D.1 U.S.-China Agricultural Biotechnology Safety Administration Cooperation Program
Phase IV Scope of Work
1. Background
The United States would like to preserve and expand the U.S. share of the growing Chinese market for agricultural products. China is the largest international market for U.S. food and agricultural products, accounting for approximately 20 percent of all U.S. farm exports.
Since China joined the World Trade Organization in late 2001, U.S. agricultural exports to the country have grown exponentially – and the U.S. Department of Agriculture’s (USDA) Foreign Agricultural Service (FAS) projects that long-term growth will continue. U.S. farm exports to China (including Hong Kong) reached a record $29.9 billion in fiscal year 2014, with top products including soybeans, distillers' grains, hides and skins, tree nuts, coarse grains, cotton and beef.
The United States and China enjoy a history of collaboration in agriculture that dates back to the 1970s. Over the years, the U.S.-China agricultural relationship has grown and strengthened through high-level fora such as the annual Joint Commission on Commerce and Trade.
The United States' engagement with China has encouraged China to adhere to international standards and to adopt rational, forward-looking agricultural policies that benefit both U.S. and Chinese producers and consumers.
Phase I Program
U.S. Trade and Development Agency (USTDA) began its relationship with the Chinese Government through funding the “US-Sino Agricultural Biotechnology Safety Administration Cooperation” (ABSAC) Program in 2003, which included technical training to Chinese officials in a number of policy and regulatory subjects. The training (i) reinforced policy discussions, (ii) reiterated the need for science-based regulatory systems, and (iii) promoted a better understanding of the U.S. regulatory framework for agricultural biotechnology. The ABSAC Program was funded under a cooperative agreement with the Council for Agricultural Science & Technology (CAST). The specific program activities included training for the Ministry of Agriculture (MOA) and the General Administration of Quality Supervision, Inspection and Quarantine (AQSIQ) in China, through a public-private partnership that included U.S.
agricultural biotechnology firms, industry associations, and the U.S. Government. This Phase I training program educated Chinese government officials about the nature, use, and regulation of agricultural products derived through modern agricultural biotechnology.
Combined, the ABSAC training program, BWG and TWG initiatives generated important policy successes. For instance, in February 2004, the Chinese government issued safety certificates that allow for easier importation of genetically modified soybeans and several other crops. These initiatives show that continuing dialogue through both high-level forums and training programs are crucial to safeguarding U.S. exports and promoting a transparent agricultural biotechnology regulatory system in China.
However, despite some measure of improvement, China remains cautious towards U.S.
agricultural biotechnology products and still employs restrictive environmental and food safety provisions, labeling policies, and trade-related barriers that jeopardize access of U.S. exports to Chinese markets. In particular, China’s ratification of the Cartagena Protocol on Biosafety of the United Nation Convention on Biological Diversity (a multilateral treaty that provides a framework for international regulation of GMO products) in April 2005 may lead to potentially harmful regulations for U.S. industry interests.
Phase II Program
In order to build upon the positive results from the Phase I program and continue the regulatory training and exchange of Chinese officials, USTDA and the U.S. Department of Agriculture (USDA) jointly developed a follow-up Phase II program that focused on bilateral information exchange and cooperation. The Phase II program funded by USTDA familiarized Chinese researchers and regulators with U.S. equipment and practices used in the testing and assessing of genetically engineered products, thus leading to potential exports of scientific testing equipment and services to the Chinese market.
Specifically, the Phase II program provided training aimed at strengthening China’s regulatory environment and enhancing market access for U.S. agricultural biotechnology products. Phase II training included a series of long-term (4 to 6 weeks) and short-term (1 week) exchange programs that covered topics in biosafety policy exchange, “stacked” crop varieties (individual crops that contain multiple genetically engineered traits), risk communication, food and environment safety risk assessment, and field testing training.
Phase III Program
Phase 3 activities were completed in 2012 and expanded upon the previous phases’ technical training in policy and regulatory subjects in an effort to reform China’s biotech system and familiarize Chinese researchers and regulators with the U.S. biotech system. The program was designed to promote the idea of an on-going U.S. Chinese partnership in agricultural cooperation.
Progress and Results
An evaluation of the Phase I-III programs indicated that considerable reform took place in the Chinese regulatory exchange that helped avoid potential trade disruptions that may stem from overly restrictive regulatory policies. USDA and USTDA view both the previous phases as having been successful and as having contributed to China’s decision in 2004 to issue safety certificates for genetically engineered soybeans and other crops, which has facilitated U.S.
agricultural exports to China. In addition, discussions with the U.S. industry and various industry associations confirm that they have also found the program to be successful.
Additionally, approvals of new soy products also increased U.S. sales to China. In addition, there have been some regulatory changes in China such as more frequent reviews for new products and more biotech product commercialization.
The program is also perceived by USDA and USTDA as having been well received by China’s Ministry of Agriculture, prompting a request of continued technical assistance from USTDA to help China further develop its agricultural biotechnology regulatory system.
Next Steps for Phase IV
Phase IV shall build upon the results of Phases I—III and capitalize on additional opportunities for regulatory and policy exchange and training aimed at furthering an understanding of the regulatory regimes and promoting agricultural cooperation and trade in products of agricultural biotechnology of our two countries. The program will contain two types of activities, long-term and short-term, which will take place in the United States and China.
The implementation of the project shall be carried out under the guidance of USDA Foreign Agricultural Service and in cooperation with China’s Ministry of Agriculture to ensure training is appropriately targeted.
The Terms of Reference contain a total of 7 tasks. The Contractor shall be involved in all of the tasks and report on the progress through quarterly and annual reports as indicated in the Scope of Work (SOW). The Contractor’s budget includes funding for all of the Contractor’s activities including logistics for all tasks. The Contractor’s role in Subtask 3.2 shall be limited to providing reports on the success of the program each year.
While the requirements of the SOW are for the Contractor’s industry experts to participate in all components of the program, given the sensitive nature of the discussions between the U.S. and Chinese Government officials, it may be appropriate for the Contractor’s industry experts to abstain from some of the more sensitive meetings between the officials of the two governments. The Contractor shall receive instructions from USDA and USTDA on those discussions and meetings that would be reserved to just the government officials.
The following Tasks are recommended for inclusion in Phase 4 based on Phase 1-3 results and stakeholder comments.
