Additional Instructions

2.1 SCHEDULE OF SUPPLIES/SERVICES

The contractor shall be capable of providing outpatient substance abuse, mental health (including psychiatric services), and sex offender treatment services to male and female offenders confined in community-based programs. The location where services are to be provided should be with a vendor located within 10 miles from the Brawley City Hall located at 383 Main Street, Brawley, CA 92227, and should be accessible to local public transportation.

All references to Residential Re-Entry Center (RRC) and Community Correctional Center (CCC) shall be treated equally for the purpose of this contract.

The performance period for the resulting contract will be a one-year base period (to begin upon the effective date of contract award) and nine additional one-year option periods. The anticipated performance start date is October 1, 2016.

Transitional Drug Abuse Treatment and Mental Health Treatment Services Decisional Rule Criteria Lowest Price Technically Acceptable:

Each quotation will be initially reviewed to determine that all document submission requirements listed under Addendum to FAR 52.212-1, Instructions to Offerors-Commercial Items, are met. By using the documentation submitted with each quotation, an initial review will also be conducted to determine whether or not it meets the minimum requirements contained in the Decisional Rule Criteria below. Any quotation not meeting this criteria may not receive any further consideration for award.

Quotes must clearly demonstrate at the time of submission, unless otherwise stated, the capability to meet the Decisional Rule Criteria below. Quotes will be rated "Acceptable" or "Unacceptable" based on the Decisional Rule Criteria. Quoters receiving an "Unacceptable" rating will be advised of their elimination from the procurement. Quoters receiving an "Acceptable" rating shall be considered for award.

Community Treatment Services Decisional Rule Criteria Lowest Cost Technical Acceptable:

1. The Quoter demonstrates a philosophy that adheres to Cognitive Behavioral Therapy (CBT) or they use a theoretical model compatible with CBT (e.g. Motivational Interviewing, Rational Emotive Behavior Therapy, Dialectical Behavior Therapy). Quoter shall submit a mission statement and/or treatment philosophy reflecting and describing their use of CBT and CBT techniques in the administration of treatment services. Quoter must identify and submit a written summary of any additional treatment protocols to be used. Quoter must clearly explain how the additional treatment protocols will be used and how the additional treatment protocols are compatible with CBT.

2. Quoter must submit a plan addressing the obligation to report negative information which comes to their attention regarding an inmate’s treatment or an inmate’s behavior which may be a threat to them or to public safety. In response to negative behavior, the Bureau may request the treatment provider deliver an intervention. Quoter must submit a plan identifying the use of CBT interventions to address negative behavior.

3. Quoter will accept all referrals made by the Bureau for treatment services. Quoter must identify any treatment services and/or inmate types Quoter is unable to serve, to include sex offenders in need of substance use, mental health, and/or medication monitoring. Quoter must submit a written statement clearly explaining the inability to serve, including any possible violations of local and/or state laws or ordinances.

4. Quoter must submit a plan for addressing Crisis Intervention Assessments (i.e. PREA and suicide risk) required to be completed within 24 hours of the request by CTS staff. Quoter will have crisis intervention procedures in place for emergency referral and evaluation of inmates, if the need arises and the inmate cannot be evaluated by the agency’s mental health provider.

5. Quoter shall submit a plan or written statement identifying how treatment files for Bureau inmates shall be maintained. Quoter must clearly detail and address how Bureau inmate files will be maintained separately from non-Bureau files, maintained on-site, and maintained securely. Any use or intended use of electronic database systems must be detailed and address the electronic system’s ability to meet the Bureau’s electronic security requirements. All persons with access to the electronic system must be identified and included on the List of Staff/Technical Personnel document.

6. Quoter must have a comprehensive inmate accountability program to be used in conjunction with the Bureau provided sign-in/sign-out logs that ensures every inmate is accounted for while at the Quoter’s facility. Quoter must submit a written plan identifying the staff member who will be responsible for submitting weekly treatment schedules to the RRC. Quoter must also detail how inmates will be accounted for upon arrival, during treatment, and departure from the treatment performance site.

7. Quoter must identify and demonstrate any and all proposed performance sites utilized in performing the contract are within the geographic restrictions. The Quoter shall submit a map (e.g. MapQuest, Google, etc.) plotting the proposed performance site(s) and the geographic restriction point. The submitted map must demonstrate the proposed performance site(s) is within the geographic restriction.

8. Quoter must ensure the performance site meets the space requirements for the treatment population. The use of audio/video monitoring of treatment sessions is prohibited. Quoter shall submit documentation (e.g., written summary, pictures) identifying the performance site layout and number of rooms. Performance site compliance with ADA, or a plan for ADA accommodation, should be clearly addressed by Quoter, to include restroom access. Quoter shall submit a written statement detailing any use of audio/video cameras or recording devices in the performance site for security or other purposes.

9. Quoter’s proposed performance site is currently available to provide the treatment services required in the Statement of Work. Quoter must submit a deed, lease, bill of sale, options to lease, or option to buy in the name of the Quoter. If the proposed performance site is at a RRC, the Quoter must submit a valid lease or intent to lease a defined space at the RRC dedicated to treatment. Any documentation submitted must show the proposed performance site is available and current at the time of proposed contract award.

10. The Contractor shall maintain all licenses necessary to operate a business and treatment facility as required by the state in which services will be performed. Quoter must submit a current valid business license issued by the state and or city in which the services will be performed. The business license must be in the name of the Quoter (Prime Contractor).

11. Quoter must complete and submit the Technical Personnel document attached to the solicitation posting to identify the position and responsibility of all personnel proposed to meet the SOW requirements, to include all employees, subcontractors, volunteers, and interns who have face-to-face interaction with inmates or who have access to inmates’ personally identifiable information, treatment records, contract documentation, billing invoices, or other inmate information. Resumes must be submitted for each listed staff member. The number of staff will be adequate to perform all services required by the contract. All authorized negotiators for the Quoter must be identified on the Technical Personnel document.

12. The Quoter’s program shall establish limits on caseload size and group size to ensure effective treatment. The Quoter must justify the caseload size based on the number of inmates to be served, program design, characteristics and needs of the population served to include gender concerns, and any other factors. Quoter shall submit a written plan identifying the inmate to therapist ratio for therapist caseloads. Quoter must also identify the limits for group size.

13. The Quoter shall provide or have access to appropriately credentialed bilingual staff for non-English speaking inmates. Quoter shall submit a written plan detailing availability of bilingual treatment services provided by appropriately credentialed bilingual counselors to non-English speaking inmates for as long as there is a need for such services.

14. It is the Bureau’s expectation treatment services will be provided during staff absences (e.g., vacation, sick leave). The Quoter is responsible for providing treatment services with staff that are equally credentialed to key personnel during these instances. Quoter shall submit a written plan detailing how treatment services will be provided and the personnel who will provide the services during scheduled and unscheduled staff absences.

15. The Quoter shall ensure all personnel providing direct clinical services to Bureau inmates meet the educational requirements and licensing requirements outlined in the SOW with appropriate licensure/certification to practice independently (i.e., without direct supervision) as required by the state authority where the services are being provided. A provisional license is not acceptable as a valid license to provide services. Interns or trainees must work directly (i.e., in the same room) with a licensed staff member when providing direct clinical services. The Quoter will provide staff that has experience in dealing with a criminal justice population. The Quoter must have a qualified practitioner (i.e., Physician, Physician Assistant, Advanced Practice Registered Nurse Practitioner/Specialist) with prescriptive authority meeting the standards of practice established by his/her state’s professional regulatory board to provide medication monitoring. The Quoter must have a qualified practitioner who is appropriately licensed to conduct psychiatric evaluations in the state where services are being provided. The Quoter must submit the name and position for all personnel providing direct clinical services. A resume, detailing type and years of clinical experience, and a current valid license to provide services in the state in which treatment services will be provided must be submitted for each staff member identified by Quoter as providing direct clinical services.

PRICING

Prices proposed to the Government shall be as low as or lower than those charges to the supplier’s most favored customer for comparable quantities under similar terms and conditions, in addition to any discounts offered for prompt payment.

DELIVERIES

In accordance with Federal Acquisition Regulation (FAR) 16.505, and the clause located in FAR 52.216-18, Ordering, states that any supplies or services to be furnished under this contract shall be ordered by issuance of task orders by a warranted Contracting Officer in the CTS Contracting Office.

BILLING INFORMATION

The Government will make payment on a monthly basis via Electronic Fund Transfer. Invoices with the contract number should be submitted on a monthly basis in duplicate to the Regional CTS Coordinator indicated in Item 15 of the SF-1449. Contractors that are classified as a small business are required to indicate their small business size status on each invoice submitted for payment.

3.1 INSTRUCTIONS TO QUOTERS - COMMERCIAL ITEMS

The provision at 52.212-1 is hereby tailored to modify paragraph (b) "Submission of Offers". As a minimum, quoters shall submit all of the following documentation:

· Completed SF-1449 (blocks 12, 17a, 17b, 23, 24, 30a, 30b, and 30c).

· Signed copy of any solicitation amendments.

· Completed copy of the representations and certifications at FAR 52.212 -3 (see paragraph (k) of that clause for those representations and certifications that the quoters shall complete electronically at www.sam.gov).

· Completed Federal Bureau of Prisons Service Contract Business Management Questionnaire.

· Copies of Client and Bank Notification Letters.

· Proof that the proposed facility is within the geographic restriction stated in Section 20, Description of Services on the SF-1449.

· Proof that the proposed facility is licensed/certified (as required by the controlling state, county, city, or other controlling public entities authority).

· Copy of the deed, lease, bill of sale or option to buy for the proposed facility to where services shall be given.

· Copy of a mission statement that reflects the use of CBT.

· Proof that the proposed facility is accessible to or accommodates inmates with disabilities. This may be done by ADA documentation or a personal statement detailing a plan for accommodations.

· Copies of licensed/certified clinical professional (e.g. psychologist, social worker, etc.) with documented substance abuse training to oversee the program. Individuals shall be licensed in the state in which services will be provided to offenders.

· Proof that the agency has a licensed clinical supervisor for all staff providing services. Submit current license from the licensing board.

· List of names and positions of each staff member that will provide direct services to the inmates.

· Copies of Primary contractors and/or subcontractors licenses that shall be providing services.

· Copies of the quoters plan for emergency situations to include a contingency plan for suicidal inmates. Quoters who fail to furnish any of the above submission requirements may be excluded from consideration.

· Proposals shall be submitted on or before the proposal deadline specified in Block 8 of the Standard Form 1449, page 1 of the solicitation. Proposals shall be submitted to the following address:
