oracle Database Management Systems, Windows Enterprise Systems and an HP-UX Enterprise System.

The Contractor shall provide software development and systems engineering support for software development and maintenance efforts that provide ongoing and additional system capabilities for law enforcement information systems.

The Contractor shall coordinate the Government's Configuration Control Board to manage the system baseline for the project and to prioritize all development efforts.

The Contractor shall provide training and system exploitation support for training system users on analytic tools and processes and for providing user help on advanced system capabilities.

The Contractor shall provide program management support to manage all project tasks and staff and coordinate all project deliverables.

The Contractor shall provide support for data analysis and processing of large amounts of data in various formats from multiple sources.

The requirement is a single award for a three month period at a total estimated value of $2,167,446.00. An additional three months are optional with an estimated value of $703,636.40 per month.

2. An identification of the statutory exception from the requirement to use competitive procedures and a demonstration, based on the proposed contractor's qualifications or the nature of the procurement, of the reasons for using that exception.

6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements.

The Drug Enforcement Administration's (DEA) critical mission is increasingly dependent upon the ability to quickly and effectively access data in its automated systems. Through the use of information technology, the DEA is able to fight violent drug crime in the domestic and international

markets; coordinate and cooperate with other Federal, State and local agencies in mutual drug enforcement efforts; and effectively manage a national system that collects, analyzes and disseminates strategic and operational drug intelligence information.

The incumbent contractor, General Dynamics, is currently performing the required engineering and support services. The continuation of services and support is needed without interuption until a new five year contract can be executed/awarded.

General Dynamics provides varying levels of expertise, in which the skill sets and experience of the personnel provided to the Government ranges to ensure the product delivered meets the needs of the Agency. By balancing junior and senior level team members with the appropriate skill sets GDAIS can effectively manage the program's task keeping the Office of Special Intelligence's classified infrastructure available, secure and responsive to the changing needs of program.

3. A determination that the anticipated cost will be fair and reasonable.

The Government antcipates fair and reasonable pricing based on a rate comparison for similar services under current contract vehicles. The existing contract DJDEA-08-C-0049 was issued in 2008 and the prices for Option Year IV of the contract were determined to be fair and reasonable at the time of award. Based on current market prices, the Government expects to obtain a favorable price reduction. Further comparison was made with the ITSS-4 contract awarded with the Justice Management Division . Based on our analysis of that competive procurement, the DEA intends to negotiate comparable prices.

4. A description of the market survey conducted or a statement of the reasons a market survey was not conducted .

Market Research to the extent of identiyfing various contract vehicles of similar size and scope was performed . A Sources Sought Notice was not issued at this time due to the limited period of performance. It is the DEA 's intent to execute a competitive procurement during the existing period of performance.

5. A listing of any sources that expressed in writing an interest in the procurement.

There has been no written expression of interest to date.

6. A statement of any actions the agency may take to remove or overcome a barrier to competition before a subsequent procurement for those needs.

The DEA intends to conduct future Market Research to determine if the requirement can be set- a side to various socio-economic groups offering similar support services with the knowledge and expertise to support the needs of the Agency. DEA intends to execute a competitive procurement in FY 14 for a new contract for these services.
